Background: I moved into a brand new house in a new build estate with around 20 houses around 4 years ago. Builders advised that there was ample parking (with overflow) however no allocated parking spaces. So parking is very much first come, first served. However most people have settled into a habit of parking outside their houses.

Today I arrived home from work to discover one of my neighbours has installed a bollard. It's a metal pole complete with key. He/She therefore seems to have "claimed" their parking space 24/7 despite not owning the land!

AIBU to find this entitled CF at its finest?

Ideally the management company needs to remove the bollard.

Wow. Entitled much? It’s absolutely not legal. You can’t just go installing things on property that isn’t yours. But honestly? I would just steer clear of it and of that neighbor. This entitled person sounds like the type that will start a neighbor feud and make your life miserable. Eventually someone will report it or an authority will see it. Let them take the brunt of her entitled rage.

You need to buy a dildo and superglue it to the top of the bollard.

Yes, incredibly cheeky since they don't own the land. If the management company won't remove then could you remove yourself in the dead of night? It can't be that hard!

If there is no power to enforce, then surely just get them numbered to match the houses. You need a residents association.

Response to my email asking what happens if neighbour ignores letters:

"As mentioned, we don’t have the powers to remove, as this would technically be theft.

We don’t have powers to enforce the Title Deeds, it’s only the owners who can enforce this as part of a civil action. Unfortunately therefore we are limited to what we can do if the owner chooses to ignore."

Hmmm, pretty certain it would count as criminal damage to their parking space. Any legal bods able to confirm?

I would definitely install a second bollard 8 inches in-front of the existing one Grin management company can’t remove it. You have their confirmation of that.

Appreciate you're in Scotland so this may be different, but if the manco was party to the transfer / lease they can usually enforce the estate covenants in it. More recently some estates have been set up this way exactly for the type of issue you describe.

The factors should be privy to the deed of conditions, this should relate to communal areas and adoptable areas.

If the road is to be adopted I'm sure the council would be interested. And also, the developer will be pissed off if they incur additional charges to reinstate the road to adoptable standard. Is it a plc builder?

@janeygodless the builders were working directly for the local authority.

Some of the houses/flats were rented to local authority tenants, others were sold.

Looking at the deeds it seems it is due to be adopted later this year.

I have done a general letter but will speak directly to this owner. Has anyone spoken to the lady regarding this? I’m just wondering what the reasons were for installing and the thought process behind it, apart from commandeering a space for their own use.^

Interesting! I wonder how this will play out?

It wasn't the lady wot done it... It was the moles who use it for pole dancing after dark... 😂
