Is my neighbour selfish to smoke on his balcony

First AIBU.

I live on the 3rd floor of a block. My neighbour below is home a lot now. I am also working from home.

It is a new build, south facing flat, which is extremely warm.

He is now smoking most days on the balcony. Flats are non smoking, assume he is allowed on the balcony.

There is literally nothing I can do apart from using diffusers etc.

There is a group Facebook group and people moan all the time about parking and kids, it's a bit vigilante so I don't want to be one of them.

I want to email the Housing Association but not sure what they would do.

I used to smoke so I am extremely sensitive to the smell. It's impossible to ignore. I also have lung disease so its quite drying. These are my problems I accept, but do you think;

Is he being selfish given that everyone has to be at home now.

I'm with OP on this one, we had to live for a while in a flat and the neighbours below us smoked on their balcony - it was horrible. In warm weather when you wanted to have the windows open you couldn't because of the stink. It was one of the reason we moved far more early than we originally wanted too. We even put it as the main reason when the LL asked why we were leaving early.

I would smoke on that balcony. I don't think you can report the man.unless there are now no smoking balconies everywhere !!

I see why it's annoying as I also really hate the smell of smoke but he's not doing anything wrong, he's allowed to use his own balcony. It's just a downside of living in a flat I guess.

Just looking as I woke up. I am glad 15% agree, but it looks like a resounding YABU.

We are not allowed barbecues so this may be a thing. Will have to check.

A fan is a good idea thank you. It's actually lingering and all I can smell now.

I hadn't really thought of it as toxic.

I don't have a car myself, but get the point.

He doesn't have to stop, he could vape. I'm intrigued what the cool thing with a cardboard tube is.

I honestly don't mind occasionally, but it is now all the time. Sorry that wasn't as clear in my post.

I slammed the window quite loudly today. Passive aggressive but felt good.

Will dig out the tenancy agreement, just to know.

His balcony, he can do whatever he wants. He shouldn’t have to vape if he doesn’t want too, I’m sure you’d end up complaining about that too eventually.

I feel for you OP as I'm a non smoker, unfortunately there's no getting away from it unless you live in a detached place away from other.
We lived in a terraced house and people would smoke at their back door and the smoke would drift straight into the living room and bedrooms in the summer we put up with it as it's their property. However when they started smoking weed they got asked to do it away from our window and they were cool with it

OP vaping stinks as well. Different smell but it stinks.

I would be tempted to put leaflets in his post every single day saying smokers are more likely to die if they catch Covid-19.

YABU. Good ol' MN smoking thread - kill all smokers, I hate smokers, report them, call 101, poison, you will die immediately - right up there with BBQ threads. Too bad this Summer won't feature the usual bitching threads about smokers in pub gardens because won't someone think of the children?!

PMSL! Yeah, PA waste of paper so going to work! It appears smokers aren't as likely to catch the virus, but more evidence needed of course. I don't smoke but if I did and found out my neighbour was harassing me with PA bollocks it would tempt me to smoke even more.

OP I really do sympathise, yes he's outside but you are above his balcony so you get full whack of the delightful aroma & quite frankly disgusting habit

It's a really shit situation as you can't control his behaviour & to have to keep the windows closed is a rubbish long term solution as we move into the warmer weather

You have my sympathies

I think it's unfair for some others to say that you are policing other people's behaviour- YANBU as you are totally & utterly impacted by this

Maybe they have a smoking policy including balconies etc. Worth trying

If you take the advice to report him be very careful that nothing you do breaks any rules. Half my neighbours have dogs and cats for example.

Unfortunately nothing you can do though unless rented and smoking not allowed on the balcony
