Childminder kicking out child for not being potty trained is she BU?

My niece is currently not able to attend her childminder as SIL isn't a keyworker. SIL has contacted childminder about care resuming from March 8th and been told she will only have DN back if SIL can guarantee she will have no accidents.
Is the childminder being unreasonable, is this even allowed?
DN is 5 and in Reception, no SEN.

My 6 year old (year 2) has toileting accidents, she has a muscle condition that particularly in the cold affects her being able to feel the need to go so sometimes she doesn't quite make it to the toilet or feel the need to go at all.

Due to her medical condition she was late to potty train (she wasn't diagnosed until she was in Reception but we suspected she had a condition as she really struggled) and only trained at the Easter before she started school (Easter 2018, started school Sept 2018) and was still have daily accidents until half way through Year 1. She still has 2-3 accidents a week, sometimes as many as 5 in a week.

School have always been great although I feel sorry for them. The difference is they're aware she has this condition that masks her need to go to the toilet.

I'm not saying your DN has a condition and it isn't laziness but you can't know that without having it looked into.

It’s tricky as if child is pooping in knickers rather than a nappy it is a pain in the bum to clean. Find another child minder and explain what happens.
Does the child hold their poop in at school all day as soon many kids don’t like using the school toilets as they aren’t particularly private and noisy then can’t hold it in anymore.
Kids do have odd accidents but every day warrants further investigation
