Re. my holiday allowance?

SpunBodgeSquarepants · 26/01/2020 17:03

I started a new job last June - holiday year runs 1st January to 3st December. I work 3 days a week - 5 hours a day, totalling 15 hours a week.
My colleague works 42.5 hours a week and receives 20 days holiday. I get 7. This means I can only take 2 full weeks off per year, which is really not great for me, being a single parent. It's really difficult to find childcare during the school holidays! Am I right in thinking that this has been worked out wrong? I see where they've got this figure from - I work roughly a third of the hours my colleague does, therefore. I get a third of the holiday days too. But this would be based on full, 8.5 hour days wouldn't it?
Help!!

Probably been said by now but legal entitlement is 5.6 weeks of holiday so you'll get around 83 hours.

Binting · 27/01/2020 22:31

Hi OP. I work p/t and we have 26 days holiday (plus BH’s).

My understanding is that pro-rata annual leave hours are calculated as my hours (28) divided by normal ft hours (35) x holidays (26) x daily hours (7) = 145.6 hours

If your company has 28 days leave and a 35 hr week yours would be 15/35 x 28 x 7 = 84 hours or 12 days

Hi I am also confused about my holiday. I work 30 hours a week 5 days a week. I dont work all of August. My employer pays us holiday pay in 2 lump sums in August and December. It's only worked out to 7 days in my December pay and about 8 days in August, so 15 days for the year. Is this right? I've asked the person who does payroll about it and she told me they use some spreadsheet to work it.

nonamesleftatall · 27/01/2020 23:16

5.6 x however many days worked per week, is your total holiday allowance including bank holidays.

So your full time 5 day colleague is 5.6 x 5 = 28 - made up of 20 days plus 8 bank holidays.

Yours houses be 5.6 x 3 = 16.8 - made up of 8 bank holidays and 8.8 (rounded up to 9) days for you to choose.

Also depends if you work Mondays as there are more Monday Bank Holudays you dont get them in the count they our taken out of your holiday allowance. Working part time alwaysbedt to doTes, wed, thurs or wed to Frid

Changeofname79 · 28/01/2020 05:43

@Skone yours is a slightly more complicated one but you are still entitled to the 5.6 weeks pro rata. If you work for 238 working days out of 260 in a year then you should get 20.5 days or 154 hours.

Changeofname79 · 28/01/2020 05:44

@Skone is it just August you don't work?

dementedpixie · 28/01/2020 06:10

@Skone you should still get 28 of your shorter days as holiday or 5.6 x 30 = 168 hours. August 2019 had 22 working days which still leaves you with 6 days to take. Or 22 x 6 = 132 which taken from 168 gives 36 hours left.

How have they worked it out? Do you get to take other holidays?

dementedpixie · 28/01/2020 06:15

Do they deduct other bank holidays too?

StatueOfBiberty · 28/01/2020 07:01

I work exactly the same as you, 15 hours pw over 3 days so 5 hour days and I have just got 14.5 days holiday allowance (not including bank holidays).

As a comparison my colleague who also does 15 hour weeks but over 2 days so 7.5 hour days has received 10 days allowance.

When you work it out we have both received basically the same ie 5 weeks holiday (I am half a day short for some reason).

Changeofname79 · 28/01/2020 07:34

@dementedpixie I have excluded August as assumed she meant not paid so a bit like term time workers but I may have misunderstood, in which case you are obviously correct. I have removed August from the calculation as you would for annualised hours or term time so I may be wrong there.

Also I have said 20.5 days but that's based on 7.5 hrs so I should be 25.6 days or 154 hrs if August is unpaid.

Changeofname79 · 28/01/2020 07:37

@Skone please see post above re days. It definitely depends on what the other terms are re your leave.

thatmustbenigelwiththebrie · 28/01/2020 07:47

I'm part tome and my bank holiday allowance is also pro rata'd. So it doesn't matter if it falls on my working day or not (which it usually does as I work Mondays) I get 60 percent of the total bank holiday hours for the year as I am 60 percent FTE. I think this is standard and fair.

bruffin · 28/01/2020 08:07

thatmustbenigelwiththebrie,
It depends how you work. If you work every day but say just 9 to 3 then it wont affect anything, but if you work just 3 full days inc a Monday you will be given 60% of the day, but have to pay back a full day if that makes sense.

Polly673 · 28/01/2020 08:53

Definitely entitled to 17 days. Our cleaner only works 10 hours a week but gets the same holiday entitlement as full timers because she is in 5 days a week and is entitled to 5 weeks off like the rest of us.

LizzyA123 · 28/01/2020 10:01

Hi,

I think they’ve given you 7 days at full time hours (8.5) which translates to 11.9 days at (5hrs). Ask for your entitlement to be specified in hours not days. You should also be entitled to an equivalent portion of bank holiday hours (even if they don’t fall on one of your working days) so that you can take the time elsewhere.

LizzyA123 · 28/01/2020 10:04

11.9 will be rounded up to 12 days so you do get four weeks holiday based on a working week of 3 days

Skone · 28/01/2020 14:15

@Changeofname79 we are also closed 2 weeks in December so no one works then. They calculated holiday from Aug to December. I only took 3 days off during half term but that was non paid holiday. The next calculation is Jan to July and we get that holiday in August. Any 'holiday' time we want to take off is non psid

Changeofname79 · 28/01/2020 14:25

@Skone So you dont get paid for August at all or 2 weeks in December? Their calculation doesn't sound quite right still though. Do you work bank hols? To calculate properly I need to understand your terms more.

It might be worth you using the online calculator that has been posted on this thread and you can put all your details in and it will calculate it for you. Happy for you to PM me if you have any questions.

BackBoiler · 28/01/2020 17:28

Yes we get our entitlement in hours therefore a days' holiday for someone who works part of the day is less than what someone that works a full day. You should get the same amount of weeks off, it is just that you book the hours that you work.

burnoutbabe · 28/01/2020 17:57

i think the bank holidays get added on and then prorated - so 28 days holiday /5*3 if you work 3 days a week.

So 16.8 days. You just have shorter days. (so the 84 hours people mention)

And you need to take off the bank holidays which would fall under your normal working days, the rest is yours.

ilovemyrednosedaymug · 28/01/2020 18:40

yes, if you work bank holidays then obviously they are not part of your holiday entitlement so you can take them at any time.

However it is worked out, you should always get at least 4 x your working week whatever that is.

Holiday has changed which has confused people as the standard used to be 20 days plus bank holidays, now it is 28 days to include bank holidays.

burnoutbabe · 28/01/2020 19:00

Also, one joy of being part time (i do one day a week now) is that when there is a week with a bank holiday, I can just come in another day and so get that day to use at another time (well a pro-rated part of it)
So i get 5.6 days to take each year, which in effect means i can have 5 whole weeks off if i wanted. Which is more flexible than others (who can have 4 whole weeks off (20 days) and then 8 allocated bank holidays.

appreciate not all jobs are that flexible as to what day you come into work.

adnilc · 28/01/2020 23:52

You should be entitled to 84 hrs holiday per year, according to the .gov holiday entitlement calculator.
