To wonder how we CAN even consider not bringing the girl back from Syria?

Do we not legally have to? We can't just wipe our hands of her, can we?

I've seen petition after petition on my Facebook feed about not allowing her back, sign the petition, etc etc.

But if she's a British citizen, does she not have every legal right to be here, even if she is vile and dangerous?

I did see someone mention she would have to get here on her own steam, but isn't there a big part in the British passport (I know she hasn't got one but she was entitled and is technically British), that says something along the lines of Her Majesty grants assistance and protection as needed?

Without her baby even coming into the argument, she alone regardless is allowed back here, vulnerable with a newborn or not.

@Walkingdeadfangirl

The baby was born in Syria so is a Syrian and should not be allowed into the UK.

Syria doesn’t have birthright citizenship, so no, the baby isn’t Syrian.

Syrian citizenship is passed down only through the paternal line - as hen baby’s father is probably Dutch, it does not meet the requirements.

Furthermore, as it cannot be proved that this Dutch man is the baby’s father, there’s no way the Netherlands will give it Dutch citizenship.

So the baby’s only citizenship is British, which it is fully entitled to through maternal descent. And as it’s illegal to make someone stateless, the UK government cannot withdraw the baby’s citizenship.

MongerTruffle · 18/02/2019 14:33

The baby was born in Syria so is a Syrian

Syrian citizenship is based on the father's citizenship.

Snowmaggedon · 18/02/2019 14:38

Yes that's me. sorry, I'm getting her confused.

icannotremember · 18/02/2019 14:38

Unless someone here is a Syrian nationality lawyer

Or if they are able to google and can find out within 30 seconds that " The Syrian nationality is transmitted by paternity (father) (see Jus sanguinis).[1] Therefore, Syrian nationality is determined solely by the father's nationality, while the place of birth is irrelevant. In other words, birthright citizenship is not recognized since being born in Syria does not grant an automatic right to become a national. In most cases, individuals are deemed to be Syrian nationals regardless of whether they are born inside or outside Syria as long as their father holds Syrian nationality.

Syrian women cannot pass on their nationality to their children. If a Syrian woman marries a foreign husband, their children will have no claim to being Syrian nationals even if they were born and raised in Syria."

Farahilda · 18/02/2019 14:39

"So the baby’s only citizenship is British, which it is fully entitled to through maternal descent."

Maybe.

It depends on the nature of his mother's citizenship. I've not seen comment on what her citizenship category is, or whether it can be passed on to a child born outside UK.

SaturdayNext · 18/02/2019 14:40

This seems to be a fairly comprehensive analysis of the legal position - barristerblogger.com/2019/02/17/can-the-home-secretary-prevent-shamina-begum-returning-to-the-uk/

Limensoda · 18/02/2019 14:42

Yes let's bring her home, where she can get a council house, benefits, be set for life and train other terrorists/raise a Jihadi son who can do the same. Just don't complain when it's your DC that are blown to bits by the bombs they make

You have no idea that will happen. No evidence to support your assumption. This is the sort of tripe people believe because they read stupid propaganda.
Her parents may support her. She may live with them. They don't share the views that she believed when she ran away.
You don't know exactly what she believes now. It's all fucking speculation by people who think they know.

JellycatElfie · 18/02/2019 14:44

It’s happened before. The navy rescued The Manchester bomber from Libya and now 22 people are dead and many more injured. Who wants to take that chance?

AnnaComnena · 18/02/2019 14:45

It depends on the nature of his mother's citizenship. I've not seen comment on what her citizenship category is, or whether it can be passed on to a child born outside UK.

So if the baby can't be Dutch or Syrian, if it turns out that the mother can't pass her citizenship on in these circumstances, what would the baby's status be?

teaandgingercake · 18/02/2019 14:48

I don’t think the majority want her back. Their rights to not to have someone with huge terrorist connections living amongst them should over rule her “right” to have her demands followed through. A lot of people are going on about her “rights” , whilst the rights of the population get ignored.

ReflectentMonatomism · 18/02/2019 14:50

Her mother is dead. She was raised by an uncle who is a "religious scholar" who encouraged her to get up at 5am each day to pray. He immediately sought the advice of Cage Prisoners. What assures you think he isn't a supporter of IS?

You don't know exactly what she believes now

We know she thinks that blowing up children at concerts is self-defence.

Puzzledandpissedoff · 18/02/2019 14:58

Predictably, the Grauniad's drafted in another useful idiot - a former al Qaeda member, no less, though he later claimed to work to prevent extremism - to suggest that objections to Shamima's return are "fuelling the ISIS narrative"

Even the Home Office saw fit to remove his funding at one point but up he still pops, yet another who insists that even the wish to protect ourselves involves offence to those who'd destroy us

TheRiverIsAComfort · 18/02/2019 14:59

She is in the best place and that's where she should be left.

