Ordered a coat from a known French store (£295)

Been receiving update emails and it was due to be delivered today

Made sure to stay home and at 2 received a notification saying it has been delivered
It has not

I was home waiting. The doorbell is working. I did not have headphones on nor went shower just in case.

Sent the store an email demanding my money back. I don’t want to be re-sent the same item and I don’t want store credit either.
I know it is not their fault but it us not mine either. I kept my end of the bargain which was to pay and stay home to open the door.

Now will have to go out and see if I find a coat somewhere as I plan to wear it tomorrow.

Where do I stand? Anyone been through similar?

The evidence is the email from the carrier that it has been delivered - I sent them a screenshot

But that isn’t proof that they haven’t delivered it. Anyone could claim that their order hasn’t turned up when really it has.

Can you look at the tracking details to see proof of delivery - signature or picture?

Whilst I don’t agree with OP demanding a refund immediately this problem is not down to her lack of planning. OP ordered a coat which was supposed to arrive before she needed it (so she did plan quite well), the problem is the courier has either delivered to wrong address, lost the parcel or marked as delivered and is going to deliver the parcel late. It is now OPs problem but it’s not her lack of planning

As I stated earlier, deliveries can be unreliable. Ordering something that arrives 'just in time' isn't good planning.
I don't mean to criticise the OP. Planning is relevant because it's her main justification for getting a refund ASAP.
She claims that she needs the money to get a new coat in time for tomorrow.
If she had ordered it very much in advance, she wouldn't need to do that, she could wait for the refund before ordering another one.

I understand why you're annoyed, but surely you can see that you can't just say you haven't had something and get an immediate refund. Tracking says its been delivered so it's now your word against the couriers, and they're going to want to investigate.
I had this with an expensive item on amazon. I was waiting to go out, so was watching the van on that little map thing they do. It went to you're next, then the van drove past without stopping, and it clicked over to delivered. They made me wait about 3 days, but fortunately gave me the benefit of the doubt.

Sometimes delivery drivers mark things as complete but then actually deliver them the next day, because they get told off if it's not delivered but sometimes it's not practical for them to deliver it that day.

Also if you don't have a camera get one, that way you can show footage of no one coming to your door all day as proof of non-delivery.

The courier will try three times to deliver first. Completely unreasonable of you to expect the money back before that happens.

Sometimes I get notifications that my package has been delivered then it turns up later/the next day. I presume they have targets that they have to hit sí they mark them as delivered before they actually deliver them. It's only been an hour since it said it has been delivered. I would give the company some time to look into what happened with the delivery company before 'demanding' anything.

Same and it's usually royal mail then it turns up the next day. Op is being OTT just be patient

I don’t think YABU. I had similar, it was EVRI and an expensive jacket (Didrikson). EVRI changed the delivery date on th e day and I was working, no way to stop the delivery ( their website was a farce and their number did not accept calls). They left it with a neighbour but did t bother putting a slip through the door giving the address. I knocked at several doors to no avail. Then 2 days later a neighbour further down the road on the opposite side brought it over. Luckily they were honest. I wrote to Didrikson to complain and left a 1 star review for EVRI on tripadvisor.

OP isn't asking for legal advice (well not exactly). She's asking whether her expectation of getting a delivery email, but no goods, entitles her to an immediate refund.
This is obviously U, why should anybody take her word for it. Company needs to investigate.

If the OP wants practical advice, then a good starting point is to understand their position in a distance selling contract. Which isn't going to happen here.

Is there a picture of where the courier delivered to?
There's so many posts about parcels which have gone astray, "anyone recognise this front door?" kind of posts on our village FB group. Although once it transpired the courier had sent the exact same photo as proof of delivery to at least 5 people Shock

Legally the seller had to ensure it is delivered to her. Not to a neighbour. Not to a doorstep.

She can therefore request a refund but I wouldn't expect it to be quick while the company tries to sort out with courier.

However was it on a credit card? If so raide a dispute with the credit card holder as over £100 and they may recredit quicker

Sometimes a delivery driver will say they’ve delivered a parcel and they haven’t even been near your road, they will then deliver another day.

That could have been what happened. I’d wait until Monday, and if it isn’t delivered, you can ask for a refund.

Yes, legally it's the seller's responsibility. However, if she wants any chance of finding out where her parcel might be before Monday, contacting the courier would be the logical thing to do. If my experience is anything to go by, they will at least start an investigation of its whereabouts. At best they'll rearrange delivery.

Our local Facebook page often has posts asking whether anyone has received a delivery that isn’t theirs with photos of front doors attached and it always involves one of two delivery companies. It seems it’s a common occurrence.
If I received a parcel that wasn’t mine I would try my best to track down its rightful owner but I’m sure a lot of people just keep hold of things in the hope that the rightful owner will turn up, and when they don’t keep whatever it is for themselves.

When I buy on line now I always check how they are going to be delivered and don’t bother buying if there is no option to pick up from a collection point.
I understand your frustration OP but think a speedy refund will be unlikely

So. They have a contract with you

they must deliver the item to your house. If it gets lost or stolen then it’s up to them to sort it

I doubt very much that they’ll give you the money today.

how did you pay? Credit card? PayPal?

Sorry OP but it’s not gonna happen today. You’ll have to raise it with the shop and they can take a while to resolve it with the courier. Even then they may not side with you - the Evri guy nicked my parcel but put it on the doorstep first and photographed it, I just lost my money. Did the courier take a photo of where they delivered it to ?

everyone try to pay with a credit card. Even if you pay it back straight aaay. You get much more help when buying it on a credit card.

Isn’t there a picture of where it has been delivered?

my parcels appear in the shed, log store, wheelie bin, behind plant pots, in the porch. We have a few outbuildings and I’ve very often found parcels just dotted around.

There’s always a picture. More often than not they take a picture of the recipient holding the package. Have you checked this?

If they send you another coat just return it via the returns process and you'll get a refund. The distance selling act enforces refund for change of mind. They can't just decide to give you a store credit for an online purchase.

two. It doesn’t enforce it for a change of mind. It means that you can cancel the contract within 14 days as you’re protected buying it online. They can refuse to refund you for change of mind in a shop. But it’s illegal for an online order
