Just got sacked AIBU?

So my boss has just sacked me for saying Iv been spreading malicious gossip about him to customers. Long story short Iv never signed a contract, I don't receive payslips and Iv worked for him for less than two years. Back last year a colleague found a bag of class A drugs, brought them to me the boss have showed up and admitted they were his, end of it's none of my business what he does in his spare time. A year later he's sacked me over the phone stating I'm untrustworthy because Iv been gossiping about his drug addiction - to clarify I have NEVER mentioned anything about this because quite frank it's none of my business and I don't care enough. On the other note, the colleague that found them hasn't been sacked nor had a word with he's just assumed it was me, without even so much as asking for my side of the story even though there isn't one because no words have left my mouth about this. Aibu? Could I take this to a tribunal?

If you don’t have a contract or receive payslips he’s been employing you illegally. Have you been paying tax and NI?

you have less protection under 2 years, if you can prove its unfair you may get somewhere, but its unlikely you'd get much. Use all your energy to get job hunting now (although not sure what you'd put for reason for leaving)

You don't need a written contract to be an employee and covered by the relevant laws. I suggest you call ACAS for some proper advice.

You were employed completely illegally by a criminal. Never mind a tribunal, report him to HMRC and the police.

I think you'd have a hard time taking him to an employment tribunal when you don't have any record of him employing you in the first place.

How does he pay you? Cash? Bank transfer? How do you pay your income tax and NI contributions?

He's been employing you illegally, by the sound of it.

most places don't if you don't know who they belong to. unless its an amount that for more than personal use. you just chuck them.

Anywhere that has large customer turnover would. it's more hassle than its worth with little to no outcome for you or the police other than jeopardising your business and license to operate.

So, if you've never had a payslip, how do you know you've been paying tax and NI? It's your payslip that shows you all those things. What tax code are you on? Where's your last P60? Has he given you a P45 now that he's sacked you?

This is all completely legit, he's been paying by bank transfer I have proof that my wages come from his shop we've just never been given a contract to sign but I have proof Iv worked for him through my bank account.

Sorry I must state, I have received payslips in the past but for the past few months I haven't. So receive payslips sporadicly.

You have formed a contract by turning up for work , working regularly and being paid for it . He is breaking the law by not providing you with payslips
Yes he has unfairly dismissed you but with only 1 year service it’s doubtful you’ll get anywhere . I’d contact HMRC to ensure he’s been declaring your tax & NI and ACAS or CAB who will advise you further if necessary.

I wouldn't report a bag of drugs to the police either in case I was accused of dealing.

Firstly, set up a Government Gateway Personal Tax Account, this will show all your income and tax for the last four years.

This is what I can't put my finger on, nothing has happened that I'm aware of. This has come as a complete shock to me, I'm a single mother with a child with ASD, my only source of income and sanity to be fair. I think he's been completely unfair will be contacting ACAS, but will also put my energy into looking for another job.

That’s not true where I live. We have a locker which the police come and empty once a month…

I may be wrong but think employment tribunals are public. If he is worried about his reputation, i am sure he would be delighted with the idea of his drug use being referred to in a public tribunal hearing. That might give you some leverage, but probably not as you don't have a case (assuming he pays notice) as you have been employed less than 2 years
