Delivery driver tried to run into me

Long and short is that I had a delivery today. Pallet was over 2 metre high and they wouldn’t deliver it to the back of the house. Every other delivery has been delivered this way. He wouldn’t tell me why he wouldn’t do it. It could have been there wasn’t enough space or whatever but he wouldn’t say.

I asked him to take the delivery back as I didn’t want to be liable for a pallet on the main road that wasn’t secured properly (was no wrap at the bottom) and I hadn’t signed the tablet. He refused.

As the driver was closing the back of the van etc I stood at the front of the van and tried to call the company. The driver than tried to drive into me. Had to call the police etc.

AIBU for standing in front of the truck and him trying to run into me? I was on the phone to his company.

@cerseii it most certainly is and certainly makes you realise just how hard of a job a Truck driver has. My OH is a Truck driver and I can remember one time as he was approaching a zebra crossing he could see two young girls at the side of the road and then suddenly they disappeared. He had to stop his Truck where he was which was away from the zebra crossing and actually stand up in the cab before he could see them part way across the road. Mind you he also had a woman walk behind the back of the Truck whilst he was reversing into the store he was delivering to. She pushed her baby's pushchair across just as he was reversing and left it behind the back of the Truck. Everyone else had stopped to let him in. Worse for her the reversing camera was spot on that day and she got the shock of her life when he jumped out walked round and went bloody move now. I also know from experience of another Truck driver asking me to guide him into the delivery area that they cannot see if you are stood in certain areas. The driver I was guiding in had a reversing camera but it was dark and he said he couldn't see me at all when he was reversing. Difference was as soon as he was nearly in I was back on the path and hit the trailer a couple of times to let him know he was nearly in

What exactly happened? Did he start his engine when you were standing in front making the call & then manoeuvre around you & drive away or did he deliberately drive at you? If the former, complaint to his company. If the latter, I'd be off to the police station to make formal complaint. Where is the pallet now then? On the road presumably if he wouldn't move it??

You were hit by a truck and the police never came? Did the delivery driver drive away after he hit you with the truck?

Instead of calling the police about something that almost happened and instead of posting on MN you'd be better off just contacting the company that sent the driver out to you

That all sounds quite scary and difficult for truck drivers, however if he was approaching a zebra crossing and saw people standing there then he should have been stopping anyway. I know the actual rules are that if they arent on the crossing then they dont have right of way, but when you see pedestrians at a crossing, you stop.

@AWhisperWillDoIfThatsAllYouCan sorry probably didn't make that clear in my other post but he was slowing down to stop. Sadly though people don't often realise a fully loaded 26 tonne Truck doesn't just stop like a car. Years ago when I was with my exH we witnessed a couple of lads playing chicken with a Truck whilst on a busy road. Thankfully the driver saw one of them and was able slam his brakes on, but bearing in mind this guy was driving to the speed limit of the road the distance that Truck traveled forward with its wheels fully locked was surprising

Honestly it was pretty stupid of you to stand in front of the van. Why not just let him leave and phone the company to complain? Although you paid for kerb-side delivery, but wanted it by the back, which is probably a paid extra…

YANBU. It doesn't matter how awkward of a customer you were being. No-one should be driven into.
You were entitled to refuse delivery as the item /packaging was not of satisfactory quality.

Op has explained several times that she didn't want the package left in the road because it was potentially unsafe and would have been her liability if someone or something had been injured or damaged as a result.

Got in his car.
Started his engine.
Moved us vehicle in front of me.
All with CCTV.

Yes YABU if you were stopping him from leaving. Why would you stand in the road blocking someone in a van.

Yeah, in what way did he try to run you over? How did you stop him? I'm guessing he edged forward and you moved out the way? That doesn't mean he was trying to run you over.

But that's the delivery Op paid for.... she wanted the driver to make the delivery onto an unmade road which I'm assuming would've been an extra, hence was unwilling to do it
So she refused the delivery, fair enough. Then she stood in front of his lorry when he wanted to leave. Why not just let him leave?! He had other jobs to do I'm sure. Did she want him hanging round while she argued the ins and outs with the company, which would've had nothing to do with the delivery driver.

notmethenwho the driver had already dropped the goods so she was trying to force him to lift them again. She was too late to refuse delivery. Delivery had occurred.

Kerbside is just that. Why should he move an unsafe pallet....was it hiab truck?

You ordered kerbside drop off then refused other delivery drivers have been nice enough to drop at side instead does not mean they have too an they don't need a reason not too either. However he is completely in the wrong for driving at you.

Apparently they didn't come out and are waiting for CCTV from the cab. I know the police are busy but surely they'd come out for a hit and run?

Unless you left special instructions to deliver it to the rear of your property then the seller, and their method of delivery, has fulfilled the contract by delivering it to your home address. If you don't want it left on the road then you'll need to arrange your own way of getting it inside. YABU to make this poor delivery driver late for his other deliveries, likely risking his job, due to your lack of planning.
