Is my neighbour selfish to smoke on his balcony

First AIBU.

I live on the 3rd floor of a block. My neighbour below is home a lot now. I am also working from home.

It is a new build, south facing flat, which is extremely warm.

He is now smoking most days on the balcony. Flats are non smoking, assume he is allowed on the balcony.

There is literally nothing I can do apart from using diffusers etc.

There is a group Facebook group and people moan all the time about parking and kids, it's a bit vigilante so I don't want to be one of them.

I want to email the Housing Association but not sure what they would do.

I used to smoke so I am extremely sensitive to the smell. It's impossible to ignore. I also have lung disease so its quite drying. These are my problems I accept, but do you think;

Is he being selfish given that everyone has to be at home now.

Bettter to smoke outside then in. I can def see your point of view but I don,t thik you can do anything about it.

Patsypie · 03/05/2020 15:18

Tough luck I'm afraid. It's his balcony and it's outside.

GrumpyHoonMain · 03/05/2020 15:19

Not much you can do except keep the windows closed.

BeforeIPutOnMyMakeup · 03/05/2020 15:19

Unless it is forbidden go smoke inside your own individual flats he can smoke on the balcony as that's part of his flat.

Poptart4 · 03/05/2020 15:26

I hate smokers but theres nothing you can do about it. Hes allowed to smoke on his own balcony.

Purpleartichoke · 03/05/2020 15:28

He might not be allowed to smoke on the balcony. You need to check your building regulations.

SciFiWoman · 03/05/2020 23:45

Could you get a fan, Op, and point it towards your balcony or windows, therefore wafting the smoke straight back out.. or at least ‘diluting’ it a bit? It must be yuk for you, I’m not a fan of someone else’s fag smoke!

nocoolnamesleft · 03/05/2020 23:59

He is being unreasonable, but there's not much you can do about it.

PumpkinP · 04/05/2020 00:31

I can't see the problem and I hate smoking but this is fine imo, I live in a g f masionette and my upstairs neighbour use to smoke out of his window , the only time I complained to the council was because he started throwing the cigarette butts out of the window into my garden! Thankfully he has moved no w.

LouiseCollina · 04/05/2020 01:14

These fucking smoking threads are relentless... YABU OP because he is OUTSIDE!

Close the window, buy a cooling fan, and stop trying to police other peoples behaviour.

stella1know · 04/05/2020 01:18

YANBU because the smoke spreads and it is awful. Not much you can do about it though unfortunately.

Tigersneeze · 04/05/2020 01:20

YANBU

literally poison drifting into your home.

WelcomeToGreenvale · 04/05/2020 01:43

YABU. Live in a block of nine flats, three by three. Everyone smokes on their balconies because the buildings are nonsmoking. The wind direction is no one's fault.

I hate smoking as much as the next person but it's no different to having someone standing in their back garden next to yours while smoking.

anonacatchat · 04/05/2020 01:46

Actually in most new developments smoking on balcony's is forbidden . Check ...

Btdp · 04/05/2020 01:49

I hate smokers

That's a bit harsh, some of them are nice people Wink

7Days · 04/05/2020 01:50

Leave the lad alone. Cog smoke doesn't linger in the open air

PurpleTrilby · 04/05/2020 02:38

How many of you lot who are so anti smoking drive a car? Seriously, you get all upset about people having a fag, a legal activity, on a privately rented balcony. Whether he's allowed to is dependent on the tenancy agreement and nothing to do with anybody else. Meanwhile all you drivers are / were fucking up everyone's air supply. One of the upsides of lock down, less traffic pollution. But no, the biggest fucking problem is a man smoking a fag. Jesus.

LouiseCollina · 04/05/2020 02:49

Too true PurpleTrilby, you never see these anti smokers brigade posts prefaced by an apology for the many times more carbon dioxide they’re pumping out into the world.

CoffeeIsMyOnlyJoy · 04/05/2020 03:03

I totally understand your frustration, but he's only allowed outside his home once a day. What you are essentially asking is that he quit smoking, which is pretty unreasonable.

Honeybee85 · 04/05/2020 03:08

I understand it's annoying for you but it's his own balcony and he's outside.
When I was a smoker I always smoked on my balcony and neighbours who complained about it wouldn't have affected my decision to do so at all. These days people seem to have become very intolerant of smokers to the point where it's getting ridiculous.

MrsTerryPratchett · 04/05/2020 03:11

literally poison drifting into your home.

God the drama.

Any studies that prove that second hand smoke, briefly, from outside, has any effect whatsoever on other people? Thought not.

There are things he could do if you fancy chatting to him. You can make a cool thingy from a cardboard tube with a dryer sheet in it. Blow the smoke through that; no smoke. Or a fan he smokes next to.

Reginabambina · 04/05/2020 03:13

@CoffeeIsMyOnlyJoy OP is in the U.K.

Yes, it’s incredibly selfish to smoke where you know your fumes will get into some else’s house. Horrible thing to do. I’d suggest getting yourself some aircon, you’ll thank yourself in August.

SkiingIsHeaven · 04/05/2020 03:14

Could you buy some pots and flowers for your balcony. Then overwater them so the excess water pours down and puts his cigarette out?

HeronLanyon · 04/05/2020 03:16

YANBU.
He might not be able to smoke on his balcony - lots of flats with balconies include them in no smoking terms of lease.
I wouldn’t say anything just yet though. See what happens may7th - it might be that he’s back to work and it’s no longer a problem.

LostDesire · 04/05/2020 03:21

Yeah smelling smoke when you're not a smoker is rank. However he is not being U for smoking on his own balcony.

Yes @PurpleTrillby I agree a lot of people are hypocrites. They will dis smoking, yet feel fine using a car, bus, train that all shit out a hell of a lot more crap then a cig. It's a life style choice to use poison transport. Same as smoking, both impact others.

Everyone does something that impacts other people. No one is innocent lol 😂 ... Even breathing has a impact, tut, tut you selfish people.
