Supreme Court rules the term sex refers to 'biological women'

Finally.

There is no “triumph” for me.

i am delighted though.
I feel relief that this reasonable request for clarity has been heard.

The judge also said “the law still gives trans people protection against discrimination.”

As it should do. No one ever argued otherwise.

Fabulous news!! Common sense finally prevails 👏🏼👏🏼👏🏼👏🏼

I no longer have to put up with the label a "person with a cervix" I can return to being a glorious, fabulous and original WOMAN! 🙋🏼‍♀️🎊🎉🥳😁

Cleebope2 · 16/04/2025 10:38

So transwomen can now be called certificated women by law. That’s ok by me. The difference is literally certified. Thanks to the amazing Scottish women for leading this campaign. With JKR financing.

JohnKettleyIsAWeathermanAndSoIsMichaelFish · 16/04/2025 10:39

I'm feeling very emotional at this ruling. I've argued with friends over this and been called a bigot and shunned. I think I might send the link to each of them.

ItsUpToYou · 16/04/2025 10:40

Am I being a bit thick here? What else could it possibly mean? I avoid most sex and gender discussions on MN as I often disagree with the majority and don’t want to be piled on, but even as someone who has no issue with trans people, I thought the argument had always been the sex=biological? I’ve not come across any trans people or “trans activists” that disagree with this.

This needs to be said over and over.

There was always a need for legitmate discrimination. And women have been talking about this in terms of that legitimate discrimination and being called transphobic and hateful and bigots. But there was always a need to discuss it with precision so that people with gender identities had protections where they needed it but not over riding the protections for women and children.

EmilyDickinson · 16/04/2025 10:41

I have to say I am massively relieved by this. I’ve felt like I was living in a world where I had to go along with 2 + 2 =5 or be vilified. I wonder whether public attitudes to JRK will change now.

The ‘majority’ think you can’t change sex and men can’t become women and should therefore stay out of spaces and sports that are female only. What
part of that do you disagree with?

There are plenty of male people and other trans activists who have stated that male people are indeed female people. Because their identification says so and because they have a certificate that says so. Or because they feel they are.

Therefore they have demanded that they are always allowed access to single sex provisions for female people.

Excellent decision, well done to everyone who got us here

I think the idea is (was) that ‘woman’ actually referred to gender identity. Ie women were people who identified as a woman, not necessarily because they were female

DoddlesMcDoddle · 16/04/2025 10:29

This is so FUCKING FANTASTIC! So now Fife NHS are fucked. This is great news. Transwomen are not women and never were and never will be. Women are Adult Human Females. And transwomen not to be in female spaces. I think we'll be headed for third spaces/categories/definitions; male, female, and gender neutral. Which is WHAT WE ASKED FOR, FOR YEARS but trans rejected it. Too bad for them now, hah!

#Up the women!
#Womens Rights Are Human Rights!
#Feminist REVOLUTION!!!

Its the taxpayer who will loose out in that and all cases. The management will continue to spend other peoples money and get paid high salary while doing so.

But lets see if the Fife management have the courage to ask that the "dear doctor" who is not able to identify a female or a male gets some extra CPD to be able to take a basic medical history while being let loose on the general public.

And how Fife propose to manage the risk medical and sexual assault as staff in the A&E were being bullied by a team who expected staff to bring a male doctor to a woman who requested a woman doctor.

The copium has started elsewhere. Someone on Reddit has just assured me this ruling means people with a GRC have actually changed sex and this is a real own goal for terfs.

Interestingly, Reddit bans people who give the opinion the supreme court has given today. Will be fun to watch how they handle this.

For instance. Dr Upton earlier this year told the court that he was a biological female and deserved access to all female single sex provisions at NHs Fife. He said his identification says he was female and he was biological not a robot. It is the level of dishonesty that we have been seeing for more than five years. This exact argument was used by MCKinnon when he as a male athlete added his testimony to others in front of the IOC to continue to allow male people into female Olympic sports.

scandalito · 16/04/2025 10:45

I am monumentally relieved. But I don’t think I will ever get over the collective madness and gaslighting of the past decade. Well done all the women warriors who fought for this. For Women Scotland are absolute heroes.

MinnieMountain · 16/04/2025 10:46

@StopGo 2 women and a man. The man only read out their joint ruling.

None of it. Which is why I’m confused. The only argument I’ve ever heard from “trans activists” is that there is a difference between sex and gender. Where sex (ie biology) is relevant (such as in sporting events), only biological females should be allowed. I thought that was a given.

FondantFancyFan · 16/04/2025 10:47

They all thought they were being "inclusive" by erasing the term biological woman. I wonder if the hardline gender fundementalists will acknowledge how misogynistic & sexist their man made ideology is.

MissScarletInTheBallroom · 16/04/2025 10:49

Huge thanks to For Women Scotland for not giving up.

GarlicSmile · 16/04/2025 10:50

A BBC bulletin I heard this morning said that the law currently says a person, assigned male at birth, who has a gender recognition certificate "has changed sex for all purposes".

Not only is that not what the law says - it's "for all legal purposes" - but how fucking stupid do you have to be to tell the nation that a certificate changes a sperm-producing body into an egg-producing one?

Relieved to see Lord Hodge's sane and measured decision and still very pissed off that this was even necessary. It's gonna be a long road still. Thank you, For Women Scotland!

Cleebope2 · 16/04/2025 10:50

Joanna Sherry just now: lesbians are not attracted to men and are not attracted to certificates. Priceless.

Hoppinggreen · 16/04/2025 10:51

Fucks sake, how is this even a thing?
Will more money and time have to be wasted on ruling something bloody obvious that everyone has known since humans existed is a fact as well?
Glad this is the decision but sad and flipping angry the whole thing was even necessary

RedToothBrush · 16/04/2025 10:51

So women have rights and trans people still have the rights they always had under the existing law

Nothing has changed.

Except that now women can't be called bigots and can actually use the rights they always had and people who tried to deny them these equal rights will have to stop over reaching and pretending the law says they have additional rights to ignore the rights of women.

Everyone wins.

UndermyShoeJoe · 16/04/2025 10:51

About time.

SugarPlumpFairyCakes · 16/04/2025 10:52

And it does annoy me that we are now referred to as Cis Women because some men have decided they think they know what it’s like to be a woman and think they want to be one.

So even the word ‘woman’ has to be altered to accommodate these men. To differentiate us. For them.

narcASD · 16/04/2025 10:53

All that wasters money to confirm something that didn’t need confirming in the first place, still good news though
