As I understand it, they were submitted to Rooney's team by court order and that's presumably who's passed them to the press.

It's quite straightforward. Vardy was required to hand over to Rooney's lawyers the messages between her and her agent. She downloaded the messages to her lawyers (although all media files got deleted in the process) who passed them on to Rooney's lawyers. The content of some messages was revealed by Rooney's lawyers in a court hearing this week.

It sounds to me (although difficult to tell from reading the reports; the DM is hardly known for accuracy) that Vardy’s lawyers handed over heavily redacted messages to CR’s lawyers as part of the disclosure process and somehow CR’s lawyers have managed to see through at least some of the redaction - perhaps because the redaction wasn’t done properly or there was a glitch in the program Vardy’s lawyers used. Team CR were never supposed to see these messages but now they have they are saying that Vardy has not complied in full with her obligation of disclosure as there must be more (even worse?) messages that have been withheld. Hence all the “explanations” from Vardy and co about dropping phones in the sea, losing laptops and so on. Will be interesting to see what the outcome of the hearing is.

Team Rooney. Vardys actions with items breaking or disappearing just as they are needed instantly show guilt. From the messages seen, she's a nasty piece of work with an over inflated ego. She needs to remember she's only famous for who she's fucking.

Wow, she is horrible. Either send genuine condolences or just accept that you aren't close enough to be expected to send condolences. Rosie dies and Rebecca Vardy is thinking only about how it could potentially make her look bad. Wow.

I think she'll end up winning because the courts seem to focus on different things (MM v MOS) but in the process of winning it's a pyrrhic victory when you reveal yourself to me this 'charming'

If Coleen loses because she can't prove it was specifically RV who leaked, all she needs to say publicly is that it's very difficult to prove a case when lots of the requested evidence has met with unfortunate accidents.

In the light of those texts I bet itv are cringing that they gave air time to Vardy when she was banging on about how stressful her pregnancy had been because of all this.

I do think this is the measure of a narc. How dare you make me accountable for what I did. A normal person would hang their head a bit. I know there's a huge middle ground between flagellating yourself for the sake of others and insinuating or flat out stating that the person holding you accountable for what you did ought to be ashamed, but you can see what Vardy's thinking is here. HOW DARE you hold me accountable for what I did.

Whoever loses will have to pay costs, which is likely to come to more than any damages.

They can both afford it, but I can see why they'd each want to avoid it.

I'm Team Rooney but I don't know how it'll play out if it was Watt who actually pressed "send".

It’s also likely that people will view the victory as unfair and the libel system in england as stupid. Either way Vardy has done herself no favours here.

I saw Vardy on I'm A Celebrity and have never forgotten what a nasty bully she was to poor Iain Lee. She groomed a horrible group of other celebs to become her helper bullies and encouraged them all to gang up on him. Proper Lord of the Flies stuff.

I remember a thread about this a few months back and opinion was more split. The text messages and the phone being lost at sea etc seems to have really swung opinion firmly in CR favour.
Imagine knowing you'd sent those messages and still thinking it's a good idea to sue.

I work for a law firm and it has happened twice before that the redaction hadn't worked properly when combined with certain printing software. We found out subsequently that this is a pretty well known fault in the system.

Yes I remember Piers Whatsit being all smarmy & sympathetic towards her (allegedly, only my opinion Grin) very unlike his usual style. I wonder what that was all about and why they decided to back the wrong horse?

The more I read about this, the less I can understand why RV went ahead with this! She should've left it at her public comment denying it and this would've gone away. Instead she's started a legal case that I can't see how she could win, but even if she did, she loses anyway given the information that's come out in the process.

She's truly a vile bully who is now stamping her feet and then throwing her weight around because she doesn't like being exposed for what she is. She can't possibly think she will come out of this with any kind of decent reputation. She is poison and her only hope for a media career after this is as a Hatie Kopkins style turn.

As an observer, this is a fascinating spectacle but it's total madness that it's got to this point.

In the Meghan Markle case, the fact she misremembered her involvement in her unofficial biography was not relevant to the issues being considered in the appeal and MoS did not rely on this in their arguments to the Court of Appeal. The central question was whether MoS had breached Markle's copyright (not really a question - they clearly had) and whether they had any defence in law for doing so (again, not really a question - they clearly didn't). I was not at all surprised when the judge gave summary judgement for Markle, nor when the Court of Appeal upheld that judgement. The only surprise was that MoS thought they had a chance of winning. To be honest, their behaviour in part makes me wonder if they defended the case not so much because they thought they might succeed, but as a warning to other celebrities - effectively, if you come after us when we publish untruths about you, we will drag your name through the mud in the courts. They certainly tried to do this with Markle. A lot of the evidence they advanced was entirely irrelevant.

In the Vardy/Rooney case, Vardy was under a duty to preserve the evidence that she had been ordered to hand over, as was her agent. The fact that much of it has been destroyed shortly after it was ordered to be handed over will not go down well in court. I would expect the court to draw the obvious inference. Having said that, a lot may depend on how Vardy performs under cross examination. If the judge thinks she is a credible witness, he may accept that the destruction of evidence was an unfortunate series of accidents.

Up to the judge but I don't think she will lose on that basis. The question is whether Vardy is responsible for the leaks. If her agent was the one who actually had contact with the press but was leaking on Vardy's behalf, Vardy is responsible.

Also, I think if it hadn't been MM, that would've been explained in the judgment. I've seen plenty where the judge makes clear their view of a witness who is clearly lying and then goes on to say something like "notwithstanding that, the fundamental issues in the case are xxx and I decide xxx" as judges generally want to make it as clear as possible that manipulating evidence is bad! Probably just didn't want to go there with that particular case and MM.
