Parking and Neighbour

Who is being unreasonable, me or my neighbour?
The space in blue is a "shared access driveway" but part of it outlined in red is owned by us.
We park in our parking bay (23). Our neighbour (24)keeps parking where the yellow box is on my picture, which blocks access to our drive and stops us being able to get out.
She says so does this because she says she should be able to get into her drive without doing any manoeuvres (no idea what she means) and she has to be able to get up close to our back gate.
She has two spaces, and if she has a visitor she parks in the yellow rectangle. Sometimes she parks there anyway. (Sometimes her visitor parks on our drive) .
Is she allowed to park in the yellow rectangle when it blocks our private parking spaces?
Also, am I allowed to park where the pink car is or does it block her parking spaces?

If she can't do manoeuvres then she shouldn't be driving!

@PeaceGoodMercutio

This is quite clear from your hand drawn diagram and a very common set up.

Your neighbour has right of way over the hatched area that you own, but needs to park on their own driveway.

You will find in both sets of deeds (can be downloaded for about £3) that no parking is allowed in the hatched area so you can both manoeuvre into your own parking spaces. Your neighbour will have right of way over it, but absolutely not to park on it.

One house is usually given ownership so that they can take responsibility to maintain the driveway.

We have similar and cannot park on the back of our driveway as two neighbours have ROW over it, although can park 3 or 4 cars depending on how close to the garage we park.

Yeah it buyer a smaller car 🤣 imagine using the excuse that her cars to big 🤦‍♀️

I’d be parking in the space that she’s blocking in, then getting up at 4am to go out shopping at the local 24 hour Asda - she’ll have to move her car.

That’ll get the message across pretty quickly - I had a neighbour that did this and me waking their whole family (including baby) several times a week sorted it.

The neighbour is allowed access to the shared driveway so that she can get her car in and out so OP would not be able to fence off the land. However, whilst neighbour has access, she is not allowed to park.

@PepeLePugh doesnt all the green belong to OP?? Looks like the red shading only is the shared access!

PepeLePugh · 08/11/2023 20:30

@2jacqi The OP has also shaded red underneath the green area if you look at her diagram. Ownership and access are separate things- OP may own the land shaded green but she has to allow access therefore cannot block or fence off the land that she owns.

@Deathbyfluffy has an interesting and it sounds effective plan OP

purplehair1 · 08/11/2023 22:44

Can’t see a diagram?

YerArseInParsley · 09/11/2023 09:18

Where's the picture?

BeingATwatItsABingThing · 09/11/2023 10:21

OP posted an updated diagram later on. Her screenshot was potentially outing.

When are people going to stop buying ridiculously big cars?
Tough luck if she can’t park her car.
I do think you should both stick to parking in your allocated spots.
It’s not your problem if she is draft enough to buy a car she can’t park though.

Evan456 · 09/11/2023 19:14

Block her in, park in her space

Isinglass20 · 09/11/2023 20:02

Shared drive way for access for fire or ambulance with no parking. If she’s awkward parallel park next to her car and block her in or skilfully manoeuvre to get herself out 🤣🤣

Jeannie88 · 09/11/2023 20:12

Can't see any pictures but from.what you say, these places are allocated to ease problems for all so she should be using them and not making up her own rules. Oh my word, one shouldn't have to manoeuvre to get out of drive? Any turn of the wheel is a manoeuvre, not hard, respect others! Why do some people have to be a total pita? X

DarkwingDuk · 11/11/2023 16:18

Nobody should be parking in the shared access area.
