Phone dropped in the North Sea? Everything 'unfortunately' wiped from devices?

YABU - those things really were totally coincidental that happened just after they were told to hand them in

YANBU yeah ...right...

@DrSbaitso - yes it does look bad if they keep losing cases... but generally it depends on the client and type of law - media law, civil lit cases within media law etc.

My nana used to work for Lord Mischcon when he wasn't a Lord and when he defended Ruth Ellis - last woman to be hung in Britain. Of course she'd never have got off but he had to defend her and she instructed him. Everyone knew the case was weighted in the prosecution's benefit but Mischcon did a good job of defending her and according to my nana she accepted her fate (turned up to the office in furs and diamonds!). If he hadn't done a good job in her defence then he'd lose more work going forward but he didn't and went on to become one of the best lawyers ever.

E.g. celebrity clients - if a lawyer keeps on losing cases for them then if it gets into the news of course they'll get less work - but generally media lawyers who are known for this work take them on, and instruct the relevant experienced barristers who have form in experience and winning cases. Some cases are known as e.g. generally they wouldn't be won whatever happens but if your client instructs you, has faith in you etc then you as the lawyer have to do your best for your client. Sometimes (and this is what drives most lawyers mad) is their client won't listen and thinks they know best. Had this with conveyancing several times - some people who aren't lawyers seem to think they know best and tell the lawyer what to do which pisses the lawyer off no end - e.g. why isn't person instructing a lawyer if they think they know it all?!

With non media cases it's far simpler because not many get into the public domain so reputation is less likely to be damaged.

Team Colleen here too, she’s not the one that dragged it to the courts. Also the way she revealed it in the first place was perfect.

GreekGod · 09/02/2022 12:36

@Aderyn21 - yes, fully agree with that comment

Gonnagetgoing · 09/02/2022 12:37

@FrenchBulldogsareFab

Who is RV and why does she have an agent? What is her talent?
@FrenchBulldogsareFab - Rebekah Vardy - wife and girlfriend. basically she's an influencer/media type famous for being Premier League James Vardy's wife. Non entity
daisychain01 · 09/02/2022 12:41

I suppose they deserve our sympathy that their whole day is spent eaten up with hatred of the other, and their biggest excitement in life is whether they've managed to be papped carrying the most expensive handbag. Depressing. They'll always be in a prison inside their vacuous heads.

LampLighter414 · 09/02/2022 12:43

Team Jacob for life

ChampagneLassie · 09/02/2022 12:44

@longwayoff

And how is the loser going to pay? The costs alone of this will be immense. Waves house/s goodbye.
Just looked up net worth estimates Wayne Rooney is £170m, Jamie Vardy £12M, I'd imagine costs coukd easily run to Ms here. Suprised Vardy supported his wife in pursuing this. Maybe she lied to him about it too
busyeatingbiscuits · 09/02/2022 12:45

Why are people so personally offended by Coleen Rooney's marriage?
Her husband is a cheating arse but lots of women are married to dickheads, it doesn't actually affect me in any way Confused
Maybe she loves him, or she doesn't believe in divorce, she wants to keep her family together for her kids, she likes her lifestyle. She's decided she's happier married than divorced so let her get on with it.
I'm not anti-divorce at all but I'd try pretty hard not to put my kids through one and then the fallout of step-parents and blended families.

Wayne Rooney's affairs only reflect badly on him, not on his wife.

thebellagio · 09/02/2022 12:46

That’s surprising that Jamie Vardy has supported this then. If that’s his wealth then although an insane amount of money to me, that could very easily disappear and be left with nothing - all you need is one or two bad financial decisions let alone a significant payout to CR if they lose…

CrinklyCraggy · 09/02/2022 12:47

I haven't followed this story, so not really in a position to comment, but it wouldnt surprise me if they're all in this together.

Gonnagetgoing · 09/02/2022 12:48

@tentative3

They're quite happy for their DH's to have affairs and be shown up for it, yet most women I know think less of them for staying with a cheater. But yes, status is more important to them. Gives such a bad image to young women or men. Stay with a partner (especially if married) and it's ok if they're wealthy or you don't want it to be made public as long as you can keep you cushy life and gym/Wag lifestyle... hmm.

@Gonnagetgoing Surely CR would get an absolute fortune in any divorce and would easily be able to afford her own cushy life and gym lifestyle? It's hardly as if she's going to be looking for a job to make sure her bills are paid, is it? I also don't think she's any more responsible for what people think about her than any other woman who makes life choices that not everyone would agree with. In fact, playing devil's advocate (and for the avoidance of doubt I'm merely being an arse here, it's not what I think at all) does that mean it's even worse when women whose husbands are not rich and famous stay with those husbands after they cheat? After all, surely they have no reason at all, given there's no money.

I don't know CR and I can't say I think about her at all in my daily life, but she didn't go footballer hunting and I think that is worth repeating.

@tentative3 - Colleen didn't go footballer hunting and she's Catholic so presumably fairly traditional?

I just think she thinks best to turn a blind eye to Wayne's infidelities, maybe she's biding her time until kids grow up then she divorces him?

I think she's just happy 'being married' and not dealing with the shitshow which a divorce from Wayne would entail.

