Supreme Court rules the term sex refers to 'biological women'

Finally.

There is no “triumph” for me.

i am delighted though.
I feel relief that this reasonable request for clarity has been heard.

The judge also said “the law still gives trans people protection against discrimination.”

As it should do. No one ever argued otherwise.

Excellent decision.

I wonder if the dictionary will update it's definition for 'woman', which currently includes "an adult who lives and identified as a woman"? dictionary.cambridge.org/dictionary/english/woman

dudsville · 16/04/2025 10:53

I am feeling celebratory. It should never been an us or them issue.

MinnieMountain · 16/04/2025 10:46

@StopGo 2 women and a man. The man only read out their joint ruling.

Think it was two women and three men and unanimous. But the wording of what was read out was by two women and a man. (Hope I got that right).

EnjoythemoneyJane · 16/04/2025 10:55

So basically back to where we started and no different to existing provisions, ie biological women and transgender people being equally protected, but by definition separately, under the Equality Act.

That it’s taken this much of a fight to simply acknowledge that the existing provisions were fit for purpose, and that ‘Science’ and ‘Facts’ are a thing, is a fucking outrage.

I’m relieved but still so very angry at what we’ve put through in the name of ‘be kind’ and ‘progress’.

BeReet · 16/04/2025 10:56

This is a fantastic decision and I hope that it will lead to a complete collapse of all this gender identity nonsense. I have had enough of it to last me a lifetime. Congratulations to all women everywhere who have resisted, objected, acted and defied, our effort and persistence is paying off - we will never wheesht!

I'm feeling very emotional at this ruling. I've argued with friends over this and been called a bigot and shunned. I think I might send the link to each of them.

I’ve also been called a bigot by people close to me. Its horrible. I’m very thankful for this ruling and the work of FWS and all involved.

For instance. Dr Upton earlier this year told the court that he was a biological female and deserved access to all female single sex provisions at NHs Fife. He said his identification says he was female and he was biological not a robot. It is the level of dishonesty that we have been seeing for more than five years. This exact argument was used by MCKinnon when he as a male athlete added his testimony to others in front of the IOC to continue to allow male people into female Olympic sports.

I couldn’t agree more that this is wrong. The majority of people supporting trans rights that I know would also agree. The pushing of sex over gender has always been a fringe section of the trans community but for some reason is pedalled as if it’s the majority. It’s typically poorly informed “do-gooders” that push the opposite, ultimately doing more harm than good for trans people.

knackeredcat · 16/04/2025 10:57

At last, but it's crazy that the definition was even up for debate! Common sense, and again relieved but not jubilant.

pinkingshears · 16/04/2025 10:58

I am utterly relieved. I'm the parent of a female young person who has been told she 'must be Trans' if she had feelings for other female young people (she does, we chatted about it & she said she was gay). But the school 'Trans support' person (who is also the ASD support worker) phoned me with the 'changed name & pronouns she & yp had decided on today' & when I was initially confused (she called up talking about 'your son, X') I was accused of 'trans hate speech'. My yp is Autistic & semi verbal. We are in Scotland. Sorry to give anecdata, but this ruling protects all women, including my YP.

StopGo · 16/04/2025 10:38

So a man has sat in judgement of who I am?

I doubt the judgment mentioned you at all.

Despite the insanity of the last few years, we all know you don't have to be a woman to know what a woman is and you don't have to be a man to know what a man is.

Thankfully, the three men and two women judges are sane.

The fact it was needed is FUCKED UP but happy to see this none the less !!! 🙋‍♀️🧬

wizzywig · 16/04/2025 11:01

Thank you everyone for spelling out clearly what this all means.

Mba1974 · 16/04/2025 11:02

What a fabulous fabulous day!! Couldn’t allow myself to believe it would happen 💪

Moonshinerso · 16/04/2025 11:03

Hopefully the term’ cis woman’ can be obsolete now.

MinnieMountain · 16/04/2025 11:03

Was it @Gettingmadderallthetime ? Fair enough. I only read the BBC comments.

OutandAboutMum1821 · 16/04/2025 11:04

Excellent decision, relieved that common sense has won out today.

Lovelyview · 16/04/2025 11:04

So pleased to hear this. Feeling quite emotional.

I would literally never use this term, and I would firmly correct somebody if they ever referred to me as one…nope, I am a woman 😊

LyingWitchInTheWardrobe · 16/04/2025 11:05

I agree with all on this thread. Thank goodness that common sense has finally prevailed. I'm appalled though that it took so long or was even needed at all?

Strange days.

Alilacat · 16/04/2025 11:05

Sensational. The change in direction away from the weaponised empathy crowd’s point of view will now increase in speed. Phew.

Am I being a bit thick here? What else could it possibly mean? I avoid most sex and gender discussions on MN as I often disagree with the majority and don’t want to be piled on, but even as someone who has no issue with trans people, I thought the argument had always been the sex=biological? I’ve not come across any trans people or “trans activists” that disagree with this.

You avoid the discussions so have limited understanding of what is and was happening.

Sports bodies allow males into women only sport if they say they are women and female.

The UK are placing males into female prisons if the male says the magic words "I am a woman" if they did not say the magic words they were sent to a male prison, the police were recording male sex crimes as being carried out by women with a penis.

Fife NHS is spending tax money on an employee, a male doctor who stated in an ET that he expected that he would be brought by other staff to women who asked for a woman doctor. The medical hospital which provides sexed health care have by law to provide changing spaces based on the sex of the employee not on how the male doctor feels, yet they are defending allowing the male use the womens changing room.

Scotish women had to fight to remove wording from legislation which would have allowed a State appointed medical examiner in a rape/sexual assault case to carry out a medical exam for the State's court case on a witness who was raped/sexually assaulted when the witness had asked for a specific sex when the medical examiner was not of that sex. The argument for the State appointed medical examiner carrying out a second sexual assault was that the employee had "rights".

Great news.

I feel the same! It felt insulting, now there’s no reason to use it as woman quite rightly refers to biology.

NameChangedForThis2025 · 16/04/2025 11:07

I want to say a heartfelt thank you to all the women who have stuck their necks on the line to make this happen.

I’m sure you’ve been afraid how this would impact your jobs and your relationships but you’ve bravely forged ahead despite this.

Those of us trying to quietly hold to our principles but too scared to make lots of noise are in your debt.
