They don't seem to be saying yet what breed of dog it was, only that it was a 'fighting dog'

What's worse is that the owner was charged with it being dangerously out of control back in November too.

That poor man and his family.

To determine if a dog is typed as a pitbull or XL the dog officer (forgotten the proper terminology) looks for certain criteria - the squareness of the head, the height, whether it has a petrol pump tail etc.

If you have a dog where the mum is a labrador and the dad is a staffy or ddb, it doesn't matter if you can prove the breeds or the dna, it's purely about looks.

So an officer uses his own subjectivity to determine if a dog meets some arbitrary list of characteristics for a dog breed that doesn’t exist? That’s incredibly illogical, given that the reason for banning “pitbulls” in the first place is that they’re supposedly “bred for” fighting and it’s still “in their blood.” A dog could have just enough characteristics to look like a “pitbull” but not actually be related to any of the original fighting breeds, and be taken from its owner or have unnecessary restrictions imposed on it/the owner.

“Pitbull” is not an actual breed of dog, so I don’t see how you can ban it. There are lots of other dogs bred for fighting off predators, serving military and police purposes, or protecting their owners, and nobody’s calling for the banning of those breeds for potential aggression.

Also like.. how does breed banning even work? Like if my dog is mixed with Labrador retriever and distantly descended from a Staffordshire terrier, and someone calls the police because I own “pitbull,” what are they going to do if I say he’s a lab? DNA test him?

Nor are XL Bullies, they are a ‘type’. Anything crossed with these or deemed to be of this type is covered under the DDA.

Whether a dog is deemed to be of this type comes down to a listed set of features and specific measurements. They would look at its features and measure various aspects of it such as height, muzzle length to head length ratio, leg length etc. not carry out DNA tests. If the dog did not have a high percentage of matching measurements or features it would not be classed of type and if it did it would. The list of specifications to be classed as an xl are pretty broad.

What I don’t understand is, if this dog had already been subject to being dangerously out of control and identified as a banned breed, regardless of whether it could be proven exempt or not, is why it wasn’t seized back in November. Will the dealing officers be subject to disciplinary action for failing to seize the dog prior to this happening!?

Yes, that's exactly how it works. Just measurements and looks.
