To report someone for possible mortgage fraud

Is it fraudulent to not declare an existing mortgage in another country when you apply for one in the UK?

Don't worry about what he/she is doing in another country just get them took off the mortgage.

How is somebody else's mortgage affecting your whole life?
Lots of people don't declare honestly how many children they have. About 16 years ago I worked for a lender, not in the uk, I could see if they had missed a payment on a UK mortgage but if they had a UK mortgage but had never missed a payment, then we wouldn't know. This experience is a decade out of date though

Sounds like op & ExH bought a place abroad. They've now split and ExH had gone back to the UK, whilst making no contributions to mortgage 1. He's set up with a new woman and they have applied for mortgage 2.

Whether or not he has declared mortgage 1, op doesn't know and its none of her business.

Op now needs to sell as she can't keep up repayments on mortgage 1 and wants to vindictively throw a spanner into mortgage 2.

It wouldn't necessarily be mortgage fraud no. I mean I don't know what you'd do with it or how it would help you to be honest?

@clpsmum mortgage provider is useless. They couldn't even take his address and phone number from me, he had to give these himself. I had a battle with them and eventually they took them from me. I can't afford a solicitor raising four children alone and my mortgage has increased to a whopping 2314 per month.
I live in a private estate, I can't afford my MGMT fees and this morning my car has been clamped because I haven't paid.

Mortgage fraud is irrelevant.
You need to take whatever legal action is available to you in your non-U.K. jurisdiction to deal with the fact you have a joint mortgage and the other person isn’t paying.

In the U.K., you’d be joint and severally liable, and every payment you made would potentially be benefiting them. So I’d get legal advice on how to sever the mortgage and buy them out or force a sale.

Or, you could waste your time instead wondering about their U.K. mortgage. 🤷🏻‍♀️

Forget it. Go take the legal steps that you need to in your country.

No I could not work that out, I don’t know what mortgage came first for example. Or what countries they were in. You need to speak plainly, we should not have to work it out from cryptic posts. All you are doing is annoying everyone.

Why don't you buy them out/have them taken off your mortgage then? I don't understand why you are trying to shop them rather than just deal with this like anyone else who has broken up or bought someone out of a house?

It affects stamp duty.

Stamp duty only applies in England now. Wales and Scotland have their own land transfer taxes.

Tbf her posts are clear as mud, but I’d definitely take this to mean that her joint mortgage is outside of the U.K., with someone whom she now believes has taken out a second mortgage in the U.K. with declaring the first.

Could you possibly get legal aid? Could you get help from any benefits at all? It's ridiculous that your mortgage company won't help. If you aren't entitled to legal aid maybe try citizens advice. You really can't go on like that it's also really unfair. I can totally understand why you're so angry. Sending hugs x

You’ve been paying a mortgage for EIGHT YEARS without him, all the time paying money into an asset he co-owns?

I guess if mortgage is cheaper than rent where you are, and legal fees when he’s absent extortionate, and you know you couldn’t buy him out anyway… it’s not necessarily the wrong action. But still.
Have you done anything to establish your legal position over the value of the house?

@clpsmum thank you, I'll take the hug 🤗 I'm in Ireland. The mortgage company don't care as long as the mortgage is being paid.
Ex husband is a slippery fish and won't deal with the mortgage company. Doesn't pay maintenance, you know the type. Hasn't seen his kids since 2014 when I left him due to domestic violence.
My mortgage was around 1095 when I left him. It's going up almost every month. I'm suffocating and feel like I can't breathe.
