To sue ASDA?!

Ok so maybe not actually sue- but to be very annoyed and shaken up?

This afternoon I was shopping in a (reasonably small) ASDA supermarket picking up items for my gran.

I turned an empty aisle and noticed a ‘cleaning in progress’ sign on one side. No visible spillage and the sign was only on one side so I walked around it (gave a wide berth), Boom, I was on the floor having landed heavily on my right knee.

My fiancé, who was with me, picked me back up and another middle aged chap came running up to help. He had just fallen himself, in the exact same spot as me! The floor was coated in a slippery oil based substance - it had stained his jeans.

A minute later an employee came running up apologising profusely - the chap told her off as she had ‘wiped’ the floor after he fell but obviously done a terrible job. As I hobbled away I saw her retrieve a bucket and mop.

I went to the customer service desk and manager was called- he was nice and apologised (gave me a nominal gift card) but I wasn’t in pain, just shaken and annoyed as had that been my very elderly grandmother or heavily pregnant cousin (who it would have been had I not volunteered) it would have been very dangerous!

Since I got home my knee has seized and is now bruised and swollen in a lump. I’m 25- fit and healthy - never had anything like this happen before. But I’m really annoyed that It did- I won’t be able to cycle to my office tomorrow 😒 and expect I’ll be sore for a while. I’ve never considered suing anyone for anything but think this could easily have been avoided!

To sue ASDA?!

What outcome do you want from sueing them exactly? When you say sue them, what for specifically?

But there was a sign in the isle and like you said, no visible spillage.

Exact same thing happened to me at Morrisons. DH went mad when they said to him that "it hadn't been sorted because the shop isn't open yet". She meant the tills weren't open. The shop clearly was as we were in it! We got some flowers after we asked for the manager!

You say there was no 'visible' spillage, so is it possible when cleaning up the staff member didn't see a bit was missed?

There was a sign in the aisle. What do you expect the store to do? This 'let's sue culture' is nuts... take responsibility yourself.

It was unfortunate, but there was a sign. The employee has already been bollocked. You've had a gift card, and it wasn't either your grandmother or cousin. How much more grabby can you be?

They are legally covered because they had put out signage. You could complain, but anything they give you will be a token gesture.

YABU. There was a sign alerting you to the fact that cleaning was in progress. You saw it, you were aware of it, looking after yourself is your own responsibility.

Unless you can’t walk again or ever work or your small children have to change your nappies for you due to injury then YABU

just take the gift card. And get on with life.

Happened to me in Asda too. Except in the fruit and veg section. I face planted into a crate of tomatoes. Was mortified and couldn't get out fast enough.

They had a sign there, there was no visible spillage, they will have filled in paperwork to say a spillage was cleaned up and have other paperwork to demonstrate that they are usually good at cleaning spills.

The whole 'it could have been x or y person' is a pointless argument because it wasn't them, it was you.

You will probably get 2 or 3 hundred quid thrown at you after a few months of to and fro between you and asda, they won't accept responsibility but give you it to shut you up and get rid of you.

Not worth the aggro, accidents happen sometimes.

I don’t need money so it’s not that I want to sue for a pay day. I just feel wronged - I’m sat here on my Sunday night having a seized up knee- having to go back to work with a sore knee for the week!

It’s annoying and it doesn’t feel very fair.

Goodness me, these things happen. The “what if” about your pregnant cousin are completely irrelevant.

They had a sign up warning you, what more do you expect? You could have chosen to avoid the aisle.

If you were going to be off work, or your knee was damaged enough to need treatment then you could push for compensation even if there was a sign.

But for a bruised knee and a bruised ego I don't think so

You've got a gift card which is more than enough. I'm not sure what else you want from them? I understand it hurts and you're probably a bit embarrassed but surely it's just an unfortunate accident?

This isn't fair either, a minimum wage employee in a shitty, disgusting job, getting 'told off' by a member of the public when she came over to apologise for not seeing something that you and the other guy couldn't see either.

🤔 I’m not grabby - I’m annoyed. The ‘sign’ was pushed right up against one side of a wide isle and I walked down the other side- they hadn’t closed the aisle and I was the second person to fall in the space of a few minutes.

Pretty sure that’s over and above ‘take responsibility for yourself’
