Fucking fuming - child maintenance review

Got child maintenance review today. DC dad declared he earned £13,248 last financial year. He claims he works 6 days a week and is always late picking dc up due to work and works every weekend even the Saturdays he has dc. He owes £1254 in arrears via the cms and £2500 from before I applied to the cms (obviously I have written that off) so now I get the princely sum of £29.30 a week but not before cms have taken their 4%.
is this a joke? How do men like this have no shame? I know there is nothing to be done I am just venting. I have never included his money in my budget thank god but that doesn’t mean I don’t need it! I work full time and I work hard but why do men think this is ok? Why do the girlfriends think this is ok? Why do the father’s parents think this is ok? I have 3 boys and no way would I be congratulating them on avoiding maintenance.
Oh, and he’s a plasterer 🤣

How does that help him though? What am I missing? He has to live somewhere officially surely? When he lived with his brother he had all post sent to his parents as it was ‘easier’ e.g car was registered at parents. But when his brother kicked him out his parents said he can’t live with them because it would affect their benefits. He has dc at his parents house every other weekend as he (and me!) won’t allow his gf to meet dc

It might not be about helping just him.

If his girlfriend isn't working and has children then she's likely claiming benefits herself. His income would then be taken into account for that claim - he would have to show his books etc for UC.

When a friend of mine went from being a single parent to a disabled child to living with her partner she lost all benefits except her carers allowance and the child's PIP. It was several hundred pounds a month - which in their case they were happy with as a couple as he earns enough to keep them all as a family and they were happy with it.

It may be different now, but when I was at CMS and they were talking about where frauds can occur the majority of deliberate UC fraud was not declaring a partner.

It’s how it works
if he lives with someone with kids the kids are used as a deduction for your maintenance

totally stupid and unfair

as I said some people are thick and she probably dosent realise this is the case

She isn’t thick and neither is he. They will play ‘the system’ though. Goes back to my question - he has to be registered at a house somewhere surely?

According to the review there are no other children taken into account. She has 5 dc (1 adult and 2 dc who are 12 live with their dad) but the other dc would definitely be named if that meant a reduction in maintenance so why hasn’t he named them?

Because the reduction he would get in paying you maintenance is a pittance compared to her benefits as as single parent

Mine played super stepdad all the talk about stepping up his family were the same love bombed dd with holidays days out nan of the year? Nan of the century!

They have NOTHING to do with the bio children/grandchildren now nan is playing nan of the century to her step grandchild from his latest relationship

CMS will have an address for him. I'd bet you his parents house is his official address given that he's used that for the school.

If they're playing the system with her claiming as a single parent it'll be worth far. more than the discount for her children

He knows how to game the system with his self employment to reduce maintenance so the chances of him not knowing about the reduction for her children is nil.

Therefore it simply must be worth more somewhere else for them not to be declared.

Not necessarily
if he isn’t claiming any benefits then he don’t need an address

He might have no fixed abode or care of address

honestly it’s not hard to do
i would bet money on she is claiming as a SP and he is living there unofficially

if he’s not on the electrol role no credit / bank accounts at the house then it’s hard to prove

Are they aware he is married
are they aware he owns a house

if he is on benefits sometimes you have to do the work for them

find out where he is living
get the house deeds / it will say who owns it
Get social media info
If he is renting out property that will be taken as a income for benefits

Yes you can have the your address as the benefits office
so he could be doing that
if he is on benefits he could have a room rented / HMO as proof of address and get the rent paid

however irs pretty hard to stay on UC unless your in the support / illl health group so he could be doing that

So, playing devils advocate , if they were legitimate living together and his declared earnings were honest and true - why wouldn’t he declare his step kids?

The only reason not to declare the step kids

1 the benefit she gets by him not being there officially is more than any discount

2 they aren’t aware of it

3 most men who don’t support ie kids are perfectly aware of this loophole

In January when he missed maintenance (again!) I may have laughed at him and told he was shit at his job because everyone I rang in his area for a quote were fully booked up and charging £275 a day 🙈

I completely get that people do jobs that need doing and aren’t paid properly for it - those jobs will always exist.

I completely get that being a tradie can be hard and work can go in cycles.

I don’t ever want to claim anything off anyone if it causes them hardship.

How old are his parents? Do you know what benefits they claim? Depending on what they are he may not affect them at all, or if he does by very little.

It's a hard realisation that one. I remember the day that I realised my ex was one of those guys about child maintenance like it was yesterday - our daughters are mid twenties now.

Why indeed? There would be zero reason not to.

In fact if his earnings were genuinely so low and he's the only one in the house working then he'd be a fool not to do so when the opportunity is there.
