The same judge who was totally on his side in the first appeal is the judge of the directions hearing for the federal circuit court. Ffs.

Rainbunny · 14/01/2022 11:24

The hearing is happening now and ND's lawyers are claiming that his visa was cancelled because the government didn't want to excite the anti-vaxx community. Nice try...

WindyState · 14/01/2022 11:27

Christ, he really needs to know when to accept defeat.

Great news.
Major tournaments should be setting the example and requiring all participants to be fully vaccinated (unless genuinely medically exempt for a genuine and medical reason - a reason that a consensus of doctors agree is counterindiative for vaccination with any of the approved vaccines. Which is highly unlikely for someone fit enough to participate at top level sport).
And their entourage too.

I hope he gets deported so fast his feet don't touch the ground.

His career is probably finished now too as more countries are going to want the same proof of vaccination and he's pretty much person non Grata amongst many tennis fans too

Rainbunny · 14/01/2022 11:47

His career is nowhere near finished. the French Open have already stated that he will be allowed to compete, they're not requiring the players be fully vaccinated. I don't know about Wimbledon, but he can definitely enter the UK withough being vaccinated. The US Open will be more tricky as the USA has a vaccine mandate to enter the country so I don't know if he can get an exemption for that, I'd laugh if he tried the last minute positive covid test scam again.

The botton line is that he's chasing history. He's currently tied with federer and Nadal, each with 20 grand slams. He's younger and fitter than the other two and it's expected that he will end his career winning the most grand slams in history. Nothing will stop him from trying.

LumosSolem · 14/01/2022 11:50

It's a real shame, that he will likely end up with the most grand slams. Federer and Nadal are better players and better men.

Rainbunny · 14/01/2022 11:52

Interesting, the Telegraph just posted an update about Djokovic's future travel issues:

"Most countries require visa applicants to disclose if they have ever been deported or had a visa rejected or cancelled.

While France's sports minister said last week that Djokovic would be allowed to play at the Roland Garros even if unvaccinated, citing International Tennis Federation protocols, President Emmanuel Macron's said he wants to make the lives of the unvaccinated so complicated they will end up getting jabbed.

The French Tennis Federation said it was still too early to reveal health protocols.

And Wimbledon's organisers are also yet to decide safety arrangements for the major.

The Lawn Tennis Association said entry requirements for its events would be determined by the government, and that, currently, non-vaccinated people could enter the country but must self-isolate for 10 days.

A US Open representative said the tournament would follow New York City Department of Health guidelines.

Flying into the United States could also be an issue for Djokovic. Foreign air travellers have had to be fully vaccinated since November and provide proof before boarding flights, with limited exceptions."

It looks like he will likely be okay for the French Open and Wimbledon but I think he's in serious danger of not being eligible for the US Open.

He doesn't do defeat well in tennis either
AlternativePerspective · 14/01/2022 12:01

Well, they’ve agreed to delay his deportation. And the judge hearing the appeal is the same one from last time who was so obviously biased it was a joke.

The whole thing is a farce at this point, they might as well just let him in and have done with it. They’re not going to deport him, it’s all political posturing.

Rainbunny · 14/01/2022 12:04

I completely agree about Federer and Nadal being better men but as galling as it is to admit, Djokovic really is the best tennis player likely in history. Strangeley though I dislike his game, it's just not enjoable to wtach unlike federer who play beautiful tennis and Nadal who's entertaining to watch.

Whatever happens, Djokovic can kiss goodbye to his lifelong dream of being loved by the public the way Federer and Nadal are. I used to feel a bit sorry for him as he's always been so painfully desperate to be liked but the truth is that he's never been likable.

Rainbunny · 14/01/2022 12:08

The case is being transferred to federal court now which is a blow to ND as he wanted it to stay in the circuit court with the friendly judge. I think the government has no intention of losing this case!

LumosSolem · 14/01/2022 12:09

I still think Federer is the best because his game is so beautiful and he makes it all look effortless. And he is so so classy on court- not just the tennis but his behaviour.

