Is it my fault I scratched my car?

So I’m in a situation where I scratched my car whilst driving, but wasn’t really given another choice (there was one other choice but it would’ve been a nightmare). I’m wondering who you would hold at fault for this?

I have a diagram, I’m uploading from a phone (please excuse the scribbles my toddler grabbed the pen 😂)

Options as I see them:

  • pull back into traffic - you said they were all banked behind you suggesting room to return to the road. Plus once through the gate you sat in the car for half an hour, so had time to find another park.
  • if possible and enough room from a slightly different approach, do a modified 3 point turn to reangle your approach - only works if there is sufficient space to fit through the gate from a different angle and sufficient space on the road to let you do a wiggle.

Damage the car would not be a viable option for me.

I’m confused, you say you couldn’t see the blue car as you were turning as it was behind the wall so surely you would have hit the wall if the blue car was or wasn’t there? How did it become an obstruction if it was behind something you hit and you couldn’t see it?

I think I’d have been braver if people could see the blue obstruction 🙈 then at least they’d go “oh she can’t move” and not “why is this silly bitch just sat in the middle of the road”

I think most people behind you would just assume that there was some reason that you weren't pulling in rather than thinking that you had just stopped because you are a half wit! And if they did, then surely a quick walk up to the front of the queue would confirm that you weren't being unreasonable to stop - literally nobody would expect you to scrape your car. The only reason people could be annoyed was if there was in fact plenty of space, but you had no idea how wide your car was and weren't confident about getting it through in which case someone could have offered to guide you through.

That must have been very annoying. But I think you needed to stop where you were and get out of the car to ask the pink cars on the road with you to make room for you to get back onto the road. They can't expect you to damage your car and if you are blocking their way they would have to scooch back and let you out.

Sounds really stressful, was the blue car parked like that or were they reversing?
If they were parked and had left the car unattended then the only option you had was to block the traffic and wait until driver of blue car returned.
If they left their car like that then they are an idiot.
Unfortunately you don't really have any come back I hope the scratches are easily sorted.
I think I may have actually made the same decision to you, hoping that I could actually squeeze through.
Much easier to reach a different decision in hindsight and without the pressure and stress

Sorry I see you were a bit stuck but was your fault....the nightmare you alluded to knowing was correct. Assuming that the night mare was get out of car make sure the rear cars moved enough for a rewind.

As the driver of a car YOU are responsible for ensuring you don't hit anything. No court or insurance company will find you anything other than 100% at fault. Under the Road Traffic Act, your ONLY option was to wait until you could reverse out safely and park somewhere else.

It looks to me from your diagram that you’ve cut the corner off to get into the car park? Surely you’d have been able to see the blue car if your road positioning was correct? Sorry if it’s not clear on the diagram.

I would have either tried to pull back (once people see reverse lights they would do the same so eventually you would have had enough room to get back onto the road) and then drive back round to park elsewhere. Or I would have put my hazard lights on, got out and let a few of the cars behind me know that someone was parked like a twat therefore I cant move so would you mind reversing back a bit please just enough for you to manoeuvre your car out. No way would I scratch or damage my car on purpose?

I'd have waited and put hazard warning lights on or found a way to reverse. Why would you damage your car just because people are honking horns ?!

Bot RTFT but enough to understand the problem. I would have stopped, got out and spoken to a car in the queue of traffic behind me and explained the problem and that I needed to be able to reverse back onto the road, so when the traffic pulls forward could they please not pull forwards and make a gap to allow you to do this?

Unfortunately regardless of whether or not you were blocked in you were at fault as you were the only person driving the car. I had to squeeze out of a parking space in a pub car park some time ago as some silly sausage had park up in the non parking area. Ended up misjudging and scratching silly sausage's car and paying for repair to his car as I was the only one trying to move my vehicle past an inanimate object!

By saying there was another choice but a nightmare? is again admission of fault through choice. Why a nightmare, can you reverse in, wait, take a look,, wider turn in angle etc etc ...

Oh dear OP 🤦🏻‍♀️

I’d have jumped out the car and waved the car behind me to go on and asked the car behind that to wait for me to reverse. If necessary i would have stopped the traffic coming in the opposite direction if the car would have had to go in the opposite lane. Then I’d have reversed out.

I wouldn’t even have been embarrassed about it. 🤷🏻‍♀️ It have taken a few minutes.

I would never had purposely driven into a post 😂😂😂

OP has said that there was no room for the car behind her to get past,unless she pulled further in (and in doing so scraped her car)

It sounds like the exact type of situationthat makes me hate driving. I do it because I have to, but I'm really not keen on it at all!! I'd have tried to reverse too, but if people weren't forthcoming then I'd quite likely have contemplated scraping my car too, tbh, and depending on the stress levels I'd have done it
