Finally.

There is no “triumph” for me.

i am delighted though.
I feel relief that this reasonable request for clarity has been heard.

The judge also said “the law still gives trans people protection against discrimination.”

As it should do. No one ever argued otherwise.

Am I being a bit thick here? What else could it possibly mean? I avoid most sex and gender discussions on MN as I often disagree with the majority and don’t want to be piled on, but even as someone who has no issue with trans people, I thought the argument had always been the sex=biological? I’ve not come across any trans people or “trans activists” that disagree with this.

Firstly we don't have an issue with trans people. It's with MALES.

Secondly, if you had paid attention instead of choosing ignorance is bliss, you'd know there are many transwomen (and allies) that truly believe they have changed sex by taking hormones that it changes their sex. They are that ill that they genuinely believe they actually change their sex. Hormones apparently alter chromosomes, DNA and 'body chemistry' to become females. This is only one example I have; I have lots of screenshots especially from transwomen who say they are biologically female. Also note India Willoughby and the Fife transwoman doctor who says he is biologically female (and he is a doctor, ffs!)

You do have to laugh (wryly) at those who deliberately stuck their fingers in their ears and chanted 'be kind' now claiming that they hadn't picked up on the nuances of the argument. Which women have been discussing at length. For years.

But anyway, massive thanks to For Women Scotland for fighting ceaselessly for the rights of women! We're bloody lucky to have them.

Agree totally. The problem is that the genderist lobby has deliberately conflated "discrimination against trans people" (which is and should be illegal, for example when it comes to who gets housing, a job etc, and of course protection against any kind of persecution) with knowing what sex someone is and daring to say so. The way this has been pushed into schools, the NHS, police, corporates etc means lots of people - including actual police officers and NHS staff - think it's discriminatory and wrong to not think and behave as if TWAW in every circumstance.

"Discrimination" doesn't mean understanding that a TW is a man and acting accordingly when lesbians and other women need safety and dignity and spaces of their own. It means discriminating against trans people in the exact same way that discrimination apples to other protected groups.

A LOT of people need to get this into their heads, and lying propaganda from the likes of Stonewall and similar genderist orgs must be weeded out and banned. It would be if it related to any other protected category.

European Court of Human Rights (ECtHR), but the process is complex and not a direct appeal. The ECtHR cannot quash, vary, or revise the UK Supreme Court's decisions. Instead, an individual can apply to the ECtHR if they believe their human rights have been violated by a UK court, including the Supreme Court, but the ECtHR will not rehear the case or directly intervene with the UK court.

It's a massive relief and I got quite teary watching the women singing after the ruling. However, I'm not particularly looking forward to having to explain this to my grandchildren one day in the future, if they ever ask why society went so unbelievably stupid in the 2010s and 2020s.

Isn’t this ruling saying they still wouldn’t be counted as a woman though as they’re not biologically female? Though I guess if they’ve changed their birth certificate how can you prove they’re not short of invasive tests which nobody wants…..can they change their birth certificate? I thought they got a gender recognition certificate or something but I’m maybe out of date?