Ex friend of mine (also Catholic) got back and stayed with the father of her daughter as he was father to her daughter. No matter that he was seeing someone else same time as her, left my friend for her and they had a baby. then friend took him back. Financially abusive to friend and also physically to her. He apparently appears to have 'atoned' now - but she has a good life, big house, all she ever wanted. She's happy to put up with him, god knows why. And she was known as a gold digger (her OH called her that) as he's comparatively wealthy compared to her family.

My own DM and her DM (nana) would never have stood for that and told me so many times when I got involved with wrong uns.

@CrinklyCraggy - totally. all raises their profile. gets them more PR. sly and sneaky and RV comes across as the 'loser'.
QOD · 09/02/2022 12:51

Omg am I the only Team Vardy?

😂

I from the start just thought Colleen was happy to have a reason to distract the press from yet more wandering from dur brain Wayne

@busyeatingbiscuits - well you do you babe Wink.

No - seriously - I wouldn't stand for what Wayne has done and most posters here would tell Colleen to LTB many times over!

If she wants to stay with a serial cheater then up to her...

prh47bridge · 09/02/2022 12:53

@Aderyn21

Can a court compel a newspaper to reveal their source. If I was a journalist I would not be willing to go to prison to protect a source for this sort of story
No, the court cannot compel a newspaper or journalist to reveal sources under any circumstances. That would be a breach of the European Convention on Human Rights.

I'm not clear if disclosure was ordered by the court or simply requested - different reports say different things. Either way, shortly after disclosure was requested/ordered:

  • Vardy's agent went on a boat in the North Sea and dropped her phone overboard when the boat hit a wave
  • Something went wrong when Vardy was downloading WhatsApp messages between herself and her agent to her lawyers, and all media files in the conversation went missing. We therefore have the text but no media
  • Vardy's laptop became unusable with the data unrecoverable
  • Conversations between Vardy and a Sun journalist were deleted and are unrecoverable
  • Vardy's husband's WhatsApp account was hacked, and all conversations were deleted and are now unrecoverable

Whilst it is not entirely impossible that this has happened accidentally, it seems highly unlikely. Far more likely that Vardy and her agent genuinely believe that destroying evidence will allow Vardy to win her libel case by preventing Rooney from proving that her allegations are true. Of course, the courts aren't stupid. I suspect the judge will draw the obvious inference from this.

For clarity, Rooney cannot walk away from this. If she does, the courts will enter a default judgement in Vardy's libel case against her and she will have to pay damages. Vardy can walk away from it any time she wants but appears to think she can win. Her barrister insists that Rooney is relying on selective and incomplete exchanges and that other messages prove Vardy did not leak to the Sun.

😂

@QOD - I don't mind Vardy myself either but then I have zero knowledge of her!

Colleen irritates me if only because Wayne is such an idiot and expects everyone to believe that a young scantily clad woman just ends up sleeping in his hotel room from time to time... Hmm.

whynotwhatknot · 09/02/2022 12:53

All colleen did was try and find out who was leaking her information-vardy has gone to court for libel except everything points to it being true=-shes not very bright

SpinningTheSeedsOfLove · 09/02/2022 12:54

I had to deal with solicitors through work once who were tearing their hair out because our opposition was representing himself, badly misunderstanding the law in the process, and thus refusing to mediate on the grounds of laws he was totally misapplying - whilst sending them patronising emails telling them how to do their jobs

Same here, @thecatsthecats. The bloke ended up having huge costs awarded against him - over £200k in the first tranche - and in parallel he refused to submit to a financial examination authorised by the court and a bench warrant was issued for his arrest. He was last heard of on the run on the Costa del Crims.

wanttomarryamillionaire · 09/02/2022 12:54

Having known a few of these types ( wags) through dating a youth team member many moons ago i can tell you they all sell stories on each other! It takes a certain type of woman to survive and thrive in that environment. Its beyond bitchy, none of them are " womens women" if you see what i mean.

Classica · 09/02/2022 12:55

In the words of Pamela Shipman: 'It's the drama, Mick. I just love it!'.

busyeatingbiscuits · 09/02/2022 12:55

@Gonnagetgoing sure, most people probably wouldn't stand for a husband like Wayne, but who cares if someone else does? She's not doing any harm my staying in her marriage, yet some seem to think it makes her pure evil herself Confused

CrinklyCraggy · 09/02/2022 12:56

I thought with libel the complainant had to prove it was untrue, rather than the defendant prove it was true?

youvegottenminuteslynn · 09/02/2022 12:57

@AndAnotherNewOne

The money wasted on the reputations of women who serve no useful purpose but managed to marry money infuriates me.

It's hardly 'marrying money' in the way you look down on considering Colleen met him when they were 12 and starting dating when they were 15/16!

FacebookPhotos · 09/02/2022 12:58

Of course, the courts aren't stupid.

But isn't the onus on Colleen Rooney to prove her allegation was true? Could she lose the case because she is unable to access the now destroyed evidence?

ForensicAccountant · 09/02/2022 12:59

I’m not so clued up about phone Technology but I can look at my phone messages on a computer so throwing the phone away will not get rid of the messages.
