To be shocked at what’s just happened on the school run

So today after picking DCs up from school/nursery a car that was parked up close behind my car put their car into accelerate instead of reverse and ended up pinning me between my rear bumper and their front bumper whilst I was putting bags etc in the boot.

Mum in question did not realise one of my legs was taking the brunt of this until I was shouting to tell her to reverse.
She did apologise at the time, but didn’t get out of the car to ask if I was ok or anything like that!

I’ve got home now and my knee already is swollen and starting to bruise.. I’m also thinking this could have been a much worse accident if this was DS stood in between the car.

Fortunately a parent came over to check if I was ok and he did catch the incident on his dash cam.
So would you put this down as an unfortunate accident or do anything about it? I’m not even sure who or if I would report it too.

She hit you with her car. You need to call the police and get yourself to A&E now. Your knees are so important to mobility. Please get yourself checked over.

Too much dangerous driving on school runs. There was an illegally parked car (in a gateway where you get into the school!) with non working brake lights that suddenly sprang into reverse without looking and nearly knocked my 7yo over. I actually had hold of him already and dragged him out of the way. I knocked on the car and it drove away. It was on school CCTV and they reported it to police.

You should definitely report the driver to the police. absolutely shocking to drive into someone and not even get out of the car.

It was clearly an accident but I can't believe she drove away. She may well take another car tomorrow if she can OP thinking you may be on the lookout for her.

I believe there is an obligation to report any accident where someone is injured, so report to police and push them to prosecute. There is no way it was acceptable for her to drive off. Get the footage asap, key evidence.

that's quite horrendously bad. If I had done this I would have been beside myself apologising.
You need to contact police and insurance and hopefully the dash cam driver will let you/them have the footage.
As it was not on school property I don't think they can do anything except perhaps repeat the message to parents to be extra careful when driving around during school drop offs.

I would get that knee checked out too. Hope you are ok .

I'd report it to the police. Even if no one was hurt, a driver involved in an accident (in the UK) is required to report it to the police within 24hours.

The fact she didn’t even get out snd drove off is certainly - from a legal POV - an exacerbating factor to what is a driving offence as well as a Personal Injury one

I do hope your leg is not badly injured but would suggest getting full MRI scan (and not being fobbed off with xray which may not show much). Your reaction is totally understandable, when in shock it takes time to process what has actually happened. Priorities should be medical treatment and reporting to police. You will have plenty of time to make a claim. If the police show no interest say will make a formal complaint about their failure to act, this is their job and you have evidence and a witness.

I would actually report this. You also don't know what damaged she has done to your knee you could be out of action in the next day as the injury comes out and it could impact work/care for kids etc. So I would report and get the knee checked. It could of been your child and she may of said sorry but she really needs to learn a lesson that you at least get out of the car and see if the person is ok.

At best this woman was flustered and not thinking straight and therefore drove off. However, that was utterly wrong and she should have got out of the car, checked on you and shared her details.

I would let the school know, not because they can do anything (other than possibly identify the parent) but I do think they need to know about these incidents within their community.

Very true. Worse driving and parking around the school run area. Many times cars have mounted the pavement I'm walking near the school because it's a narrow road...the cars are actually driving not parked and they drive so close to me and my children.

You must get checked out, if nothing else so that it is recorded on your medical notes should a personal injury claim need to be made.

If you delay seeking assessment/treatment her insurers could try and claim that you are faking it or injured yourself in a different incident and are making a fraudulent claim.

Totally agree *@wombatspoopcubes*, the school has no power to investigate car accidents. I’m not sure what anyone would expect them to reasonably do.
As that's true, school can send email to all parents with reminder to be more careful as it could be child that could be injured etc

The school will absolutely be interested in hearing about dangerous driving on the school run, it's ludicrous to suggest they wouldn't.

Absolutely shocking she didn’t get out of the car to check on you and call for medical attention despite knowing she had pinned you against your car. She should have given her details and the fact she drove off without giving them is very serious and a police matter

Call the police and get a crime number today, you can call back tomorrow to add more info to the report. If you leave it too late (maybe over 24h), you cant report it I don't think.

"If, as a driver, your vehicle is involved in a road-traffic accident/collision on a road or public place and one or more of the following occurs:

a person, other than yourself, is injured,
damage is caused to another vehicle or to someone else's property - including street lamps, signs, bollards etc.
an animal, other than one in your own vehicle/trailer, has been killed or injured (animal means any horse, cattle, ass, mule, sheep, pig, goat or dog).

YOU MUST:

stop (whether it's your fault or not) AND,
give your name and address, the vehicle owner's name and address and your vehicle's registration number to anyone with reasonable grounds for asking for those details.

If you don't give your name and address, you must report the accident at a police station or to a police constable as soon as you can, and in any case within 24 hours (this does not mean you have 24 hours in which to report the accident). If you fail to stop, fail to give your and the owner's name and address or the vehicle's details or fail to report the accident, you commit an offence/s.

If another person is injured, in addition to the above, YOU MUST:

Produce your certificate of insurance to a constable or anyone else having reasonable grounds to see it.

If you don't, you must report the accident at a police station or to a constable as soon as you can and in any case within 24 hours (this does not mean you have 24 hours in which to report the accident) and produce your certificate of insurance. However, if you don't have your certificate with you when you report the accident to the police, you can take it, within seven days of the accident, to the police station you nominate when you report the incident.

Points to note:

Reporting – if you are under a legal responsibility to tell the police about an accident you cannot do this by telephone, you can only report an accident at a police station or to a police officer in person.
Driving – you're legally obliged to comply with these requirements not only when you are directly involved in an accident, but also if your vehicle's 'presence' was a factor in an accident. You don't even have to have been driving the vehicle at the time of the accident e.g. you park your car and run to post a letter, your car runs downhill and collides with another.
The above provisions make no reference to blame. Therefore, a driver must comply with them even if they are not at fault for the accident."

So yes, get a medic to check it over tomorrow, get the dash cam footage, go to the police, inform the school afterwards so they can remind parents to be careful.

My neighbours visitor did this but reversed into my son who was stood still holding my hand waiting to cross the road. Didn't even know they were in the car until it reversed into him I had to drag him out the way by his arm and it seemed to keep coming. I'm not one for confrontation but was banging on their window I was shocked.
