YABU - those things really were totally coincidental that happened just after they were told to hand them in

No. All Vardy has to prove is that Rooney made the statement of which she is complaining to one or more third parties, that the statement refers to her and that it is damaging to her reputation. She will have no trouble proving all three of these.

Rooney has several defences available but the obvious one is to argue that the statement was substantially true. If she wants to argue that, she has to prove that her allegation is true on the balance of probabilities.

This is why journalists sometimes claim that the burden of proof is reversed in libel cases. They are wrong. The principle is the same in all cases - it is up to the person making the allegation to prove it.

I’m not so clued up about phone Technology but I can look at my phone messages on a computer so throwing the phone away will not get rid of the messages.
Only if you have downloaded the messages to your computer. And it appears that Vardy's laptop is no longer working and no data can be recovered from it. Remarkable coincidence.

I never get how CR gets such sympathy....... she stays with Wayne not for money but for status. As Mrs Rooney, she gets VIP escorts through airports, VIP concert tickets, venues to open for her, charity nights out, paying for paps to follow her on her coffee/fake gym sessions ........ as the ex Mrs Rooney, she'll get nada. It's not about money or family for her and never has been.

Do you actually know her? Do you actually know her reasons for staying with her husband? Or are you making a guess based upon your opinion?

I don't know her and am not normally a supporter but she met her DH at school, comes from a strong and loving family and seems like a great Mum. Maybe holding her family together is more important than VIP tickets or escorts - but I can't state that as fact, as I don't know.

It's more that, as far as I'm aware, there's no legal aid in the UK for libel (happy to be corrected on this, but I know it was true at one point). So the wealthy have a massive advantage.

It's quite fair that the defence should have to prove their allegation. If I publish a story claiming that Jane sells drugs, kicks puppies and glasses pensioners, should I have to prove she does or should she have to prove she doesn't?

I liked the comment by Cabriolelegs99 upthread that they should both agree to donate a chunk of what would have been ongoing costs to a Liverpool children's cancer charity and end it.

If CR made this as a public offer now, with them each walking away from the legal case and meeting their own costs, this would be great PR for her.

I've googled her, Mrs Vardy. What an empty life she seems to have, achievements appear to be featuring on two reality shows and marrying a footballer. I've resisted the invitation to gaze upon her lovely home featured in a mag but I hope she's got a copy of it herself, she may be needing it in the future.

According to a quick Google, she's worth about £3 million. Sources on her husband give anything from $12 million (yes, dollars) to £21 million, so I'm not sure what to think. Either way, I don't think she'll be down the Job Centre if she loses...but I can think of many things I'd rather spend my millions on if I had them.

Vardy just seems very bitter, and insecure. The more she pushes this, the less she is liked. What are her good qualities? What does she bring to the marriage?

Colleen at least seems like a loyal, caring, genuine woman, with a good brain in her head, but with dreadful taste in men.

I have the deepest sympathy for Mrs Justice (Karen) Steyn who has to listen to all this drivel. I hope she finds in favour of the plaintiff, awards £1 as a true reflection of reputational damage, makes both parties pay their own costs and bans them both from ever appearing in newspapers again.

We are talking about WhatsApp messages in this case. They cannot be retrieved from WhatsApp, the phone network or anyone else.

I think I'm right in saying that the relationship between Jamie Vardy and his parents completely broke down when they got married. Don't know why, but apparently they didn't like her.

We haven't seen all the evidence. It may be that Vardy is right that the stuff in her messages that Rooney's lawyers have released are misleading. But my tentative view is that a judge will think the string of accidents is probably an orchestrated attempt to avoid disclosure, the obvious reason being to prevent Rooney getting hard evidence that her accusations are correct. So, as things stand, I think Vardy will lose and have to pay Rooney's costs as well as her own. However, I could be wrong and it is possible that evidence could emerge that will change things.

What a pair of idiots. One smugly thought she was very clever with her trapping tactics and the evasive wording (which she thought would let her off the hook) of her ill-advised public admonition. The other likewise smugly thought she was clever for going to these utterly ridiculous lengths in retaliation, then quite literally adopting a 'get in the sea' approach when incriminating evidence on her devices comes to light

How are they the same? What has CR done to RV other than expose her duplicity? RV is a fucking muppet to pursue this.

It's very dismissive of women generally to lump CR and RV together. As if CR is being petty to object to her private information being sold to tabloids! We've seen the harm this does to people's lives and relationships when they don't know how their personal lives are ending up in the papers. It must be horrible not knowing who you can trust.
