Is my neighbour selfish to smoke on his balcony

First AIBU.

I live on the 3rd floor of a block. My neighbour below is home a lot now. I am also working from home.

It is a new build, south facing flat, which is extremely warm.

He is now smoking most days on the balcony. Flats are non smoking, assume he is allowed on the balcony.

There is literally nothing I can do apart from using diffusers etc.

There is a group Facebook group and people moan all the time about parking and kids, it's a bit vigilante so I don't want to be one of them.

I want to email the Housing Association but not sure what they would do.

I used to smoke so I am extremely sensitive to the smell. It's impossible to ignore. I also have lung disease so its quite drying. These are my problems I accept, but do you think;

Is he being selfish given that everyone has to be at home now.

I'd hate that - I wouldn't want to have to smell foul cigarette smoke but smokers tend to be really selfish and oblivious to others.

I'd check the policy.

I would definitely check with the HA.
The block of flats that I used to live in did not allow people to smoke on the balcony.

You're wrong there. I smoke and stink to high heavens and am perfectly happy to admit it. Perfectly happy to keep on smoking and stinking too. Each to their own! Grin

OP, if smoking on the balcony is against the tenancy agreement then obviously you have a case here. Given the times we're in I still think it'd be pretty mean spirited of you to enforce it. It's not like your neighbour can go for ten walks a day!

What2dohere fair enough and I salute you and accept you for saying my comment is wrong in your opinion

My comment was based on a friend I'd had in my car many a time. The few occasions I got out of my car I’d come back and she was smoking away saying smoke doesn’t smell. The lifts soon stopped

There’s a high chance he’s not allowed to smoke on his balcony either. You could try and talk to him first but be prepared for a push back. I’m in the same position, it’s disgusting.

His enjoyment of his property is infringing your enjoyment of yours, whether rented or owned. What is termed “reasonable use” may be defined in the leasehold agreement so check whether smoking is allowed.
It is unreasonable of him to smoke when everyone else is cooped up and either has to bear his toxic smoke or close the windows ten times a day. For children in an already polluted city it is cruel hell, as for pregnant people. It is also a fire hazard so yozu may have a chance there. Complain if there is anyone you can complain to.

Judging by the number of smokers who smoke under busstops and at playgrounds where you specifically aren’t allowed to, some smokers will push boundaries and enforce their smoke on others unless banned from doing so, saying “but it’s in the fresh air dahhhhling” and “i have a right to do so”

Smoking is rank but it's legal and he is doing it outside... it sucks, but it is what it is.
