To report someone for possible mortgage fraud

Is it fraudulent to not declare an existing mortgage in another country when you apply for one in the UK?

@Wheredoistart78 We were in arrears but I clawed it back and then was part of the tracker cohort. I spoke to the bank and filled in all the paperwork and just kept doing it over the years till the tracker thing gave me compo and then I was able to reduce my mortgage and they took him off but they had proof he paid nothing for years. Do not despair. I really hope this goes well for you and pm me anytime if needed x

Wheredoistart78 · 18/06/2023 21:36

@Neverinamonthofsundays thanks for your kind words. What was the tracker compo?

OP posts:
Neverinamonthofsundays · 18/06/2023 22:03

They took the tracker off us years ago and it made our mortgage go up. THousands were affected by it so if you were never contacted I guess you were not. I would look on askaboutmoneydotcom and see if they can tell you anything there.

Go bankrupt. You think the house is good for you but it is like a white elephant. Get rid of all the debt and then go after him to get a share from his assess.

*assets !

I think the impact of bankruptcy in Ireland lasts much longer other countries, where you are free after a year. But that is something the solictor can hopefully advise on Tuesday.

Niceeyes · 19/06/2023 18:12

Does their mortgage affect you in any way? If no then keep your nose out.

You clearly missed the part where she said it was her husband.

@Quveas what an unnecessary mean response.

Yep. There are some mean minded nasty little fuckers on MN.

onlywayissussex · 19/06/2023 18:35

If you are married, does that mean you're entitled to a share of the UK house?

Wheredoistart78 · 19/06/2023 18:38

@onlywayissussex I'm not sure! I used to live is Sussex 😊

We own a property in Spain with a mortgage on it.
When we remortgaged here we were never asked, if I had been I would have told them

JenWillsiam · 19/06/2023 18:55

You realise that the likely outcome here if you report him is a court ordered sale of the property you’re in right and him removed from the mortgage?

JenWillsiam · 19/06/2023 18:56

Also, you aren’t asked about foreign debt as you’re suggesting. They do not care.

JenWillsiam · 19/06/2023 18:57

Also, he has a stake in that house. So you paying it was a huge mistake.

Toomuchtrouble4me · 19/06/2023 19:05

Jealous much?

It might still be the best approach being as the OP has a poor credit rating already anyway. If at all possible I would try and find new accomodation first though as it may be harder to get a private rental afterwards.

Wheredoistart78 · 19/06/2023 19:23

@JenWillsiam it was absolutely not a mistake to pay it. I needed somewhere to live and the mortgage was much cheaper than rent.
It would be wonderful if this house was sold. A court order would mean he has to engage.

You are at this point effectively giving him money. When you sell it he will benefit from the payments you’ve made. It’s staggering that you’ve allowed this to go on so long.

Caelan2018 · 19/06/2023 21:32

Just wondering why you would do that you haven’t said why … if it’s an ex partner left them off they will dig their own hole if it’s a new partner and your trying to get rid of a ex them mind your own business

Grrrrdarling · 19/06/2023 21:37

Wheredoistart78 · 18/06/2023 12:59

@Aprilx I think from my posts you can work out that I have a joint mortgage with someone that has left the country and taken out a mortgage in the UK.

The back story is irrelevant. That's why I posted my question about mortgage fraud only.

This doesn’t sound like fraud BUT you are liable for the mortgage if they aren’t paying.
In the UK if something like this happens I believe that to secure the property for the person left paying the mortgage (so that the absconding party can’t come back in however many years & claim half of the property value if it is sold) you need to either get them taken off the mortgage or notify the mortgage company they are nolonger contributing to the mortgage & therefore from the last mortgage payment they made they are not entitled to any further profit from the property.

Wheredoistart78 · 19/06/2023 22:14

@JenWillsiam not staggering at all. If the house sold it would barely cover the mortgage, and I couldn't do anything without his signature. I could've paid 3k in rent or stayed in my house and paid less than half that on a mortgage.

Just in case you missed it I COULDN'T FIND HIM FOR YEARS AND ONLY FOUND HIM RECENTLY.

OP posts:
Wheredoistart78 · 19/06/2023 22:15

@Grrrrdarling mortgage company are aware that he hasn't contributed in years.

Neverinamonthofsundays · 19/06/2023 22:30

Also the laws are different in Ireland. I got my home and my ex did not benefit from walking away and paying nothing.
