Nikita had such terrible bruising, a paramedic hasn't seen such extensive bruising, she had to have a tampon removed from her cervix, she's had her house/car attacked, mum threatened, intruders broke into her home and tried to stab her bf/ threatening her and her bf he tried to pay her off in 2019 for a million, she said no I want justice.

A civil action was taken by Nikita Hand who had accused McGregor of raping her in a Dublin hotel in 2018.

It wasn’t a private prosecution. She sued him. People sue people everyday. It isn’t prohibitively expensive and you can get law firms who will do the work and only get paid if you win.

I think you are wrong.

Ms Hand’s ordeal is not yet at an end. A hearing to determine who should pay the costs of the two and a half week long trial, estimated at "well over" €1 million, is due to take place this week.

@ScrollingLeaves Irish law is different to UK law. Social services/Tusla here are very very different in how they deal with things compared to the UK.

This case was discussed on Woman’s Hour today.

It was clear that bringing this civil suit for rape was uncommon.

The costs are over 1million euros. (Obviously the 250,000 won’t cover that.)

There was no mention on the programme of ‘no win no fee’.
But obviously even if the solicitors and barristers had taken the case on this basis, and got the 250,000 they would still be owed a a very great deal.

Lawrence will have his costs owed too as he was found not guilty. Who will pay them?

There will be another hearing next week about costs.

The reason for wondering about the costs of a civil suit are that it could be a way for women to get some sort of justice more often when rape has become virtually decriminalised in practice ( as it can rarely proved 99.9 - 100%).
But as the costs are so high it seems very difficult to envisage this.

I could be wrong but I believe Lawrence was there as a witness for MG. He SAID he had sex with Nikita, she said he didn't, she was not suing him for rape as she didn't accuse him of that. The jury found that he didn't.

So as far as costs are concerned, I can't see how she would have to pay his if she didn't actually sue him for assault and rape. I think he was a patsy for MG to sully N's reputation.

I could be wrong about all that, but maybe someone with experience of the awarding of costs would know.

Lawrence was a co-defendant. She accused him the same as accusing McGregor. He won his case though.

They’re having a hearing to determine who pays the costs, but the starting point is that the loser pays the costs. So McGregor will be responsible for the bulk of it, but she may have to pay Lawrence’s costs.

She did also sue James Lawrence. But he was found not liable.

James Lawrence would have had legal costs , but maybe Womans hour aren't aware that James Lawrence didn't pay his own legal costs.

Its been reported on several news sites, that Conor Mcgregor paid James Lawrence's legal costs for him.

Civil Rape Case against Connell McGregor

Orla O’ Donnell Legal Correspondent for RTE News is speaking.

The discussion of this case is the first item on Woman’s Hour, beginning 1.53 minutes in.

At about 12:19 minutes in Orla O’ Donnell says,

The award of damages is on the low side. It’s not going to allow her not to work again.
(They had been discussing how difficult it is for Nikita to work at present with her PTSD).

She is going to face a costs hearing next week

Costs more than 1 million euros.

Because James Lawrence in effect was found not to have assaulted Nikita Hind, he, as normal things go, he would be expected to get the costs, and that could take up a lot of the money that she was awarded in damages by the jury, so it remains to be seen what the future holds for her.

His family connections to the Kinahans now on the DM, with a list of all the previous accusations against him, his drinks being taken off the shelves by distributors, losing endorsements. The house of cards is falling.

I bet he is punching holes in the walls of his house, A gurrier if ever there was one.

I hope Nikita and her family are safe.

It certainly reads like it.
Such damming medical testimony yet the DPP couldn't/ wouldn't bring it to court.

The DPP aren’t part of the gardaí (the police) @Raineys.

They didn’t think there was sufficient evidence for a criminal prosecution to be successful. The burden of proof is higher than for a civil case.

Even if he was some random man on the street or even a celebrity everyone in the public hated, this case would never have gone to court due to how bad a witness she was. Her behaviour would have been ripped apart and a jury would have let him go. Civil cases are easier.
In a criminal case, she was not a sympathetic victim. It sound awful but it’s true. Rape cases almost always come down to he said/she said in the minds of the jury, and juries very rarely convict even with an angelic victim. They wouldn’t have convicted. Prosecutions can’t be brought without a good chance of conviction:

I just read her comments on the DM, what a nasty witch, which to be fair, you would need to be to stay with someone like him. I know there was some sympathy for her, but that post really shows she does not deserve any sympathy at all, both of their credibility in the gutter.
