Mark Judge says (under penalty of felony) that he avoids public speaking engagements due to anxiety, meanwhile his publisher literally lists him as a public speaker. Maybe instead of a subpoena the Senate can just book him to speak...

Grassley will brush this off, just like he did to the ABA. They do not care. God could part the cupola, float in on a cloud and Grassley would cite regular order and dismiss him with a flourish of his gavel.

Coons returns, chatting with Feinstein. The vote was supposed to have started at 130p

We are three minutes from the vote and STILL no sign of Flake.

We are still waiting for Flake to return to hearing room. He’s been out for more than 30 mins. It’s unclear if Flake will speak

Lots of chatter on Dem side initiated by Coons and now with Feinstein staff director. Now Feinstein heads to anteroom, with Coons.

Coons just returned, whispering to Feinstein’s staff director

Flake just got up and left the hearing room and asked to speak privately to Coons in the ante room.
They are close friends; Coons became emotional and upset this AM when he learned about Flake’s support of Kavanaugh

in short, something is happening in the ante room, where Flake disappeared to w/ Sen. Coons about 45 min ago.
Several other Dems then joined them.
Now Rs have been cycling in and out of the room.
Vote still skedded for 1:30 for now, but a lot of movement/convos happening

Grassley has been out of the room and is now back but Feinstein has left. Twitter comment that Grassley not trying to take the vote which is unusual. If he thought he could do this, he would do it.

MSNBC reporting a possibility that the vote will be delayed for the FBI to reopen briefly the background check. This was the compromise that Klobuchar proposed.

.@KellyO reports just now on @msnbc that there are "serious discussions" underway right now about a delay in the vote so that the FBI could reopen the background check. That is the cause for the delay, she says.

Grassley has now reopened the meeting. Flake is now speaking as a point of personal privilege. Flake proposing that the floor vote is delayed to allow the FBI to reopen the investigation for one week.

The Senate can't force the FBI to investigate. Only the White House can. But Flake is saying he won't vote for Kavanaugh on the floor without further investigation.

Flake will advance the Kavanaugh nomination to the Senate floor, but he has made clear that he has the votes (Collins, Murkowski?) to delay the final floor vote for a week, allowing an FBI investigation.
