To sue ASDA?!

Ok so maybe not actually sue- but to be very annoyed and shaken up?

This afternoon I was shopping in a (reasonably small) ASDA supermarket picking up items for my gran.

I turned an empty aisle and noticed a ‘cleaning in progress’ sign on one side. No visible spillage and the sign was only on one side so I walked around it (gave a wide berth), Boom, I was on the floor having landed heavily on my right knee.

My fiancé, who was with me, picked me back up and another middle aged chap came running up to help. He had just fallen himself, in the exact same spot as me! The floor was coated in a slippery oil based substance - it had stained his jeans.

A minute later an employee came running up apologising profusely - the chap told her off as she had ‘wiped’ the floor after he fell but obviously done a terrible job. As I hobbled away I saw her retrieve a bucket and mop.

I went to the customer service desk and manager was called- he was nice and apologised (gave me a nominal gift card) but I wasn’t in pain, just shaken and annoyed as had that been my very elderly grandmother or heavily pregnant cousin (who it would have been had I not volunteered) it would have been very dangerous!

Since I got home my knee has seized and is now bruised and swollen in a lump. I’m 25- fit and healthy - never had anything like this happen before. But I’m really annoyed that It did- I won’t be able to cycle to my office tomorrow 😒 and expect I’ll be sore for a while. I’ve never considered suing anyone for anything but think this could easily have been avoided!

To sue ASDA?!

Think a bit deeper, if you are able, before you wade in with hatred. If they are sued it may force Asda to put in measures to stop this happening to an older person.

Nobody knows who caused the spillage. Probably another customer.

You sound very grabby. It was your own fault for disregarding the sign
The comments about who it could've happened to just make you sound like a compo hunter from local papers

Perhaps the warning sign was not near the spill because the employee couldn't see it - just like you couldn't see it.......nor did the bloke who slipped before you.

Accidents happen OP.

And you are wrong to suggest that people should run away from warning signs - it's dangerous to run in crowded areas, you might hurt yourself or someone else (who may be tempted to sue you......)

Op saw the sign, op knew there was cleaning in progress. Op assumed it was ok to walk around the sign. Op assumed wrong and hurt her knee. Op is being unreasonable.

Split liquids do not stay on one side of an aisle. Its common sense. If you ignore a 'cleaning in progress' sign and walk down the aisle anyway you assume responsibility for any consequences.

Expecting to see adverts for 'No win No fee' lawyers on my screen now.

Also, I doubt you're not after compensation, if you'd like to ask them to change how they do things (block the whole aisle instead of just a sign for example) then why not just use the complaints procedure?

YABU. The bruise looks sore and I bet the shock/embarrassment of the fall hurt even more at the time. Mega annoying, absolutely! But that's all it is. Accidents happen. No doubt it was some other customer, as opposed to Asda, that spilt something and the staff have cleaned up what was visible, then left out a sign. You're not badly injured, you've had a gift card and profuse apologies - get over it.

I went arse over tit on an oily cobblestone by a kebab van once - it was dark, but something had obviously been spilled there by the look of my coat. I bashed my knee badly enough that several months later I had to explain what had happened to a midwife as I couldn't get on my hands and knees whilst in labour! I have always found it a vaguely amusing story - I hope you come round to this way of thinking OP as otherwise you will stew on your sore knee and the whole thing will be even more annoying for a lot longer than it warrants.

Not sure why op is getting quite so much grief. Asda owes all customer a duty of care. They’ve put a sign out and a customer gave it a wide berth and slipped and us injured herself. Accidents do happen. Just don’t know enough about this to know whether this was a simple accident or Asda didn’t properly ensure safety of a customer. Anyway hope the knee recovers quickly.

I am imagining a bottle of olive oil fell off the shelf and smashed
spilling everywhere. The cleaner would put the sign over the broken glass and clean that up first. Ailse's in a small Asda are not massively wide so the spillage is going to cover the whole area.

Assuming you can go around an invisible spillage, is taking a risk. You have to apply some common sense and accept responsibility for your own accident.

Cant see what else Asda should have done short of declaring a national emergency.

The sign was a warning. It may even have actually been cleaned up: those signs are used both to inform you of a spillage and also to let you know the floor could be wet FROM cleaning!

The signs are also always 'small folding ones'.

Pay attention next time ;)

Why would it stop you cycling? These are my legs after pole fitness and aerial hoop this week 🤷🏽‍♀️ I generally look like this most of the time!
No I wouldn't sue. I have claimed from a shop when I picked up a lava lamp type thing which leaked and spilt oily liquid all over my brand new coat. They replaced the coat for me after dry cleaning didn't work

Why on earth would you sue someone when YOU stuck your fingers into someone's letterbox, which is on THEIR property, and the dog, in their OWN home, protected their territory?!

My favourite quote of the OP, in her 'I'm the least claim culture person' is where she tries to prove this by stating she's had two non-fault car accidents and not sued because she wasn't hurt in them...
