Supreme Court rules the term sex refers to 'biological women'

Finally.

There is no “triumph” for me.

i am delighted though.
I feel relief that this reasonable request for clarity has been heard.

The judge also said “the law still gives trans people protection against discrimination.”

As it should do. No one ever argued otherwise.

Interesting. Does this mean Trans Men will need to use women's toilets / single sex spaces?

Not "need" but rather that men also have a right to single sex spaces too.

But if a employer is providing SSS they can lawfully exclude female employees from the mens areas and request all women employee use the womens area and not have to provide one person areas for individuals.

CrazyCatMam · 16/04/2025 11:51

Thank fuck for that.

We should never have had to fight for it though.

Great result, Felt like the world was going mad for a while

How does it work when it comes to sports / competitions etc though if anyone can enlighten me?

This is wonderful news. A few years ago I honestly didn’t think we would get here. Well done FWS and all of you magnificent women, I am proud to be part of the army.

Well done. Thank you to everyone

TeenLifeMum · 16/04/2025 11:53

I can’t believe we need a court to tell us this 🙄

I work in there nhs and the blurred lines and fear of offending people is leading to inaccurate record keeping that reflects emotions rather than biology. I will respectfully call anyone the name they want and respect their chosen gender (whether I understand it or not) but sex is science and denying science is my line.

Agree, very well done to FWS, that must have taken a lot of fighting!

It means that they can. It also means that trans men who become pregnant receive the protections for pregnant women under the equality act. Both of which are entirely right, because they are biological women.

Such an important decision for women and girls. And for the laws of the land - enshrining a lie that a man can magically become a woman belittles truth, facts and science.

So many thanks to For Women Scotland, Sex Matters, the LGB Alliance & the Lesbian Project for their contributions to this case and to every single woman (and man) who's spoken up in any way - no matter how small - to restore the rights of women and girls to privacy and safety. Flowers

Completely agree - thankful to all those who stood up and were counted despite some hideous behaviour from people and organisations happy to throw the female sex under the bus.

Ereshkigalangcleg · 16/04/2025 11:56

So very relieved, and pleasantly surprised. Well done FWS 💪

So a man has sat in judgement of who I am?

@StopGo
Are you surprised that an educated man knows what a woman is?

But if a employer is providing SSS they can lawfully exclude female employees from the mens areas and request all women employee use the womens area and not have to provide one person areas for individuals.

Is that "can" or "have to" though, that's what I'm not quite clear about?

For example, at work we have gents and ladies toilets. Our equality training says trans people can use the toilets of their acquired gender, and that other employees can not object and shouldn't question them about this. Does this ruling mean they now have to change their rules so that trans people use the facilities for their biological sex, or can they now just declare the toilets separated on the basis of gender rather than sex and carry on as they are? That's the bit I'm not totally understanding.

Or in the Brighton case about refusing to exclude transwomen from the women's support group, they now can't call it a women's group and still include transwomen, but there's no obligation on them to actually provide a women's group if they don't want to?

UK government says ruling brings claritypublished at 11:19
11:19BREAKING
Reacting to the Supreme Court ruling, a UK government spokesperson says: "We have always supported the protection of single-sex spaces based on biological sex.
"This ruling brings clarity and confidence, for women and service providers such as hospitals, refuges, and sports clubs.
"Single-sex spaces are protected in law and will always be protected by this government.

I really hope that they actually mean this and there is no ambiguity.

They generally call them “safe spaces” deliberately so they can avoid coming down on one side. Nice to have the clarity here though. That “always” is doing some heavy lifting there.

Yes, the change from the ambiguous 'safe spaces' is at least a good place to start. Mind you, since the nurses have started to take the NHS to tribunals, I think that the government has realised that the smokescreen of 'safe spaces' simply will not work anymore.

JandamiHash · 16/04/2025 12:02

I have to say I’m annoyed the judge has told people it’s not for one group to triumph over another. In other words: women - STFU and don’t upset the men.

Well fuck that sentiment, you don’t tell me what to do - it IS a triumph. It’s a triumph of common sense over delusion. A triumph of women over entitled womb envy obsessed men. A triumph of girls in sports over people who want them to compete against boys and STFU if they don’t like it. It’s a monumental triumph, and we should celebrate it

TheKeatingFive · 16/04/2025 12:02

We have always supported the protection of single-sex spaces based on biological sex.

Im not sure this is an entirely truthful statement, but hopefully this ruling eliminates their wiggle room.

I was just wondering this. How long until we have stories about men/trans men in ladies loos saying “but I was born female”. And how will that affect sports? Can a biological female pumped full of testosterone compete against women?

Anjo2011 · 16/04/2025 12:04

The right decision.

Helleofabore · 16/04/2025 12:06

Gettingmadderallthetime · 16/04/2025 11:39

I am hoping it might lead to a reconsideration of how to make trans people feel safe in the spaces allocated to their biological sex. Not an issue for transmen, but for transwomen the current solution of 'making women budge up and shut up otherwise be accused of discrimination' has been judged incorrect. Male spaces should be safe or have accommodation for all who are born male.

Wouldn't that be nice!

That should have always been the focus. But instead, we have the current situation.

Am I being a bit thick here? What else could it possibly mean? I avoid most sex and gender discussions on MN as I often disagree with the majority and don’t want to be piled on, but even as someone who has no issue with trans people, I thought the argument had always been the sex=biological? I’ve not come across any trans people or “trans activists” that disagree with this.

You've slept through at least a decade of anti women activism, laws and policy then.

No because there are rules about drug use, which would include testosterone

tillyandmilly · 16/04/2025 12:06

Wahoo!!!

MelOfTheRoses · 16/04/2025 12:07

A clear and straightforward judgement.

Men are not women, never have been and never will be. Men who think they are women are not discriminated against and have their own protection so they do not lack human rights.

Organisations can stop discriminating against women to enable this misinterpretation of the law and are liable for having done this in the past.

I don't know where to start with this, you obviously didn't have the faintest clue what was going on.