She has one brass neck to ask for anything, as does the family's solicitor who had the ignorant temerity compare her to a war veteran!

WTBE · 18/02/2019 15:03

Out of the fire into the frying pan springs to mind. Would she be safe returning? I know to take social media with a pinch of salt but some of the comments ive seen in regards to this woman returning, the justifiable anger people have that she could come back because she dont fancy being in a terrorist organisation anymore is overwhelming.

For what its worth, and prepared to be flamed i would not waste a single penny trying to retrieve her or her baby.

If isis were "winning" you could bet she would not be on the news asking for sympathy and compassion.

teaandgingercake · 18/02/2019 15:05

No it isn’t fucking speculation, the UK is home to 25.000 known islamic extremists, that have to be monitored. It isn’t speculation that these people pose a potential threat to us. The evidence about this girl will have been gathered in the same way that our security forces gathered evidence about THEM. They certainly won’t dismiss what they know about her as speculation.

lunar1 · 18/02/2019 15:06

If she gets her back here she should never have freedom, she needs locking up. She said she wasn't bothered by the be headings and shows no remorse.

Why should anyone be her neighbour or have to go to school with her child. Why should anyone be put at risk like that.

She has been there over 4 years and it's too dangerous to risk her being on our streets. I will never find any empathy for her, Alan Henning was my friend.

Walkingdeadfangirl · 18/02/2019 15:07

So the baby’s only citizenship is British, which it is fully entitled to through maternal descent. And as it’s illegal to make someone stateless, the UK government cannot withdraw the baby’s citizenship.

Where is the proof that the baby is indeed hers? The baby does not currently hold UK citizenship, she could apply for it for him but the UK does not have to grant it. That is not the same as withdrawing citizenship because never had it.

Walkingdeadfangirl · 18/02/2019 15:12

"ISIS bride Shamima Begum names baby son Jarrah ‘after barbaric jihadi warlord who massacred Jews’ at the request of her terrorist husband"

So we should just let an evil person like this waltz back into the UK.

Puzzledandpissedoff · 18/02/2019 15:14

Her parents ... don't share the views that she believed when she ran away

Since you've criticised others for asserting things for which you believe they have no proof, can I ask what evidence you're able to offer for this?

Personally I've already said I've been unable to find reports about it either way, but perhaps you have better information than the rest of us?

JellycatElfie · 18/02/2019 15:21

Surely the name she’s picked for her child is a pretty good indicator of what she believes now Hmm

Kintan · 18/02/2019 15:21

The woman in the video interviews looks very different from the photos that were released when Begum and her friends went to Syria. Can someone's features really change that much in four years?

TheRiverIsAComfort · 18/02/2019 15:26

@Walkingdeadfangirl

I agree with your point concerning the case that the baby may not be even hers at all!

Call my cynical but what an amazing stroke of luck that this reporter found her shortly before she was due to give birth and lo, a baby was born right on cue to make her case more complex and keep her in the news.

As she was wearing a full robe, I'm guessing that this reporter only had her word for her pregnancy in the first place.

I know a baby has appeared but she could have got it any number of ways. It seems bizarre to take a highly suspect person's word for anything, let alone anything that would benefit her!

SilverySurfer · 18/02/2019 15:28

Bluerussian
Please let us bring her home. She was only 15 when radicalised which is little more than a child and since then has lost two children - can you imagine something like that at such a young age? She has given birth to a fit baby now, let us forgive her and may she receive rehbabilitation treatment, others have and it has worked.

I couldn't disagree more. I think we can safely assume that it wasn't your father, husband, brother or son whose head lay in a basket after being beheaded by ISIS and upon seeing it she apparently showed no horror or disgust, nor has she shown any regret or remorse so as far as I'm concerned she can rot in Syria.

JellycatElfie · 18/02/2019 15:30

Jamie Bulger was killed by boys younger than this. They were tried as adults because they were deemed competent they knew what they were doing. Why does everyone keep mentioning her age?! She didn’t steal from boots or try drugs. She ran to a different country and is ‘ok’ with beheadings. Who’s to say she’s not the next Manchester bomber? She’s named her baby after someone known for murdering Jews ffs.

ReflectentMonatomism · 18/02/2019 15:34

the baby may not be even hers at all!

She certainly looks very healthy and relaxed for someone who has had three pregnancies in a warzone, losing two of the children to malnutrition, and has then given birth without much (or any) pain relief or medical intervention within the last 36 hours.

She's an accomplished liar, or, perhaps more accurately, someone who thinks they are an accomplished liar. Occam's Razor says you wouldn't trust her to tell you what day of the week it was.
