AIBU to ask whether you’re Team Colin or Team Cuthbert?

Yes I know it’s a trivial question but the lawsuit’s ridiculous and I’m bored. Other supermarkets have their own version of Colin, so why are M&S targeting Aldi? Also loving Aldi’s hilarious Twitter feed. So AIBU M&S are right or YANBU Aldi all the way.

They all also taste different. The quality and taste of M&S will be far superior to the likes of Aldi, thus damaging the M&S brand if people confuse the two.

Aldi are notorious for copying other brands branding. They actually delisted their yoghurts when The Collective yoghurts took legal action.

They all also taste different. The quality and taste of M&S will be far superior to the likes of Aldi, thus damaging the M&S brand if people confuse the two.

But as I said previously without the box I doubt many would have picked Colin out of a line up as people just know he is a chocolate caterpillar they don't take note of the design of the legs or toppings.

Also surely the taste is subjective. Some may prefer the taste of colin but others might prefer how another tastes. Plus realistically any small child eating one won't give it more thought that mmm chocolate.

Oh definitely not trying to insuate he is the main market for them. We all know he frequently appears at work places up and down the country. I was merely musing that for some of those eating him then the taste is quite literally the very least of their worries. Grin

M and S have been doing knock off walnut whips for years so they are hardly innocent when it comes to copying.

I don't know how much development goes into creating each product, but however much or little, it was M&S who did that work. And they've marketed it successfully enough that the colin cake is associated with their brand and competitors want to copy it. I think it's a piss take to copy something so closely and basically sponge ( [ grin] ) off someone else's work. We don't support people making knock off designer handbags even though we are okay with rivals making similar versions. Similar is fine so long as they aren't pretending to be the real thing I think.
but they are not pretending to be the same thing. cuthbert is a completely different name from colin. so it is not passing off. they also clearly label it an aldi product. a fake gucci bag has a copied gucci logo. that is passing off.

and some will rub off onto lidl as well i think.

diddl on a party buffet table though you won’t see a box. You have a piece and think gosh Colin’s gone downhill I won’t buy one for DC’s birthday next week not realising party host served pretend Aldi Caterpillar. Booths (posh northern supermarket chain) used to do one too think he was called Cedric.
I mentioned that in an earlier post.

But that also assumes that a lot of people know about Colin & will assume that Cuthbert is Colin and that Cuthbert is inferior!

They all look freaky to me and shop bought cake tastes very synthetic. I'd happily do a blind taste test though. If Aldi use their dairyslime chocolate for their Cuthbert then it's going to taste very much like the aforementioned colon cake.

Yes, all supermarkets have a version of Colin, but that isn’t the issue here. All the other supermarket versions are distinctive away from Colin

If you are not familiar with M&S and haven’t looked too closely at Aldi or Tesco or Sainsbury’s then it’s all just caterpillar cakes

As long as it’s cake and there is plenty of sugar then do people actually look too closely at the intricate design,
It’s a cake shaped like a caterpillar.

They need to do a taste test. Aldi make some excellent quality products. I think it's more likely that they are worried that the Aldi one is cheaper, when it looks the same and is likely to taste good too. The likes of Asda would be no threat.

Most 5 year olds, no. However, some children are more particular than some adults.
