Bathroom comes with the house??!!

So DH and I have just bought a new house (not brand new but new to us :)) and it cost us a lot of money (far more than a care to admit! :))
We moved in yesterday, the house is perfect except for one thing...

They've taken the bloody bathroom with them!!!!

One of the two main bathrooms upstairs is literally empty, like I don't mean just the furniture which you obviously take with you. But they've taken the bath, sink and shower!!!!

The room is tiled but theres random pipes sticking out of walls where these things should be!! The only thing left is the toilet. I honestly don't know what to do... We were going to redo the bathroom anyway at some point but never told this to anybody and weren't planning to do so until at least November/December time but now we don't have a choice!!

The kids come home from the holiday with my in-laws on Tuesday and we've got no bathroom for them!!!!

AIBU to think that the bathroom comes with the house, or is it totally reasonable to take the bathroom with you to your new house??!!

Solicitor at once. This is breach of contract. My sister moved into a house with a very expensive kitchen - only to find that the two biggest base units had been exchanged for cheap ones and all the door handles throughout this very expensive property were now plastic and not pewter. A couple of phone calls and letters and money was forthcoming for two new base units and pewter door handles, plus installation costs, plus extra solicitor's fees , plus a sum for 'inconvenience. Bet they wished they hadn't tried that one!

When we bought our first house (looong time ago) we bought a Which book callled "Buying a house or flat" which became our bible. I don't know whether they still publish it though as much has changed. There are quite a few articles on their website though which might be worth a look- I think you can read them without being a member.

I just filled out one of these forms today as I’m selling my house. I noticed from the tick list that you could state of the bath, taps, shower etc were included, excluded or not applicable. But there was no mention of the toilet. I thought of this thread and wondered if I should add a line and my own tick box but decided the buyers would think me mad. I guess this means I could take the loo though and they wouldn’t be able to argue!

We are planning on taking the bathroom cabinets, they are expensive and often particular to taste

What?! I've never heard of anyone removing entire bathrooms. How odd. Where will they store it in the mean time assuming their new property already has a bathroom suite? Hopefully the solicitor has been in touch by now.

The whole buying/selling system in this country is shit. To think that someone thinks it’s ok to take a bathroom or kitchen just proves it. We’ve just sold our house and I’m leaving the curtains, blinds, light fittings and even the freestanding wardrobe if they want it! Plus more. There needs to be standard fittings and fixtures which are including unless specifically stated. It’s just a shame that these specifics are sorted well after you’ve agreed on a price. Makes you wonder why sales fall through, chain is broken and you have to start all over again!!

Vendor: 'We didn't steal the bathroom. Someone else must have stolen it after we moved out on Friday but before they moved in on Saturday

That kind of defense might stop them being prosecuted for theft, which has to be proven beyond reasonable doubt, but if a judge in civil case has to decide on the balance of probability who was responsible for the missing fixtures, is he really likely to conclude it was most likely the OP or burglars who dismantled the bathroom?

The real issue with regard to getting money back is not proving that it's owed, it's finding the people and enforcing judgement. (Though if they are in the UK and have just sold a house, you would think they have some money they can be sued for.)

There needs to be standard fittings and fixtures which are including unless specifically stated.

I think fixtures are included as standard, they only need to be specifically mentioned if they are being taken.

I don’t want to worry you but you need to talk to solicitor as soon as. If you had viewed this house with no bathroom you would’ve struggled to get a mortgage on it. They can’t take a bathroom and even if it had been I dictated on fixtures and fittings then solicitor should’ve noticed as mortgage company would’ve had an issue. Yiu’ll Get it sorted but don’t underestimate how cf this is.

It's not a question of theft but the house not being sold as described - i.e. A issuing bathroom

Plus for a theft to have occurred there would've been a broken lock or window

Plus the removal men would've been with them on arrival

Wow! Not normal. Obvs see your solicitor. Wonder why they took it, they will have had a bathroom in their new places and 2nd hand is not worth much