Djokovic has been more fortunate with injuries than either Federer and especially Nadal, which is why he will ultimately end up with more slams, which is a shame!

Chulainn · 14/01/2022 12:10

I read that the Immigration Minister had a few grounds to cancel the visa. He didn't opt for the false declaration on the visa document. The report I read said that if the judge overturns this cancellation, although it will be harder to do as the grounds are narrower, it can still be cancelled for the false declaration on the visa application. That is something Djokovic has admitted to, albeit by blaming someone else. However, his application, his responsibility. If a judge overturned a cancellation on those grounds, surely that's setting a precedent for anyone to rock up with a false declarationon their visa form, say it was a mistake by a 3rd party and expect to get in. I'm not sure if Hawke would have the appetite to go through this a 3rd time though.

tigger1001 · 14/01/2022 12:10

What happens to him in the meantime? Does he have to go back into the quarantine hotel or is he free to come and go as he likes? Can he still train for example?

Exhausteddog · 14/01/2022 12:10

Christ, he really needs to know when to accept defeat.
I guess though that's his mindset. He can be(and has been) matchpoint down in a 5 set match and come back to win. Surely at least part of the reason for his success is that he doesn't accept defeat...? His never say die attitude on court is obviously the same off court. As well as the chance to surpass Roger Federers GS record and the huge amount of prize money on offer

Isaw3ships · 14/01/2022 12:11

I’m glad they’ve kicked him out. Getting sick of this one rule for some and another rules for the rest of us nonsense.

LumosSolem · 14/01/2022 12:12

It really is farcical now, the way that this is rumbling on. Surely he should just be deported?

And one of the ways he does that is call for medical time outs to put off his opponents. Sounds like what he's trying do that here.

He's the king of mind games.

This, and all the screaming, shouting, yelling at his coaches in the box, it drives me nuts.

I hate watching him play.

Me too.

Used to really like him as a player, but as the years have gone on and seen more abs more unsporting behaviour from him, he's one player I just can't watch.

It's a shame. He's undoubtedly extremely talented but taints that with his behaviour. And can see others trying to follow his behaviour on court too. Not good for the game at all

True, but surely he needs to realise how much damage he is doing to his reputation and to the image of tennis as whole. Like it or not he is an ambassador for the sport and someone who millions of people look up to.

And I do think he cares about that, he clearly wants to be as widely loved as Federer and Nadal.

Blackbird2020 · 14/01/2022 12:32

The difficulty facing the Australian government is that having provided requested evidence of a Covid infection, ND was given a medical exemption. This is the root of the problem.

Sure, the timing is a bit too perfect. Sure, he might have faked his infection (almost impossible to find out without a whistleblower or Interpol involvement - extremely unlikely)

So, as far as the law is concerned, he hasn’t lied. The Aus Tennis medical panel took advantage of a (possibly legal?) loop hole to get him into the country. Others turned a blind eye. Then the proverbial hit the fan when ND posted on Insta about his exemption and Scomo needed to do some damage limitation.

This is going to be a very interesting….

Exhausteddog · 14/01/2022 12:35

And I do think he cares about that, he clearly wants to be as widely loved as Federer and Nadal.

Yes - he wasn't before this started, but he certainly won't have won any new fans in all this. And if he does win I think the tournament will be remembered more for the drama surrounding it.
I was just making the point that he's probably not going to be the type of person who's used to giving in -and will have the means to pay for the best legal advice.

Rainbunny · 14/01/2022 12:36

The federal hearing is scheduled for sunday 10am. ND will be interviewed by immigration tomorrow mornign and will go into detention after that interview but I think his legal team are still trying to get the judge to allow him to stay at his residential address. He's still scheduled to play his first round match on Monday.

The drama continues!

RobotValkyrie · 14/01/2022 12:47

Are we allowed to vote that both Australia and that tedious tennis dude are BU?

The whole thing is a joke. Whether someone is allowed in a country or not should be a straightforward yes/no question that gets answered before you even board a plane.
In this case, tennis dude also happens to be a world #1 prick. But the whole Australia border control system is insane.
