if he was dying the case probably wouldnt have got to court in the first place and i cant see that being the reason tbh - he is 18 years old and a dental student.

there just HAS to be more to this but im baffled.

In today's Daily Mail.
Nursery student aged 17 who abused pair of toddlers in her care, aged 2 and 3 .
She is now 18 and was sentenced to 7 years and 10 months in prison.

What if this wasn't discovered until recently? Halfway through trial eg.
I agree it's really unlikely I'm just baffled.

Can I just point out that a witness may still be required to give evidence in Scotland even when their statement is recorded on DVD. The DVD being broken or lost won’t affect that.

It would hopefully have been transcribed prior to the issue with it anyway.

nicky its same in england - evidence is chief aims to prevent the child doing it all in court but they can still be cross examined.

I’m baffled by this. I’ve never heard of it happening in relation to serious sexual offences. Minor crimes, yes.

It is meant for very minor infringements of law that the judge thinks should never have come before the court.

Truly incomprehensible. Even if you take the line that he was coerced & therefore be lenient, he is now an adult & pleaded not guilty so hasn't shown remorse.

I think the victim would have had to be cross examined even if the video evidence had been available.

Thanks for the explanation of how Scots law works, marymarkle. It seems to be the case that he has a conviction but it isn't recorded.
