To record someone in my home without their consent?

This is DS’s social worker who came to my home for a meeting. I had an idea that the meeting was be used for nefarious purposes and I was right.

Got it all on video and put in a complaint as have evidence of what was said and was able to go it for exact words. Told them I recorded it.

Council have said I must delete the recording immediately as social worker did not consent.

I checked and from what I read it is not illegal to record someone in YOUR home without their consent (I certainly wouldn’t do it to anyone else apart from council employees!) and keep it for your own use.

Who’s right and WIBU?

After ATOS lied about a PIP assessment (quelled suprise) we insist on all meetings etc being recorded. They then send us the recoding and we pay to have them transcribed. It's amazing the difference in the recent assessments/tribunals has been, husband and daughter awarded full PIP including mobility element

Thank you. Just seen this pop up in threads I’m on. I don’t feel like a great mum right now though tbh.

This is the 3rd September in a row that DS has not had an education placement and it just kills me seeing him laying in bed all day when he’s got so much potential if he had the support he needs and which he’s legally bloody entitled to!

I told the council I will not be deleting the video, I can forward them a transcript of it and I want the complaint looked at again. They have until Tuesday to respond.

As an update, the SEN team from the council did not attend the meeting last week (cowards) but the SW did and had changed his tune considerably. Agreed with the psychology team that the situation DS is in has considerably worsened his MH.

Still nowhere with finding a specialist college for DS for this year as of course they’re all full.

We were only told that he wouldn’t be going to the college we wanted him to go to in July (been fighting to get him in there since December 2021!) which I believe was deliberate as obviously the small amount of other suitable colleges for his age group had allocated places to start this month by then so council probably thought we’d back down and get him to agree to go to the unsuitable college which I can’t as I know it will break down within a few weeks or months and will be yet another failure for DS and we’d have to go through the legal process all over again which will take another year at least.

They’ve withdrawn his temporary provision as well, which he was enjoying as able to go out and do some activities 3 days a week, again I believe to force us to take the unsuitable college.

It’s an absolute shitshow.

Just wanted to pop in and say keep fighting the fight. Our SEN kids need us to advocate for them. I wish it weren't that way but it is. There are limited resources an sadly they go to those who shout loudest and fight hardest. Keep going x

No wonder we are leaving the profession in our droves.
Would others be happy to be recorded in their daily job without their consent? (And abused, threatened, attacked etc).
And people agreeing without any details or knowledge of the case - pitchforks at the ready.

Do your job properly then. People are having to protect themselves. No wonder the OP had to be driven to such a drastic measure.
