It’s very very very simple. As a trustee of a trust which owns a residence for children under 18 - that counts as such for stamp duty. Thus had been mentioned many many times in the press and on here. It’s not complicated and takes a 2 min look at the HMRC website.

Tax law surrounding trusts is far from simple, and it is easy to see why there are misunderstandings and why it’s sensible to get proper tax advice where trusts are involved. Even just looking at the basic HMRC guidance, you can see your understanding is not entirely accurate.

One section of the SDLT manuals :

“Include any residential property that:

  • is owned on behalf of children under the age of 18 (parents are treated as the owners even if the property is held through a trust and they are not the trustees)”

Speaking more generally, tax legislation can also be different depending on what type of trust is involved.

Does there need to be? She broke the rules, her position became untenable, she resigned.. end of discussion. Should Starmer have fired her? Probably, but he also had every right to wait for the Committees report before making a move.

The telling thing for me has been how everyone else has behaved around it.. including apparently including people in glass houses with very short memories, throwing stones....

Rayner hounded anyone she could and then got found out herself. No excuses. She blew a good role, and will likely be out at next GE.

Tax is a legitimised form of theft and no on really wants to pay it There is nothing wrong with using tax avoidance schemes but you need to get the right advice rather than asking johnny on the corner.

I think she has pulled a blinder.

She now avoids the blame for the disasters that will come next e.g. the failure to build the 1.5m homes promised and the forthcoming employment rights and renters reform bills.

She also escapes any scrutiny over her handling of her child’s trust fund which would have truly ended her career.

Instead she will be back in the Cabinet in time for the next election, probably as leader.

I think she’d be great 🙌

I have some (very limited) sympathy for what she did and if she had fessed up and said “sorry I got it wrong, I didn’t intend to, but was trying to save money” as soon as it was brought to her attention, I would have had more.

in the end it was lying about what she did rather than her original actions that meant she had to go. stating that she had taken legal advice and had followed it was stupid. We cannot afford to have stupid ministers. This was the action of someone who panicked. We cannot afford to have ministers who panic - she had to go.

The use of personal service companies is not an illegal way to reduce tax bills.

Tax avoidance is not illegal, tax evasion is.

In any event Farage is not subject to any Ministerial Code

You need to learn a bit more about this before you write about it.

TBH - I think if she'd not resigned over this, then the media would have kept hounding and digging on anything she is involved. Trial by social media all over again. We do this until we break the individual's mental health.

We get the politicians we deserve.

I've no party loyalities, but I am kind of sad that a strong woman who battled her way to do a role she gave a damn about, is gone and there's not been a full conclusive investigation. Fair do's if if has been proved she was committing fraud or tax evasion.

Majority of smart decent people would never want to be a politician - you can do fuck all right and get publicly smashed to bits.

Anyone with eyes in their head can see this is a huge misunderstanding. Tameside and Hove have a long, shared history - the cultural ties make them hard to tell apart - not for nothing is Ashton known as "Hove by the canal", and the close proximity and excellent transport links make her choice of Hove a no-brainer. She should have stood up to the elitist, classist misogynists and stood her ground.

Firstly, she isn't his wife (not that it would matter if she was). Secondly, it isn't undeclared earnings - it is earnings paid through a company set up for the purpose. Neither of which are illegal (unlike not paying SD that is due). Even if his IR35 arrangements were deemed to be unlawful, it would incumbent upon the owners of GB News to hold responsibility under new laws around IR35. Farage is a lot of things, grifter, probably racist, divisive, nasty and an utter cockwomble. But one thing he isn't, I'm almost certain, is stupid. And I imagine he has (unlike Rayner) paid handsomely for the very best, water tight, Tax planning advice to ensure he is never caught out.

But this is a post on Rayner resigning. If you feel Farage needs to resign too, then why not start another post? Her supporters all week have been doing the same ' okay, its happened. Let's move on. Nothing to see here, but, but, look, look over there........'
