To sue ASDA?!

Ok so maybe not actually sue- but to be very annoyed and shaken up?

This afternoon I was shopping in a (reasonably small) ASDA supermarket picking up items for my gran.

I turned an empty aisle and noticed a ‘cleaning in progress’ sign on one side. No visible spillage and the sign was only on one side so I walked around it (gave a wide berth), Boom, I was on the floor having landed heavily on my right knee.

My fiancé, who was with me, picked me back up and another middle aged chap came running up to help. He had just fallen himself, in the exact same spot as me! The floor was coated in a slippery oil based substance - it had stained his jeans.

A minute later an employee came running up apologising profusely - the chap told her off as she had ‘wiped’ the floor after he fell but obviously done a terrible job. As I hobbled away I saw her retrieve a bucket and mop.

I went to the customer service desk and manager was called- he was nice and apologised (gave me a nominal gift card) but I wasn’t in pain, just shaken and annoyed as had that been my very elderly grandmother or heavily pregnant cousin (who it would have been had I not volunteered) it would have been very dangerous!

Since I got home my knee has seized and is now bruised and swollen in a lump. I’m 25- fit and healthy - never had anything like this happen before. But I’m really annoyed that It did- I won’t be able to cycle to my office tomorrow 😒 and expect I’ll be sore for a while. I’ve never considered suing anyone for anything but think this could easily have been avoided!

It was a mop and bucket. I watched her do it.

And did the mop and bucket mysteriously appear at her side because she needed it? Or did she telepathically inform another member of staff and they brought it to her?
Or ya know did she put a sign up, and go and get the mop because the other two options are not very likely?
You ignored the sign.
And the sign was likely one that warned of cleaning in progress on one side and wet floor on the other. The employee doesn't choose the sign, they are pretty much standard, and as it was in an aisle the cleaning in progress side needed to be facing one way or the other. Most of those signs have imagery too, for those who don't read and are bright yellow to attract attention.
I'll say it again, YOU ignored the sign that was put there so the staff member could get the correct equipment to clean it up.
You're annoyed at the wrong person!

puzzledlady · 18/11/2018 20:28

Just woman up for gods sake op!!!!! All over a bloody bruise!? I hope you didn’t get that poor woman done sort of telling off or a warning against her job. ❄️

IHopeThisIsAGoodIdea · 18/11/2018 20:29

Don't leave OP, tell us again how reasonable and non-grabby you are...this time we might agree. Halo

MarthaArthur · 18/11/2018 20:33

dwangela thats almost worth a broken toe Grin

TattiusTeddius · 18/11/2018 20:34

A few years ago I broke my toe on a nailed-down chair at a performance of the Ladyboys of Bangkok. I should've sued really sarcasm but it was actually worth the pain when my friend quipped "This incident shall hereforth be known as the Ladyboys of Bangfoot" Grin

TattiusTeddius · 18/11/2018 20:35

Actually you're right OP. This kind of thing just screams "safe to pass"

To sue ASDA?!
ShotsFired · 18/11/2018 20:35

Boy, are you not ready to hear about the concept of "accidents" OP!

shamofamockery · 18/11/2018 20:38

Was it a cleaning in progress sign or a wet floor sign? If a wet floor sign, no chance love.

MarthaArthur · 18/11/2018 20:39

Well the ops apparently been in 2 car accidents so seems to just be accident prone in general. You would have thought she would have gotten the concept by now.

LGRACEJONES · 18/11/2018 20:40

Sue them. This shouldn't have happened. If it had been an older person it could have had serious consequences.

Nightgremlin · 18/11/2018 20:40

Wet floor one side, cleaning in progress the other

To sue ASDA?!
fruitshot · 18/11/2018 20:42

You fell over.
Where cleaning was obviously happening.
You banged your knee and have a bruise.
Move on.

Sparklingbrook · 18/11/2018 20:44

OP stated it was a 'Cleaning in Process' sign.

BumDisease · 18/11/2018 20:44

"Sue them. This shouldn't have happened. If it had been an older person it could have had serious consequences."

So we can sue on the back of hypothetical situations now?

SheCameFromGreeceSheHadaThirst · 18/11/2018 20:46

It’s annoying and it doesn’t feel very fair

Annoying and not very fair - yep, grounds for legal action right there Hmm

MarthaArthur · 18/11/2018 20:47

"Sue them. This shouldn't have happened. If it had been an older person it could have had serious consequences."

It could have been a visiting alien from mars visiting and their fall could have caused intergalactic tensions. But it didnt so it doesnt matter.

Purplehammer · 18/11/2018 20:51

breakyourselfagainstmystones you think someone who works at ASDA has a “shitty disgusting job”.
It may well be far beneath your dignity to work in a supermarket but you don’t know that persons circumstance.

Sparklingbrook · 18/11/2018 20:51

I assume this will all be on CCTV.

Talkingfrog · 18/11/2018 20:51

I would usually expect a sign like that to be put directly by the spillage so people go around. The sign being at the edge of the aisle is no use as it directs people around it as op did.
I haven't read the full thread so apologies if it has already been asked, but did they dill in the accident book. They should have completed it for both you and the other gentleman. If not, I would want to know why.
They have potentially admitted fault by giving you a voucher as the manager considered there was something to compensate you for.
I am not saying it is the fault of the individual who came with the mop. She may have put the sign in the right place while she went toget the mop and bucket, to come back and ding someone had moved it.
If you gave come out with an injury since, that 8s causing you pain and was not obvious ag the time I would say they need to know.

I would be tempted to write to the manager, include pictures of your injuries and ask for them to confirm that the accident book correctly reflects the injuries caused. Also ask for clarification as to what actually happened (it may be on camera) and how tgey intend to prevent it happening again. If you don't get a suitable reply forward to head office.
I was in sainsbury and a bloke dropped some glass. He just shrugged carried on walking. I told a member of staff nearby (she was facing the other way. We both stayed there and she called for someone else to bring things to clear it up. We both warned people approaching to watch our for the glass until it was cleared up.

As far as I know noobe was hurt, but if I hadn't seen it, and we were in a different part of the store (I was near bakery so there were staff nearby), it could have been a different story.
Hope your knee gets better soon.

Nightgremlin · 18/11/2018 20:52

@SparklingBrook

I turned an empty aisle and noticed a ‘cleaning in progress’ sign on one side.
From the OP, I must have overlooked 'cleaning in process' in OPs later posts.

Sparklingbrook · 18/11/2018 20:54

It was some sort of unfinished cleaning business Nightgremlin Grin

Nightgremlin · 18/11/2018 20:57

@SparklingBrook

The sign could have said
'Mind thee step flower, t'floors a bit skitey, tha might end up on tha's arse'

And someone will still ignore it, walk through the area then moan when they fall 😁

I may market such a sign 🤔

Breakyourselfagainstmystones · 18/11/2018 21:00

Purplehammer being a cleaner is a shitty disgusting, underpaid job, I am one, not beneath me at all.

RogerBannister · 18/11/2018 21:03

Why have you bothered to ask if you’re being unreasonable as you clearly don’t think you are, and obviously don’t care what other posters think. Pointless thread.

Biancadelriosback · 18/11/2018 21:03

It was an accident and you banged your knee. I'm curious why you can't cycle tomorrow though... This looks like a normal bruise so how will it prevent you from cycling?

My toddler nutted me in the mouth today and my bottom lip burst and is all swollen now (look like I've just had fillers!). Maybe I should sue him?
