YABU - those things really were totally coincidental that happened just after they were told to hand them in

I actually thought she had worded it carefully when she first said it. She said the only account to see was RV not that it was RV.

If you read it carefully, you see she references "someone I trust" and an "individual", plus it's obviously written to pique the reader's interest and gradually build up to the big reveal.

It's very very clearly implying that Vardy personally was the leak, and that's how it was ruled to be in an early hearing. Most people reading that would have inferred that it was an accusation against Vardy personally. It clearly was.

A hearing was held about a year or so ago to determine whether Rooney had accused Vardy personally. The judge ruled that she had, because of the wording of the tweet (she refers to "someone" and "an individual") and the fact that anyone reading it would take it as an accusation against Vardy personally, because it so clearly is.

This is interesting in that Rooney's original position is that she was saying that someone with access to the account was leaking stories and it didn't necessarily have to be Vardy, the judge found that Rooney was saying it was Vardy, and now the tiny fragments of evidence that miraculously survived the astonishing series of evidence destruction evetns clearly point to the fact that someone with access to the account was, indeed, leaking stories even if it wasn't Vardy. It feels like the judge's finding is at odds with the evidence that supports Rooney's original position.

No, the court doesn't appoint an independent expert. Each side can appoint its own expert. The experts are required to give an impartial view of matters within their expertise, regardless of which side employed them. I'm not saying that always happens but that is how it is supposed to work. Any expert witness who clearly gives a biased view can be disqualified from acting as an expert witness.

I hope that the scope of evidence hearing this week doesn't mean that there won't be cross-examination of witnesses about evidence destruction. We could be in line for some very entertaining witness testimony.

No, it isn't.

It is clear from Rooney's original post that she was accusing Vardy of leaking, not someone with access to Vardy's account. She then tried to argue, probably on legal advice, that she meant someone with access to Vardy's account. If she had succeeded that would have made it easier for her to win. The judge decided that her post meant exactly what it said - she was accusing Vardy of being responsible for the leaks. The judge's decision was nothing to do with how the leaks actually happened, just what Rooney alleged.

If Rooney is able to show that Vardy is responsible for the leaks, even if she didn't actually pass the information to the Sun herself, she will win.

I think the point is, the ruling was that that was NOT Rooney's original position. The judge ruled that Rooney's original position - or at the very least, what public would take from her statement - was that she was indeed accusing Vardy personally, even if only by heavy implication. It's certainly how I read it.

She may have referenced the "account" to cover herself, but it hasn't worked.

That isn't the way our courts work. The nearest we get is that, when both parties want to call expert evidence on the same subject, the court can rule that evidence should come from a single joint expert. If the two sides cannot agree on an expert, the court can step in and choose from a list supplied by the parties. But that is fairly rare. In general, the system of allowing each side to appoint its own expert who is required to give their honest opinion, regardless of whether it helps or hinders the side that called them, is believed to work well.

Yep. I don't think Colleen will be particularly negatively affected whatever the result. Vardy seems nasty.

I thought before that they were both behaving like bratty teenagers, dragging this crap through court but I see now why Colleen has done it. The texts really seem to vindicate her beliefs!

This is a joy.

It seems pretty obvious that Ward did the actual leaking, but with Vardy's full knowledge, approval and complicity, indeed it looks as though they did it that way precisely so that Vardy could say that she wasn't the leak and technically be telling the truth.

Whether that'll fly in court, who knows. Or maybe there's yet more to come. I hope so. Someone drag the North Sea for that phone! If this is what they DIDN'T manage to delete...

I'm still unsure how they obtained the few texts that have been released? I read it was picked up by keywords but not sure how some would make it and the majority not - anyone know?

I'm team CR all the way on this.
