DH not paying rent or contributing financially

So DH moved out. We have two children who are mainly with me, but also staying with him.

He has moved out due to issues I wont go into. But his hope and mine is that he moves back soon.

In the meantime, he is basically giving his rent on his property priority over paying for the family home. He gives me something sone months and nothing some months. Last month was £700,this month nothing.

The lease is in his name.

I cant afford to pay it all. I also cant have the stress of never knowing where i stand. Then he turns it on me blaming me for the cost of it.

He acts surprised every month of all his expenses.

His money mangement is horrendous.

he is giving me nothing for child maintenence.

What can I do legally etc? See a fin advisor? solicitor.

He just thinks it is ok. Please help i feel helpless.

I dont know what to do.

Op he can’t pay what he doesn’t have. You say you are getting benefits- are you not getting a housing element? Is it based on you being a single parent?

You can (and should) go for CMS but bear in mind you will get a set amount only not half your living costs. Also if he has money issues he won’t be able to pay it anyway (and CMS pretty awful at enforcement).

Also I would be careful about getting into rent arrears- depending on your area it could be difficult to get an alternative property on benefits even if the arrears are not in your name.

I think you need to sort out your own finances op and consider it you want him to move back in.

Neither of you can support yourselves separately and you want to get back to living together…… isn’t the solution obvious or am I missing something?

I know you want to get back with him but he sounds incapable OP. He really does.

You're better off claiming as a single parent and making it alone. He's not coming up with the goods.

OP says he has MH issues so it's highly likely that he's found family life and responsibilities too much...and has moved out to try to get his head right.

But with OP saying he has nothing to give her this month and is thinking of taking a loan out...well, I think it's time she cut her losses!

Doesn't ex want op to take out a loan?

Even if ex moves back in, he can't be guaranteed to provide

Well since OP says that she wants to get back with him...and since he's not actually doing anything about that...and she says he has MH issues, it's not a huge leap to come up with the idea of him simply being unable to cope with it ...or...just not wanting to.

If the rental agreement is in his name she won't get a penny if its joint she can claim as an untidy tenancy and it will be paid
