Hi wondering if you can clear this up for me.

So to set the scene. Busy road with a doctors on one side and school on the other. It's a 30 limit. Car A is going too fast for the situation but not necessarily over speed limit. Possibly 25-35. Car B is infront of Car A. Car B indicates left and starts to pull round. Car A pulls around Car B as it turns. At the same time Car C pulls out, Car C can see car B but can not see any cars behind Car B. Car C thinks when Car B turns left it has time to turn its self. Car A hits Car C.
Car A says Car C is at fault as he should not have turned when the view was blocked.
Car C says Car A is at fault as he was driving too fast and should not have over took Car B.

Who's at fault?

How did the insurer determine the blame ratio just out of interest. What was their rationale?

There was some batting back and forth - 50:50, 70:30 etc I think neither was confident of a win so it was a case of settling .

Don’t know what kind of roads people drive on but in busy cities etc you’d be waiting until rush hour had ended before pulling out of most side roads if everyone overtook at junctions.

I don't know why everyone is claiming car a was speeding when it was doing potentially 25 in a 30 zone.

The question is what part of car C hit what part of car A. Did the accident occur while C was still maneuvering or had they finished and the accident occurred because A moved back into the left hand lane. Unless C was straight on the carriageway they are at fault for starting a manoeuvre they could not complete.

Good question! The manoeuvre was still taking place. A hit the side of C.

Technically, in rules of the road, Car C because they were crossing a give way (or stop) line and joining a carriageway from a side road. However, car A should also have been able to stop in a safe distance and avoid a collision. Good chance insurance will go 50/50 for all against C.

To those questioning my story I agree - it seemed utter madness at the time as, to me, it seemed obvious the car from the side road shouldn't have pulled out. But that was truly how the blame was apportioned.

@girlmom21 possibly but he was adamant that all rules were followed. I wasn't there so couldn't say for sure though.

In my head both A and C are at fault as both of them have done poor manoeuvres without seeing if the road was clear.

Anyway my friend had his accident at least 15 years ago so perhaps it would have been treated differently now.

Car C was very lucky then to get any leaway on percentage, especially as it was still pulling out (illegally) when the road wasn't clear, if hit in the side.

I wonder if OP put the boot in to the dickhead driving car A 😂

That's usually how insurance will see it.

Friend of mine hit a car that pulled out of a side road. No other vehicles on the road. We assumed they'd be found not at fault as the other car had made an unsafe manoeuvre but they were found at fault as they should have anticipated that a car could pull out and approach with caution.

Thems the rules.

I think which ever car drove a change (like a turn or junction) when they can't see the way is clear to do so. So I think that's C?

Was car A on the correct side of the road when it was hit?

Car A couldnt have been on the other carriageway if it hit Car C in the side as it emerged without due care and attention from a side road.

Car C. They didn't have a clear view - there could have been a motorbike or cyclist on the offside of Car B or even a pedestrian crossing behind Car B. Car C was turning out of a side road and should have waited until they had a clear view.

Car a isnt speeding if he's under the limit. It's may be your opinion that he was but if the council have graded it 30 and he's doing 25 then it's under limit on paper..which is what they are looking at.

Anyone at a junction with a give way who pulls out without clear view is going to be deemed wrong from an insurance pov

Car A for overtaking at a junction
Car C was under reasonable assumption they could exit the junction as Car B was turning into it. If Car A hadn't decided to contravene the highway code by overtaking at a junction, there would've been no accident
