Aibu to be shocked by 24 hours in police custody

So a 15 year old boy rapes a 20 year old girl at knifepoint. He has also sexually assaulted another girl. He has been expelled from school for pulling up a girl's skirt and punching her in the vagina and asking two other girls to suck his penis. So after no commenting in his police interview, he tries saying the girl he raped was a prostitute he paid for sex. The CPS prosecute anyway, but psychiatrist says boy unfit to testify. The trial is held and he is found guilty. The judge orders a full psychiatric report on the boy and no further action is taken. So he is still at liberty to attack other girls and women. Surely something seriously wrong here?

Wtf? Why hasn’t he been convicted and sentenced. Can a psychiatrist get him off charges?

I didn't catch the updates at the end as baby kicked off. I did see the bit about him not being mentally fit for trial. I assumed he'd have ended up in somewhere like Broadmoor?

That’s shocking. Surely he could see a psychiatrist whilst in a young offenders prison!!!

I didn't watch it but normally if someone is found unfit to stand trial the psychiatrist would recomend detention under the mental health act.

No detention. I don't understand why. Was he supposed to be unstable when he did the rapes and before the trial yet OK afterwards. Did his young age affect the decisions? I felt so sorry for the rape victim who thought she was going to get some justice for the physical and emotional damage he had done to her.

I think he was locked away it was at the end he was free for 4 months then went to somewhere I was getting ready for bed so didn't read where. It was diagusting though.

I watched this as soon as they said he had learning difficulties and didn't understand complicated words my thought was "complicated words like, no?"

His poor poor victim . I was in and out the room with the tv, there was another woman who rang in as she had been touched up wasnt there? And the other woman in the hat he had followed?

I did wonder what on earth leads to a 15 year old doing that?

I think the boys dad came up with the prostitute story.
I was puzzled at the end because it did leave the impression he was not incarcerated.

I agree it wasn't clear from the wording at the end however can confirm he was not released. He is somewhere awaiting a full psychiatric assessment prior to sentencing.

I was shocked and disturbed that the 15 year old was not detained after he was found guilty of rape and that he remained in the community for a further four months before he was remanded for a full psychiatric assessment. I wonder if he is still undergoing assessment or if he has been released back into society?

The boy had clearly demonstrated a pattern of escalating deviant sexual behaviour. I fail to understand how he would not be deemed a risk to the public after being found guilty of such a serious offence.

I can't imagine how confused and frightened the victim must have felt when he was not detained. He lived in the local area and it would have been very distressing for her if she ever came face to face with him.

I just watched the end again.At magistrates' court the defendant was released on bail until trial. Psychiatrists decided due to his mental health capacity,he was not fit to stand trial.A trial took place without him. The jury concluded he committed the acts charged against him. He remained living in the community for a further four months before a judge remanded him for a full psychiatric assessment.

The final comment from the detective made me think he didn't get detained. Hopefully, I was wrong.

Yes, I was left with the impression that this very dangerous young man was not actually incarcerated - the detective's comment certainly seemed to suggest that. Good to see the sentence given to the other offender though - after 10 years he must have thought he was going to get away with both offences.

He was found guilty so would have been sentenced later. Sentence could have been custodial (often not as long as you'd think or would like, esp w time off, and victims/survivors often told when attacker released, but yes they may see them around)
If psychiatric report says he's not responsible would probably get mental health order and go to secure hospital, could be indefinite or quite short depending on if treatable, how they respond, how dangerous etc.

Well, most rape victims have to deal with the possibility of bumping into their rapist on the street on account of the fact our system is utterly shit.

Mental health is a good excuse these days to get out of shit.
Look at Ian Huntley, us tax layers pay for him to be in a 'rehab' style prison with his 60" TV /sky/mod cons and domino's take aways whenever he wants because he said voices told him to kill those two little girls.
Disgusts me how soft this country is

This is what Cambridgeshire Police tweeted yesterday about the 15 year old (who is now 16)

The 16-year-old boy is awaiting sentencing and currently the subject of a
hospital order which is due to be reviewed next month.

I'm not sure what that means but that's what they tweeted last night.

My attacker is out there, free to enjoy the world, free from any consequences of his disgusting actions while I battle the trauma of what he inflicted on me for the rest of my life.

Sadly, it's so, so common. I'd like to believe in karma but I don't. Instead I like to think he'll grow old with terrible health, lonely and unloved, eventually dying a slow, painful death.

CPS, ancient bigoted judges and a system that allows this to go on is one of the reasons police officers are so disheartened. Sitting at 3am with a named suspect, cctv, matching witness accounts and just waiting on the shit privatised forensic system only for CPS to refuse charge. You couldn’t write it sometimes.

That means he was detained whilst assessed by the psychiatrists. He is likely to have been sectioned in a unit.

I didn't watch the show but that's the norm in those circumstances (however wrong or right on a case by case basis)
