Re. my holiday allowance?

I started a new job last June - holiday year runs 1st January to 3st December. I work 3 days a week - 5 hours a day, totalling 15 hours a week.
My colleague works 42.5 hours a week and receives 20 days holiday. I get 7. This means I can only take 2 full weeks off per year, which is really not great for me, being a single parent. It's really difficult to find childcare during the school holidays! Am I right in thinking that this has been worked out wrong? I see where they've got this figure from - I work roughly a third of the hours my colleague does, therefore. I get a third of the holiday days too. But this would be based on full, 8.5 hour days wouldn't it?

@dementedpixie the OP says her holiday year runs from Jan to Dec so my calculations are for 2020 where the bank hols are evenly split between Mondays and Fridays Smile

So 84 hours minus 5 Bank hols x 5 hours = 59 hours so 12 days Smile

You are working Monday so you are getting hammed for bank holidays which are part of your entitlement.

I worked for a small company once who also took two extra office closers on 2 Tuesdays which I also worked. Plus Christmas office closing. I worked on a Monday and a Tuesdays and a Friday so I got seriously hammered
This meant I had a week and a half to choose when I took myself

Does your company have days when they shut down or over Christmas. If so they will be in your leave entitlement
So I got 16 days
6 of these were bank holidays including good Friday
2 extra Tuesday closing
3 extra days we had to take as the office was shut over Christmas and new year
So I got 5 days
It was shit and they wondered why they did not retain part time staff.

If you worked Tuesday, Wednesday, Thursday you were laughing

As you started in June and your hol year runs jan to Dec you'll only get half the entitlement anyway for that half of the year.
But as we are in Jan again now you start a new year wirh new entitlement but you have to accrue holiday as you go - ie you can't take all of your holiday in Jan and then leave - you'd have to pay it back.

@Marnie76 your calculation is incorrect. This is my job. There is no leeway on this (other than giving more annual leave which many companies do). The 42.5 hours is irrelevant. The minimum allowance is 5.6 weeks for any employee.

There is no variance on this, the number of hours is 84 for a 15 hour/3 day week. You would use 37.5 hrs not 42.5 to calculate it. For a full year then pro rata for part of a year although it gets slightly complicated due to how its accrued.

Legally you should get at least four weeks leave i.e. 12 days.

Annual entitlement/5*3= your annual entitlement. Divide that by 2 to get entitlement for june to December.

They are not, because if a BH holidays fall on your normal working day you have to use it out of holiday allowance , so you are at a disadvantage as less choice when you take holiday. Work 3 days a week and on a Monday and Friday so in an unlucky year all 8 days fall on working days, you are entitled to 17 days less 8 BH leaving 9 days which is just 3 weeks. If you work Tues wed and Thursday you tend to be at an advantage as you will only have to take 2 or 3 BH days leaving 14 or 15 days to take when you like.
Mines really complicated as I work 7 days over 2 weeks. Mon Tue Thursday and every other Friday.

Sorry I meant you are entitled to that amount of leave regardless, I worded it badly. Yes if you work on a Monday for instance you may have to use your leave on a day a bank hol falls however it still remains you have the same amount of leave in total to anyone else, just a crapier deal them someone who works Tues-thurs as they have more choice over when they take their leave.

No, they are not irrelevant for part-time workers. I don't work on Monday or Friday and because of that my employer adds the bank holiday entitlement (pro rata) onto my annual leave. If they didn't I would start working on Mondays and Fridays!

That is exactly what I meant, sorry just worded badly! I work part time and also this is my job. I was saying if you are part time you get a number of hours/days regardless of when you work. If your working day happens to be on a bank holiday you may have to take your leave then, if not you are more freedom. I dont work Fridays so I dont have to take the Friday bank holidays.

Just to be clear - you get 28 days leave a year (pro rata for part time). That is the law and it includes bank holidays. If you dont work on a bank holiday day usually then you can use that day whenever. Sorry for my previously bad worded post.

OP works 5 hours a day x 3 days a week = 15 hours per week
15 hours per week x 5.6 weeks statutory leave = 84 hours per year
MINUS 5 bank holidays she normally works on = 84 - 25 = 59 hours
59 hours divided by 5 hour days = 11.8 days - rounded up = 12 days

OP is NOT deducted the bank holidays that fall on a Friday as she does not normally work those, her colleagues will be deducted those though.
