CF parked on my driveway!

CF has now been parked on my driveway for at least 3 hours! Husband home soon and won’t be able to park!

My question is what can you actually practically do about this, apart from giving them an earful if you spot them returning to their car!! 😂

A quick google says

  1. the police won’t do anything (they might if it’s stoping you getting off your drive but not if they’re preventing you accessing your drive)
  2. My areas police website says try contacting the council . The councils website clearly states they will not remove vehicles or issue parking charge notices for private drives

Also you are not allowed to block them in as this is an offence to stop them leaving and obviously you can not damage their car as this would be criminal damage.

Assuming you don’t want to break the law 😂 what are you meant to legally do if someone parks on your drive??

Has anyone successfully got any type of justice against a CF?!? Or can I now just go around being a CF never paying for parking and just using other peoples drives?!?

CF is just a standard MN abbreviation like DH, DS or DD.

Soooo owner of the erroneously parked car has a long walk and/or taxi fare until you're sober and can move your car tomorrow.

Well we know what happens these days when the innocent party does anything to rectify the situation! The guilty people complain vociferously to the police and the police 'investigate' the crime, sometimes taking many months and then abandoning it - but the process is the punishment. A family carelessly opened their door on my car, twice, and when I got out and remonstrated with them THEY threatened to call the police because I'd raised my voice and there were children in the car who felt frightened!

No but if you didnt have a dropped kerb it's not technically a drive so someone could park across it. I would definitely put up a 'private parking' or similar sign from now on. Someone might have mistaken it for a layby or public/street parking. Hard to say without a photo. And no I wouldn't let anyone park in my land but I have a 'proper' driveway at the front of my house so I guess that's different.

Why does that mean they can park on my land? Would you let someone park in your front garden?

In future, get a trolley jack under the rear axle to lift off the floor, and then, assuming it is a front wheel drive and they haven’t left it in gear, get some people to help you push it onto the road. If they have left it gear will need to lift up the front as well

It's trespass, which is a civil wrong. You have a claim for damages (which is obviously very difficult to quantify). You can exercise a lien over the car (ie don't let it leave) until the owner has paid your claim. This is the legal basis for "clamping". So clamp it.

Do people not always leave their cars in gear when parking? I always do as I was told that it was the safe thing to do to stop it rolling if the handbrake came off. I leave it in first if on flat or uphill and reverse if downhill.

Same here. Many years ago my car rolled out of a pub car park, through the entrance, across the road and into a stone wall opposite with my terrified dog inside wondering what was happening. Fortunately it didn't cause an accident but I've never risked it again and always park in the appropriate gear.

I've been told that in Spain people leave their handbrakes off so that their car can be moved by others if necessary.

Acronyms are a part of everyday life (BBC, NHS, MOT, etc) and who hasn't enjoyed a good game of "Buzzword Bingo" at their (usually Blue Chip) employer? I honestly don't know why anyone would get so worked up about acronyms on MN (sorry, couldn't resist that one! 😉😂)

Noneed if you drive an automatic. It can’t roll back in Park.
