To worry DD25 could get a driving ban?

DD26 has been driving for five years. She's usually a great driver & a sensible person all round.

On her way to work nights a couple of weeks ago, she went through a red light at speed. She knows how dangerous this was & was beating herself up about it. She couldn't slow down in time to stop safely (I know this is a speed issue).

She was rushing to get to work as she was going to be late & there were hardly any cars & no people around. However, she did think it was a 40 zone as the signage wasn't great, the other side of the road was a 40 limit, and the area used to be a 40 when she was last there many years ago.

Last week, she got the letter through asking for her to confirm she was driving when this happened. The letter mentions the speed but there's no clear mention of her going through the red light (though it was a speed and red light camera that caught her).

She hasn't had any previous driving offences. She isn't eligible for a speed awareness course as the speed is too high for that.

Understandably, she's now terrified she's going to get a driving ban (needs the car for work). Of course she knows it'd be her own fault, but she's sick with worry and has to wait for the next letter to find out what will happen.

Anyone know what the most likely answer is?

She was doing 54 in a 30

She will get points, not a ban… and a fine

MollysBrolly · 22/07/2023 21:46

Rather she was late than If she'd hit another car, a person or wrapped herself round a tree.
A phone call to work would have saved her all this.
Maybe she needs whatever the consequence of her recklessness will be

Namechangers123484 · 22/07/2023 21:46

she does need to seek legal advice though

Not necessarily true , it is possible she will get a ban and a fine .

DoloresOnTheDottedLine · 22/07/2023 21:50

20mph or more over the limit in a 20 or 30mph zone is likely 6 points and a large fine (c150% of her weekly wage). 28 day disqualification not impossible but unlikely (particularly if she has no points already).

She will be looking at pointd and a very hefty fine and could absolutely be banned.

Genuine question to anyone who knows.. is it made more likely to receive a ban because of the additional offence at the same time (driving through a red light)?

Fucking hell that’s outrageous! Rushing because she was late is absolutely no excuse. Your Op makes it seem minor.

Curseofthenation · 22/07/2023 21:56

Yikes. That's a very high speed on top of running a red light. My guess is 6 points and a fine or a ban. Any feedback we give is a guess but it doesn't look good. The fact she hasn't been sent a PCN in the first instance is not a good sign.

Assuming OP is in the UK. Speeding fines are based on a scale, not on earnings.

But yes, points and a fine are a definite. A ban is still a potential because of the 30 limit and the red light double whammy.

Glad my child wasn't crossing a road near your daughter doing 54 in a 30. She will just need to face the consequences and slow down.

Fiddlerdragon · 22/07/2023 21:57

I’d be surprised if she doesn’t receive a ban when she was that much over the limit. Why are people saying she won’t get a ban?? She was doing almost double the speed limit which is well within the range of an instant ban

To worry DD25 could get a driving ban?
Fiddlerdragon · 22/07/2023 21:58

And that’s without taking the red light into account. I don’t expect they’ll show her much mercy

Lougle · 22/07/2023 21:59

The fact that she thought it was a 40 limit isn't going to help much, given that she was 14 mph over the speed that she thought the road was limited to, is it?

drpet49 · 22/07/2023 22:00

54mph in a 30mph zone and she ran a red light. She should get banned.

I was caught doing 67 in a 40 a few years ago, it had to go to court for a judge to make a decision on outcome, I was able to submit a letter and had to provide financial information. I didn’t have to go to court, I got 6 points and a £600 fine. Lesson well and truly learnt!

GraysPapaya · 22/07/2023 22:00

I’m not saint but 54 in a 30 is fucking terrible. I hope she is banned.

KingOfThieves · 22/07/2023 22:00

Nearly double the speed limit AND through a red light, yes she could very likely be banned OP. Time will tell

Issuefroth · 22/07/2023 22:01

A ban would be fair and she should consider herself lucky she did not kill anyone. Very dangerous driving.

Gindrinker43 · 22/07/2023 22:01

Many emergency vehicles are restricted to 45 in a 30mph zone and 20 mph through red lights, so her speed and driving were irresponsible

Sounds like she needs a ban but she likely won't get one. Sorry but I don't care if she's late for work, that's a ridiculous speed and I find it hard to believe that's the only time she's ever done it.

showslope · 22/07/2023 22:02

Thanks all

I stupidly heard this from DH today before speaking to DD. He got it mixed up (don't ask me how, I'm so frustrated) and she didn't run the red light. But she was going 54 in a 30.

Does this change much?

She isn’t a great driver or a sensible person.

Pansypotter123 · 22/07/2023 22:05

She's seemingly made no effort to slow down at the traffic lights at what is presumably a busy junction. That is an aggravating factor in addition to the speed (24 mph above the 30 mph limit) which could also persuade the Magistrates to disqualify her.

No, she was still going nearly double the speed limit and hopefully she gets the ban she deserves for endangering other motorists and pedestrians. Would you honestly want someone so reckless on the roads?
