AIBU to ask whether you’re Team Colin or Team Cuthbert?

Yes I know it’s a trivial question but the lawsuit’s ridiculous and I’m bored. Other supermarkets have their own version of Colin, so why are M&S targeting Aldi? Also loving Aldi’s hilarious Twitter feed. So AIBU M&S are right or YANBU Aldi all the way.

Also - having read about the case (possibly too much) it’s to do with people not being aware of the “origin” of the cake. So they could walk into Aldi and purchase their cake and believe they have been to M&S and purchased their cake.
Which is frankly, stupid. I’ve never once walked into Aldi and mistaken it for M&S or vice versa.

Cuthbert, quite frankly, looks insane. Reminds me of Dr Strangelove. I wouldn’t have him in the house.

I've never eaten a ' Coin' but even I'm aware of its origins! I preferred the soft icing m and s cakes they did anyway.

They are the same face, different eyes.

@SchrodingersImmigrant Incorrect again. It’s an entirely different shape of face - look at the photo you posted. M&S’s isn’t round.

I don't know how much development goes into creating each product, but however much or little, it was M&S who did that work. And they've marketed it successfully enough that the colin cake is associated with their brand and competitors want to copy it. I think it's a piss take to copy something so closely and basically sponge ( [ grin] ) off someone else's work. We don't support people making knock off designer handbags even though we are okay with rivals making similar versions. Similar is fine so long as they aren't pretending to be the real thing I think.

But the person eating it doesn’t necessarily know that they’re eating an Aldi product - if you see an unboxed cake that looks like that you’re likely to think that it’s M&S because they’ve promoted the product heavily over the last couple of years.

It’s in the nature of celebration cakes that they’ll be bought by one person and then shared around lots of others.

diddl on a party buffet table though you won’t see a box. You have a piece and think gosh Colin’s gone downhill I won’t buy one for DC’s birthday next week not realising party host served pretend Aldi Caterpillar.
Booths (posh northern supermarket chain) used to do one too think he was called Cedric.

In all fairness I doubt many would have been able to pick the m&s one out of a line up.

Most of those who know m&s sell a caterpillar cake called Colin wouldn't know what his face, feet or toppings looked like, they just know it's a chocolate flavoured caterpillar shaped swiss roll cake.

I suspect this is a shot over the bows to Aldi from M&S to stop doing close copies of a range of products. They’ve chosen Colin because it’s well-known, and more newsworthy than the packaging on pork and leek sausages

You'd think M&S would be concerned about the Waitrose cake more as they are a more similar competitor than Aldi

When I heard this I thought of another 'Colin', the Middlesbrough football manager (it's an anagram of Neil Warnock, I will leave you to work it out!).

Ludicrous court case given how little they must make of their turnover on such cakes.

And if it wasn't all about impersonating an already very successful product, they could have chosen literally any other animal, or as PP said, their silly little carrot character.
