To wonder if DH should appeal parking fine - photo included

Dh went to carpark last week. He parked slightly over the hatching instead of within white lines as he had a passenger and car next to him was quite close to white line. Obviously his parking isn’t great but worth an appeal for £100 fine?

It’s a thing this way. Folks have been fined as part of tyre has not been within the white lines, let alone outside the white lines.

He's quite a long way over the line, and the vehicle next door is within their space, he doesn't have a leg to stand on. He isn't parked to allow enough space for a passenger to get out he's just parked shockingly!

In my limited experience it is very difficult to win an appeal to a private parking company.

As pp says it costs nothing to appeal , and I've observed way worse parking that people get away with.

Private companies & ‘speculative invoices’ have little bearing

A private companies PCN vs a police or council PCN differ in law, with the latter two being able to issue ‘fines’ under legal definitions but private companies can’t. They can however issue ‘fines’ under the general definition of the word. They can also go to court and will be successful provided they have clear signs with the relevant information of the parking terms & fines

He has parked across the space, and is entitled to appeal, though unlikely to be successful so should read the information provided to consider whether it is worth the appeal (eg if he can still pay the lower fine rate on an unsuccessful appeal)

The car the other side is within 'their' white line? No idea why he would need literally a metre to get out! Unfortunately I don't think he will get away with appealing

Very annoying and I think all parking companies are totally unreasonable but you don't stand a chance in terms of an appeal, sorry OP.

There is one parking bay where I park regularly and I park right up to the line on one side as the bay next to the line is vast so that car always has plenty of space, and it gives everyone to the other side a bit more room as everyone can shuffle over a bit in slightly small spaces. But I always go in the lines in case of fining.

What's the hatching for @Forgottenidentity ? Could he argue he wasn't obstructing anyone by going over? If it's where the other cars drive round then he could be creating a hazard by being over, but if it's just a wall or a tree there and not enough room for another space then you could ask for the fine to be reduced as there's no hazard.

What is the setup of this carpark? Is it a private, free to use, carpark owned by Tesco? And they have attendants who walk around and give fines?

That’s not going to reduce or remove the fine. It doesn’t matter why they are there. You can’t park on them.

I'm not saying there is a legal basis but there may be a goodwill basis, depending on who is operating the car park. It's always worth a try, they are not going to increase your fine because you appealed, it will either be reduction/cancellation/no change.

Nope. DH once had one like this where he was out the line lengthways and it was due to the car behind him being parked too far forward so DH has no choice but to be out of the box. Though he did reverse as close as he could to the other car.

he appealed no luck.

your passenger could have got out first allowing him to park properly. 🤷🏼‍♀️

Of course he had a choice, he could have found another space!

The other car is within the lines of their space albeit very close to it. Therefore no excuse for how far over the hatching he is. If he had no passenger in the car then the parking is totally unnecessary, and even if a passenger they could have been let out before parking. Therefore no grounds for appeal at all!!

There isn’t any basis to appeal his fine, he’s parked over the line, so it is what it is, imo! Seems a bit overkill but it couldn’t be any clearer. He’s shit at parking mind 😂

Those hatchings are there for a reason, probably to allow other cars space to take a corner safely, and not just for the hell of it. That’s why he’s been fined. God help him if he does the same when he parks next to a disabled space and a wheelchair user can’t get into their car because he parked on the yellow hatchings, which are there to give them space to do that.

Was the passenger a moose? Why is that much space required for them to get out?

Also why do you think your husband specifically should be exempt from the rules everyone else has to follow? Is he royalty? A wizard? A doctor and he was rushing directly to a dying person?

Why is his meal deal more important than parking like someone who didn't get their driving license off the back of a box of Cheerios?
