So my boss has just sacked me for saying Iv been spreading malicious gossip about him to customers. Long story short Iv never signed a contract, I don't receive payslips and Iv worked for him for less than two years. Back last year a colleague found a bag of class A drugs, brought them to me the boss have showed up and admitted they were his, end of it's none of my business what he does in his spare time. A year later he's sacked me over the phone stating I'm untrustworthy because Iv been gossiping about his drug addiction - to clarify I have NEVER mentioned anything about this because quite frank it's none of my business and I don't care enough. On the other note, the colleague that found them hasn't been sacked nor had a word with he's just assumed it was me, without even so much as asking for my side of the story even though there isn't one because no words have left my mouth about this. Aibu? Could I take this to a tribunal?

If you click on the three dots at the bottom right of the post you want to reply to, it will bring up a drop down box. Choose ‘quote’ and that post will then appear in a separate box and you can post your reply underneath.

Thank you 😊

I work in HR, as you’ve been in receipt of pay and had a verbal contract as such you still have rights as far as I’m aware, you don’t always need a written contract but it’s better to have one but you can’t change that now , I would speak to ACAS who will give you some free advice about making a claim/tribunal … more info here https://www.acas.org.uk/employment-contracts-and-the-law

She doesn't have enough service. ACAS have already pretty much told her that it's pointless pursuing it.

@WhosTHATgirllala well done you! Hope you will be happier back with your old employer.

I’m referring to the fact OP knows about the drugs not the fact she’s not been employed for 2yrs

Which she can’t prove, and who is she going to tell the whole story to, given that he hasn’t broken any laws regarding her dismissal, and she can’t bring a case against him because she has less than the required service ? It’s a non starter.

I think that poster was referring to rights under the terms of an employment contract - you don’t need two years service to take tribunal action for a breach of contract, or a breach of protected rights. Doesn’t seem like either is the case though.

I have been in touch with him, requested my holiday pay - notice pay payslips, contract p45 AND my dismissal in writing..

I'm very interested to see what he will put!

Thank you all for your input.Flowers

No, as stated above I have in the past received payslips none for a few months,
I made a online account with gov to see if my tax and NI have been payed they have along with my pension - so no not self employed.

UPDATE**

I had my dismissal in writing and on there they've told me

The electric bill is getting to much so they've had to let me go.

Thought everyone could do with a laugh this morning! 👌🏽😂

Wait so is this a dismissal or a redundancy? Because if it's redundancy you are entitled to something and this could count as unfair dismissal or constructive dismissal. Look into it with citizens advice... because they've just put that in writing.

WhosTHATgirllala · 17/08/2023 14:40

@roses321 this is a dismissal Smile

Yes but with what reason!? Sounds like no good one.

At first the reason was as the post says: I was gossiping about his drug addiction.
I asked for my dismissal in writing and it says in there they've had to let me go due to the raising cost of stock and electric 🤣

OP posts:
Wearehappy · 17/08/2023 18:57

@WhosTHATgirllala So the official reason you've been let go as you cost too much in utilities?

But presumably someone else will be covering your shifts? How do you cost more than any colleague covering your shift?

I want whatever he's taking🤔

WhosTHATgirllala · 17/08/2023 19:09

@Wearehappy class A's I think he's showing that really isn't he 🤣

@WhosTHATgirllala what ever he's taking is good shit because he sounds on another planet!
