Yes I know it’s a trivial question but the lawsuit’s ridiculous and I’m bored. Other supermarkets have their own version of Colin, so why are M&S targeting Aldi? Also loving Aldi’s hilarious Twitter feed. So AIBU M&S are right or YANBU Aldi all the way.

I'm a lawyer in this area and looking at the two cakes I'm leaning towards Team M&S. You can't monopolise a general idea (e.g. caterpillar shaped cakes) but it's about the execution. There are almost limitless ways you could present it within the general confines of it having a head, body, face etc. and yet Cuthbert is just so close to Colin in ways it need not be - I mean what is with the face 😂

@victoriasponges Grin
visions of a law office piled high with both versions as you obviously have to (eat) examine each in detail

Nannyamc · 16/04/2021 23:16

As always it depends on your budget
If customers are happy with price thats it. M AND S here in the ROi have added a huge premium to their prices. This is because of Brixit.. Their customer service is awful too. .

@mumwon obviously Grin wait until you turn up at the courtroom and it's laid out like a big old afternoon tea ☕Cake

winewolfhowls · 16/04/2021 23:23

Team M and S for sure. Loving Aldi sense of humour on social media but at the same time they are being right bastards really aren't they to make such an exact copy of both product and packaging.

SEE123 · 16/04/2021 23:35

@mumwon best part is that DS is allergic to dairy and soya, so I don't have to share either. Easter Wink

Team Colin

I like Aldi but they constantly rip off the design, name and packaging of other successful products. They need to find their own thing identity rather than keep copying other brands. It's not just Colin the Caterpillar is it?
