wont pay for damage to my jeans

I actually needed new pants, so I bought 3 new pairs of mostly otton jeans that were the same on sale from a warehouse getting rid of old stock. The jeans are all one shade of blue so any marks would be obvious. I could've got cheaper jeans but I thought I'd treat myself. They no longer have the jeans in my size but are selling them or something similar on the original website for a similar amount.

Dog of a relative unexpectedly jumped up on me and scratched as soon as I got in the door. I didn't expect them to because last times I've come in they've not done that and I've gone in loads of times. I've had these jeans 2 days. The jeans haven't been torn but are damaged. You'd have to look at them to see the scratches. other marks they've made I'm not sure if it'd come out in the wash. This has effected the aesthetic of the jeans and they don't feel as special. They haven't had holes ripped in them so relative is refusing to replace them

If you forget all the rubbish about jeans and dogs, the underlying question is interesting. If someone damages your property, and let's assume they accept liability, do they owe you what you paid for the item or what the item is actually worth to replace?

What if you managed to get an ornament at a car boot sale for £1, that turned out to be an antique worth £200. If someone broke it, do they owe you £1 or £200? Would you expect them to buy you the same antique ornament, or could they replace it with some tat from B&M because it didn't cost you much?

That is literally nothing like this situation AT ALL.

I cannot believe you’ve spent £19 on a pair of jeans and want to be reinbursed because the aesthetic has been marred and now they don’t feel as special. Surely this is a reverse?

OP, has something that she feels will cost her £60 to replace, but for which she only paid £20. If MIL was to stupidly accept she needed to compensate the OP, would she owe her £20, a second hand pair of jeans in pre-incident condition (which would be impossible to find), or £60?

They're cheap jeans, so if you are that bothered ask your MIL again, if you think cheap jeans are more important than your relationship with her. I get that it is irritating. But you are taking the piss to an extent as they are just ordinary jeans and clearly still wearable as you washed them. I thought you were going to say they were 7forallmankind or something.

I agree. They were a bargain, but never special.

Other posters have found the jeans in ops size for 18.99.

Because I haven't read the whole thread but saw your comment pop up, it's nothing personal obviously, I said said it was mean to be laughing at the cost of the jeans too. Although I do agree that op is being ridiculous I just think it's a bit far to be laughing at the clothes or the cost. Anyway. I wish you well, no hard feelings

I know cars don't cost as much as jeans but to give an example

Say someone dents your car
'oh you might be able to get that sucked out anyway'

Ok then OP - how about this:

You park your car on someone else's driveway with the seatbelt hanging out of the car door. On the way out of the house, for a walk their dog pees on it.

Their dog peed in their own driveway. It may have damaged your car in some small way, but it is in no way the homeowner's fault.

Out of interest, what do you do if someone visits who's allergic to dogs? (There are a lot of posters on this thread I'd like to ask that question tbh!!)

My visitors all know I have dogs. What do you want me to do? I can't make then unallergic to dogs. They have a choice not to come! Weird.

Well, personally I'd try to settle them in a different room for a while if possible, but I dare say that would get me reported to the RSPCA by some of the people on this thread...
