To go through what he did to her, to go through a police interview and then be told it is lost, to go to court and relive it all again for hours at the hands of a very experienced defence lawyer.

That's something you don't get over, perhaps, learn to live around at best.

The idea that he’s given a free pass because of his bright future is a direct affront to the law.

A proportion (I’m beginning to think a minority) of people do not offend because they feel it is morally wrong to do so.

A proportion of people do not offend because they are afraid of the consequences , and in a civilised society that’s the law. We give up our right to go round and exact our own revenge because the law does that for us.

If the law does NOT do this, it affects society as a whole. It encourages those who need deterrent to not offend, and it leads directly to vigilante behaviour.

The rule of law is damaged by this.

That poor girl, can't even begin to imagine how the family feel. She was so brave to stand up against him and she's been completely denied justice and effectively told she doesn't matter. So more suffering for the totally innocent little girl then, sickening.

Why the fuck not? A 15-yo knows exactly what they're doing. (Absent SN yadda yadda). Too many "kids" escape justice for sexual crimes, leaving victims feeling like shit with mental health issues. I've seen it in my immediate family.

What an absolute disgrace,.poor little girl and her family it must be incredibly distressing to basically be told he has gotten away with everything he put her through. Is there a petition going to appeal/review this farcical decision?

The parents of the 6 year old girl are fully behind her and will do all they can to help her.
In many of these cases the parents don't believe the girl, or if they do believe her they still maintain that nothing bad has happened and the perpetrator should not be held accountable
and that just further compounds the damage that is done.

Whilst it is awful the fact that her parents are behind her means that she has some chance of some healing.

I thought an absolute discharge meant the crime doesn't show on a DBS check?

So does anyone actually know whether or not this non-conviction/absolute discharge WILL show up on an enhanced DBS? Or has it been completely wiped? I get that it won't show up on a standard DBS, but the enhanced one should show it, shouldn't it?

I'm properly disgusted at this. And the general attitude that females are there to service males' sexual needs whether they want to or not - and other males condone this because, probably, they agree with it.
I wonder if the judge would have been so keen to give that little shit an absolute discharge if it had been his own (the judge's) daughter - bet not!

As said his picture is out there and he will be a target for vigilante justice, it would be better for him if the law had dealt with him properly
He may end up paying a very high price

I agree that the rule of law is damaged by cases like this, vigilantism is the route to a primitive and barbaric society
No one benefits from that

Yep, it's horrific failures in the legal process which lead to vigilante justice.

He is hugely likely to reoffend and will quite likely turn into a prolific sex offender now that the courts have told him it's ok to sexually abuse small children. FFS.Hmm.

I think it will show thumb. Because his entire police record can’t be wiped? He will have been arrested and interviewed and the decision taken to prosecute.

If someone has been interviewed by the police without being arrested, the police retain a record of that. And can disclose for an enhanced dbs if it is relevant.

I don't know now, Thumbs, but 25 years ago an absolute discharge meant nothing is listed on an enhanced check, I was told.

The whole thing is a farce, why not force him to sign the SOR, to protect people (IANAL, but guessing then it would show).

Have a look at the DBS or Disclosure Scotland websites.

As they say, certain non conviction information can show on certain certificates if it's relevant.

In fact he only stopped at 17 because the girl told someone.

To be honest if it was my child he abused I’d take him out myself happily , my comment on page 1 about the fact I wasn’t sure about 15 year olds being put on the sex offenders register was actual curiosity and also being aware that that might be the reason it hasn’t happened .
People twist comments so easily on here .
To be honest sex offenders register or not , there’s no way this boy whole have a bright future and the judge knows that , he won’t pass disclosure applications for employers his picture and name is everywhere and people know what he did .

With a PVG check non conviction information, which basically as his conviction has been wiped he has, can be shown on an enhanced check if the police think it’s relevant.

So the question in this case will be - “do they think it’s relevant”

And if there is extenuating circumstances then surely for the sake of faith in the justice system they should be explained? If you are going to make someone an exception to the law then you need to explain to the public why.

We need to face facts that our justice system doesn’t support woman when sexually assaulted end of story old or young even rape doesn’t carry a heavy sentence , it’s fucking disgusting and needs to change , I’m not at all surprised they let a young boy off with this to be honest .

The article says although he was found guilty, legally he was not convicted. That is why it may not show in any DBS check, because there is no conviction.
