AIBU to ask whether you’re Team Colin or Team Cuthbert?

Yes I know it’s a trivial question but the lawsuit’s ridiculous and I’m bored. Other supermarkets have their own version of Colin, so why are M&S targeting Aldi? Also loving Aldi’s hilarious Twitter feed. So AIBU M&S are right or YANBU Aldi all the way.

It’s keeping the wheels of the economy turning and keeping us all harmlessly entertained.

Not a fan of Aldi, which is a huge multinational several times the size of M&S, presenting themselves as the oppressed underdogs so maybe that makes me Team Colin by default.

Agree, they're massive in Europe.

Not everywhere. Lidl is my family's fave. And Kaufland...
I am nkt sure about the latter, but Lidl has proper packaging copies of basically anything. Even aussie shampoos

I do see the point that someone might eat some of an unboxed Cuthbert that someone else has bought & think that it's Colin.

But surely Aldi aren't actually trying to dupe people into thinking that they are buying Colin in disguise?

No they're not trying to dupe the purchaser, who of course knows they bought it at Aldi. But they've deliberately produced a product that the purchaser can present at a party unboxed, as is usual, and say "I got you a Colin" and people would believe it was a Colin.

Waitrose and Sainsbury use same face just different eyes on theirs.
Incorrect. Waitrose’s Cecil has different colours and drizzle, and yes, a different face - just look at the ears. It’s a different shape entirely.

Sainsbury’s Wiggles again has a different shaped face, different coloured bits and hundreds and thousands type decoration that Colin doesn’t have.

And there we go back to Cuthbert is an exact replica of Colin while other supermarket versions are different.

I actually think m&s is right to.
You don't pay for copyright to then not enforce your rights.
I say this because I think the Aldi one looks almost identical to the m&s one.
Most of the others look significantly different, except the Sainsbury's one, I think they might be next in the firing line.

So by producing the exact replica they are enticing the purchaser to buy a cheaper replica to present as a more expensive Colin. That's why it's identical.

Well, I mentioned just the face and it wasn't even in a defence of Aldi. Just an observation.
They are the same face, different eyes.

Miguel Tuna is very worried by the whole situation. He is related to both Colin and Cuthbert, and is just hoping this whole thing doesn't lead to a resurgence in hostilities between the factions...

As far as I was aware (via an Aldi buyer), a lot of the stuff in Aldi IS the same product as in other supermarkets from the same manufacturers - including M&S products. So my immediate thought was why is this an issue? I didn’t even know a caterpillar cake was anything to do with M&S until a couple of years ago, just thought it was a standard supermarket cake design. And Colin has a scary face.

The Aldi one is an exact copy, I think others have been just different enough. TBH I don't understand why Aldi and Lidl aren't sued for many more products but I do buy all their rip offs

I love Aldi & have just been but forget to get a Cuthbert! I loved the FB post a PP posted about Grin

Their knock off Lurpak is fab and I always thought it was Norpak but it's actually Nordpak, was the D always there? I'm clearly very bored and lockdown is having an effect!

I think Cuthbert will seek out Oprah Caterpillar soon to open up about ' his truth'
He didn't want the same design as his cousin and felt really uncomfortable about a possible rift, but Aldi said no, we want our cake and eat it. We can get away with this. They won't know the differences between you. We can deceive .
Cuthbert just wants to turn into a beautiful butterfly and get away from all the bad press.
It's all very sad :(
