My exh gives me £40 per week per child to cover all bills except the mortgage for which I pay my own half.House joint owned. He originally agreed to share the expense of big outgoings but never did in the end.I have three kids.Only one of them sees him for one night overnight per fortnight. We will divorce soon.He is recently self employed so I expect he will hide a lot of money etc.He will say that he cannot afford to give me more money to rear the children in court despite enjoying plenty of holidays in the last year and wearing the best of clothes. In your experience, what will the Judge do? I can't afford to rear my children with this amount of money. My weekly outgoings including car loan and sustantial bills is £1200. I have had to use a lot of savings and take out a loan to get by despite working in a high paying job. If he doesnt have the money(or hides it etc) will the Judge increase my equity on our home when it comes to be sold. It is so grossly unafair that he has nothing to do with the kids and pays £120 per week for me to rear them. How the hell is this even legal???????

You’re not in the U.K.?
Then why are you asking a U.K. based site what a judge will decide?

Isn't he meant to pay half the kids costs ?And why is it only half when the kids are with me full time? Im trying to get my head round this sorry! My loan is£500 pcm and fuel is £400 for context.I will need to down grade my car asap as loan is nearly gone but my fuel bills will remain the same. I am not in UK so have to pay all medical/education/orthodontic/pharmacy bills privately.

But you don’t need a fancy car? A £500 per month loan for a car is the height of stupidity. If you can’t afford it sell it to repay the loan and get something cheaper.
He isn’t only paying £520 for the kids either as he is still paying half the mortgage. So you are living in a much nicer house than you can afford because of it.
Based on your numbers it looks like he is paying 1000-1500 towards the mortgage plus 520. He might be a dick but from a purely financial point of view I don’t see how he could pay more than that on a 60k salary. He still needs to house himself.

Testina · 25/10/2022 14:02

Your title question is nonsense too.
You're wasting people’s time asking that if you don’t say you’re not in the U.K.

lasagnesogood · 25/10/2022 14:02

Kids are 18/15/13.Two with SN so plenty of private therapies and medical bills every month.

And why is it only half when the kids are with me full time?

Because the children are 50% yours and 50% his so the costs of the children are split in half.

If he had the dc himself, for 50% of the time, then you wouldn't get a penny as he would legitimately be covering half of their costs.

Namechangefail123 · 25/10/2022 14:02

Very bizarre @Testina

I have an average sized home with huge domestic and transport bills. Surely a couple who have three kids would spend this amount per week? The only difference is that he doesnt live there ande at the food. His transport costs were always separate.

Nobody would spend that amount unless you have a huge mortgage.
People manage , I never got one penny.

EstellaRijnveld · 25/10/2022 14:03

If you think he'll hide money because he's self employed then you can anonymously report him to HMRC for tax fraud. Also, put a claim in for child maintenance and see a solicitor for a financial settlement.

Go through your monthly expenses and cut down or swap services/utilities & groceries for cheaper swaps.

SpinningFloppa · 25/10/2022 14:03

Could always be worse, I get £7 for 4 children

IdiotSandwich05 · 25/10/2022 14:03

£1200 a WEEK? What on earth?? We have two children, one of whom goes to nursery three days a week, and our outgoings are around 3k a month.

Could you sell your car and get a cheaper one? You don't need a fancy one and that would cut costs down.

Kabbalah · 25/10/2022 14:04

You'd have to seek some sort of legal advice in your own country. Rules and experiences from ppl here in the UK are of little value elsewhere.

BernadetteRostankowskiWolowitz · 25/10/2022 14:04

Aren't you and the dc on some sort of health care plan? Presumably there's a set up in your country for paying medical bills via insurances or whatever?

EstellaRijnveld · 25/10/2022 14:05

I have a feeling that the op has champagne tastes and is struggling to adapt to a lemonade budget.

qwerdi · 25/10/2022 14:05

You won't get any helpful information here as you are not in UK.

You'll also not get any sympathy considering your obscene level of spending

User0610134057 · 25/10/2022 14:06

You’re wasting our time (and yours) by quoting costs in £, asking what a judge would decide etc then drip feeding you don’t live in the Uk 🙄 where systems of cms, and healthcare education etc are different. Massively annoying

Testina · 25/10/2022 14:09

lasagnesogood · 25/10/2022 14:02

Kids are 18/15/13.Two with SN so plenty of private therapies and medical bills every month.

If you were in the U.K., which apparently you are not, then CMS is based on salary and contact arrangements, not on the actual cost of the children. If they have additional medical related costs, you would have that detailed in your Consent Order a separate responsibility.

Talk to a lawyer in the relevant country.

Pollydon · 25/10/2022 14:10

What an odd thread, you are not in the UK but are using £'s.
What country are you based in, so posters knowledgeable about child maintenance in that country can advise?

RandomMess · 25/10/2022 14:11

You can report him to CMS and HMRC that his declared income doesn't match his lifestyle - depends on whether he is legally minimising his income or taking cash in hand though as to the outcome.

RandomMess · 25/10/2022 14:12

Ah not in UK could be a very different system where you live.

TidyDancer · 25/10/2022 14:16

OP can you advise where you are and a breakdown of your outgoings? People might be able to give some geographical advice as well as help you cut down your outgoings.

You aren't getting the right advice because no one knows what country you're in and on the surface your spending is extremely high. This might be easier to understand if we had some more info.

Not in a millions years! I have 4 and spend less than half what you do

lookslikeabombhitit · 25/10/2022 14:19

In a couple, renting with 3 kids here. One really old 2.0l petrol car. Fibre internet, 2 mobiles, no sky, no private medical, we have Netflix, prime and a music subscription. Childcare used for all three children to cover our working hours. We're veggie so can reduce food spending that way ... Total monthly outgoings are about £2500- which is about what our income is.

£4-£5k a month blows my mind.

lasagnesogood · 25/10/2022 14:21

Thanks for your replies. As I said my loan and fuel expenses are very big.My electric, oil and fuel amount to £200 per week.Medical/pharmacy/therapies cost £200per week at present. Food, lunch money, phonebills, sky, internet etc £250 per week so straight away that amounts to approx£850 and that's before pocket money, clothes, hobbies,ed fees, trainers etc. Maybe it seesm like a huge amount but it all goes out, every week.

This is all irrelevant unless you disclose what country you are in.

However you will have to drastically cut back wherever in the world you are.
